HomeMy WebLinkAbout1973-07-03 I 1 I Bozeman, Montana 3 July 1973 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 3 July 1973, at 1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Comm- issioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't. City Manager Keyes and the Clerk. Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held Wednesday, 27 June 1973, were approved as read. Open Bids - Sidewalk & Curb Construction This was the time and place set for receiving bids for the repairing and reconstruction of mis- cellaneous sidewalks and curbs. Affidavit of publication of "Notice to Bidders" was presented and it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the bid of Binder Constru- ction Company, Bozeman, being the only bid submitted be opened and read. Binder Construction Company, Bozeman $20,479.00 The Commission concurred with the recommendation of the City Manager and it was moved by Comm- issioner Lehrkind, seconded by Commissioner Vandeventer, that Binder Construction Company be awarded the bids for the sidewalk and curb construction on the basis of his bid as set forth above and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow; those voting No, none. Open Bids - Gravel Supply This was the time and place set for receiving bids for 2,000 tons 3/4 inch gravel and 4,000 tons 1/2 inch gravel to be used for street and alley maintenance, to be paid out of Gas Tax HB254 funds. Affidavit of publication of "Notice to Bidders" was presented and it was moved by Commissioner Vande- venter, seconded by Commissioner Vollmer, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. The following bids were then opened and read: Bozeman Sand & Gravel, Bozeman $13,080.00 Grabill Trucking, Bozeman l2,700.00 In concurrence with the recommendation of the City Manager, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that Grabill Trucking, Bozeman, be awarded the bid for 2,000 tons 3/4 inch gravel and 4,000 tons 1/2 inch gravel in the amount of $12,700.00 contingent upon receiving the Montana State Highway's written approval and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Comm- issioner Vahaeventer, Mayor Grabow; 'those voting No, none. South Third Avenue Sidewalks: The petition signed by ten property owners along the East side of Third Avenue South between South Grand Avenue and Kagy Boulevard protesting the action of the City Commission concerning the installation of sidewalks was removed from the table and it was moved by Commissioner Sedivy, second- ed by Commissioner Lehrkind, that they grant the request for a variance of the sidewalks along the east side of-Third Avenue South between Grand Avenue and Kagy Boulevard for a period of one year to 1 July 1974 and the motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Unnumbered Resolution - Purchasing Oil from Montana Highway Department, Fiscal Year 1974 An unnumbered resolution authorizing the purchase of not to exceed 25,000 gallons of Road Oil during the fiscal year 1 July 1973 to 30 June 1974 for use by the Street Department in repairing pavement and for sealing certain sections of existing pavement within the City from the Montana State Highway Department was presented as follows: RES 0 l:U T ION ---------- WHEREAS the City of Bozeman will have need during the fiscal year July 1, 1973 - June 30, 1974, for road oils for use in repairing streets and for sealing certain sections of existing pavement with- in the City, and WHEREAS the City of Bozeman does not have proper facilities for handling and storing the needed quantities of oils, and WHEREAS the Montana State Highway Department does have storage facilities and normally does have quantities of the required types of oils stored in Bozeman from which it can supply the quantities - 4~19 - 450 needed by the City of Bozeman, NCM, 'l1IEREFORE, be it resolved: That an emergency does exist relative to the procurement of road oils by the City of Bozeman and the City Manager is hereby auth- orized to purchase from the Montana State Highway Department, from its stocks in storage in Bozeman approximately twenty-five thousand (25,000) gallons of road oil, this to be purchased from time to time during the fiscal year July 1, 1973 - June 30, 1974, as needed by the City of Bozeman for repair and sealing of exist- ing pavements, and these quantities of road oils to be purchased at cost plus normal handling charges. Passed and adopted by the City Commission of Bozeman, Montana, at a regular meeting of said Commission held on the 3rd day of July, 1973. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the resol- ution be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Request for using Portion of Old City Dump for Gallatin County Motor Vehicle Graveyard A letter received from the Gallatin County Commission requesting that the 4-5 acre site at the old City Dump be granted for use by the County as the motor vehicle graveyard as required under Chap- ter 410 of the Montana Law of 1973 was presented. Following a discussion, the Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that they acknowledge receipt of the request and take it under advisement and refer it to the City County Planning Board for their decision. