The Commission of the City of Bozeman met in regular session in the Commission Room, Munic-
ipal Building, 11 July 1973, at 1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy,
Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't.
City Manager Keyes, City Attorney O'Connell and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceedings were
had.
Minutes of the regular meeting held Tuesday, 3 July 1973, were approved as read.

Resolution 1592, Creating SID 529
This was the time and place set in Commission Resolution No. 1587, to hear protests to the
~eation of Special Improvement District No. 529, construction of Water and Sewer on North 21st
Street between Beall and Durston Road. Affidavit of publication of Notice and the Clerks mail-
ing certificate stating that all property owners had been notified as required by law were pre-
sented. There were no protests on file and no one appeared to protest verbally. It was moved
by Commissioner Sedivy, seconded by Commissioner Lehrkind, that Commission Resolution No. 1592
creating Special Improvement District No. 529, entitled Commission Resolution No. 1592 set forth
in full:

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING
A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT
NO. 529 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF A WATERMAIN
AND SANITARY SEWER MAIN AND APPURTENANCES TO SERVE THE ADJOINING PROPERTIES
AND MORE SPECIFICALLY DESCRIBED AS FOLLOWS: A SIX (6) INCH WATERMAIN AND
APPURTENANCES ON THE ENTIRE LENGTH OF NORTH TWENTY-FIRST AVENUE BETWEEN

INCH SANITARY SEWER LATERAL MAIN AND THE NECESSARY APPURTENANCES ON THE EN-
TIRE LENGTH OF NORTH TWENTY-FIRST AVENUE BETWEEN BEALL STREET AND DURSTON
ROAD TO SERVE LOTS 1 THROUGH 15 OF BLOCK 3 AND LOTS 18 THROUGH 33 OF BLOCK
2 OF WEST PARK MANOR, SECOND ADDITION TO THE CITY OF BOZEMAN, MONTANA.
THE CONSTRUCTION AND INSTALLATION OF THE WATERMAIN TO INCLUDE ALL TRENCH
EXCAVATION AND BACKFILL, BEDDING MATERIAL, CAST IRON WATERMAIN, VALVES,
FITTINGS, HYDRANTS, SERVI CE LINE STUBS, AND OTHER NECESSARY APPURTENANCES.
THE CONSTRUCTION AND INSTALLATION OF THE SANITARY SEWER MAINS SHALL INCLUDE
ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIAL, INSTALLATION OF SEWER
MAIN, NECESSARY WYES, SERVI CE LINE STUBS, MANHOLES, AND OTHER NECESSARY
APPURTENANCES THERETO.

Open Bids SID No. 531, Paving Circle Drive
This was the time and place set for opening bids for the construction of paving and instal-
lation of necessary storm drain on Circle Drive and a portion of Spring Creek Drive in Westridge
Subdivision SID No. 531. Affidavit of publication of "Notice to Bidders" was presented. It
was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the bids be opened
and read and the motion was carried

The Commission concurred with the recommendation of the City Manager and it was moved by
Commissioner Vandeventer, seconded by Commissioner Vollmer, that the bids be referred to the con-
sulting engineer and the City Engineer for final tabulation and recommendation and the motion

Open Bids, Leasin~ of Police Vehicles
This was the time and place set for opening bids for the leasing of three sedans and one
station wagon to be used by the Police Department of the City of Bozeman. Affidavi t of publication
of the "Call for Bids" was presented. It was moved by Conmlissioner Vollmer, seconded by Commis-
sioner Sedivy, that the bids be opened and read and the motion was carried by the following A:ye
and No vote: Those voting A1e being Commissioner Vollmer, Conmlissioner Sedivy, Commissioner
Lehrkind, Commissioner Vandeventer, and Mayor Grabow: Those voting No being None.

The Commission concurred with the recommendation of the City Manager and it was moved by
Commissioner Sedivy, seconded by Commissioner Lehrkind, that the bids be referred to the Chief
of Police for tabulation, review and recommendation and the motion was carried by the following
Aye and No vote: Those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner
Vandeventer, Commissioner Vollmer, and Mayor Grabow: Those voting No being None.
Mr. Robert Soper - Exchange Club I Regardin~ Fourth of July Fireworks
Mr. Robert Soper of the Bozeman Exchange Club appeared before the Commission to express
the concern of his club as to the lack of paid attendance at the Fourth of July Fireworks display
so that the club will be able to continue this project. He suggested that the City consider the
possibility of regulating parking in the area so as to be able to charge those who viewed the
display the admission fee. The Commission thanked Mr. Soper for attending the meeting and express-
ing his views.
Request to Use Temporary Storage Building - Harrison Tire Co.
A letter received from Mr. William E. Harrison of the Harrison Tire Supply, 316 East Bab-
cock, requesting permission to move a frame structure from 128 East Babcock to the back of their
lot at 316 East Babcock Street for the purpose of temporary tire storage on a temporary basis was
presented.
Following a discussion, the Commission concurred with the recommendation of the City Manager
and it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that they deny
the request to move a frame structure on a temporary basis and the motion was carried by the
following Aye and No vote: Those voting Aye being Commissioner Vandeventer, Commissioner Vollmer,
Commissioner Sedivy, Commissioner ,Lehrkin d" and Mayor Grabow: Those voting No being None.
Request for Pedestrian Crossin~ - Main Street at Sr. High School
A petition received from residents and property owners living near Bozeman Senior High
School requesting that maintenance of a pedestrian crossing to be located near the Bozeman Senior
High School and the Pittsburg Paint Store on West Main Street on a year around basis be considered.

The Commission concurred in the recommendation of the City Manager and it was moved by
Commissioner Vollmer, seconded by Commissioner Sedivy, that the request be relayed on to the
State Highway Department for their consideration, action and advisement. The motion was carried
by the following Aye and No vote: Those voting Aye being Commissioner Vollmer, Commissioner Sedivy,
Commissioner Lehrkind, Commissioner Vandeventer, and Mayor Grabow: Those voting No being None.
Request to Conduct Parade - Little League Baseball, 15 July 1973.
A letter received from Arnold Foss, Little League President, requesting that the Bozeman
Little League Baseball organization be authorized permission to have a parade on 15 July 1973
was presented. The Parade will begin at the Montana National Bank and proceed down Main Street
to Church Avenue then right to Bogert Park where it will terminate.
It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind. that permission to
have the parade be granted and the motion was carried by the following Aye and No vote; Those
voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer. Commissioner
Vollmer, and Mayor Grabow: Those voting No being None.
Application for Beer License - Town Pump
An application for a one-half year off premise beer license along with the appropriate
fee from the Town Pump was presented. The City Manager stated that he knew no reason to deny
this application and recommended approval thereof. It was moved by Commissioner Lehrkind. seconded
by Commissioner Vandeventer, that the application be approved and the Director of Finance be
instructed to issue the license and the motion was carried