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Request for Connection to City Sanitary Sewer - G-B Properties 91.2 acres Northwest of City A letter received from G-B properties, Inc., requesting that the City grant them permission to connect to the City sewer in the East half of the East half of Section 35, Township 1 South, Range 5 East, 91.2 Acres, Gallatin County, Montana, was presented. Following a discussion, and in concurrence with the recommendation of the City Manager, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that they take the letter under as- visement and that the letter be referred to the City County Planning Board for a specific zoning recommendation and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind. Commissioner Vandeventer, ~ and Mayor Crabow; those voting No, none. Reques t for Aba temen t of Sidewalk Order - Allan Green A letter received from Mr. Allan W. Green requesting a variance of the curb, gutter and sidewalk construction ordered by the City Commission at the Corner of South Willson Avenue and West Olive Street for a period of one year was presented. Following a discussion it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that they table Mr. Green's request for a period of one week in order that they might make an on the ground inspection of the area. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, and Mayor Grabow; those voting No, none. Appointment to Community Recreation Board - Allan W. Green - - - - - Mrs. Ed. (Pe~~y) Hines John Robinson - - - - - - 30 June 1974 - 30 June 1975 - 30 June 1976 It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that they concur in the Mayors initial appointment to the Community Joint Recreation Board on a three year staggered term as follows: Allen W. Green Mrs. Ed. (Peggy) Hines John Robinson to 30 June 1974 to 30 June 1975 to 30 June 1976 The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow, those voting No, none. The Commission instructed the City Manager to address a letter to the past members of the Park and Recreation Board in recognition and commending them for their many years of service. I 1 I I 1 I Reports: The following reports were presented. Building Inspector Librarian Fire Chief The City Manager commented on the reports and recommended approval thereof. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, and Mayor Grabow; those voting No, none. Claims for June Claims No. 15722 thru 15891 and 4275 thru 4438 inclusive were presented. The City Manager chec~ the claims and found them to be true and lawful claims against the City and recommended they be approved and the Director of Finance be directed to issue warrants in payment. It was moved by Comm- issioner Vollmer, seconded by Commissioner Sedivy that the following claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. The Building Inspector had recommend- ed the continuation of the Montana Power Company Bond. The Commission concurred in the recommendation of the Building Inspector also concurred in by the City Manager and it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the continuation of the Gas Fitters Bond for Montana Power Company be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Seal Coat Contracts for Execution - Project No. 212(23) The contractclocuments for the construction of approximately 72 blocks of City Streets and in- cluding all labor, materials and equipment to seal coat said streets as awarded to Bozeman Sand and Gravel, Bozeman was presented. TheCity Manager recommended that the contract documents be approved. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the contract docu- ments be approved and that the Mayor and Clerk of the Commission be authorized and directed to sign the contract for the City of Bozeman and that Bozeman Sand and Gravel be authorized and directed to proceed with the seal coating and the motion was carried by the following Aye and No vote: those voting aye being Commissioner Lehrkind, commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Acceptance & Final Payment - SID 514. 516, 517, C. W. Schmid, Inc., The Certificate of the Engineer of Thomas, Dean & Hoskins, Inc., on Special Improvement Distric No. 514, 516 and 517 stating that the construction of the sanitary sewer improvements by C. W. Schmid, Inc.. having been completed in accordance with the terms and stipulations given in the plans and specifications was presented. The City Manager concurred in the recommendation of the engineers and recommended that the proj- ect be accepted and approved by the City Commission and final payment made. This final acceptance and payment does not relieve the contractor of the responsibility for negligence or faulty materials or workmanship with the extent and period provided by law. The contractor has furnished a performance bond equal to the contract bid to guarantee meteial and workmanship for a one year period commencing upon the final acceptance. Following a discussion, the Commission concurred in the recommendation of the City Manager that in connection with a letter received from C. W. Schmid, Inc., that the final payment be made to C. W. Schmid, Inc., and AStna Casualty & Surety Company at 709 Spokane and Eastern Building, Spokane, Wash- ington, in care of E. E. Midgley, Claim Supervisior. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the project be accepted as completed and payment be made as specified and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. t' i 451 452 Examination of Depository Securities In compliance with the provisions of Section 16-2618, R.C.M., 1947, the City Commission proceeded to examine the receipts of Depository Bonds and Securities held by the Director of Finance as Security for City funds deposited in Bozeman banks. It was moved by Commissioner Vollmer, seconded by Commiss- ioner Sedivy, that the securities be approved and a list of these be set forth in full in the minutes of the meeting and the motion was carried by the following Aye and No vote: those Voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none.
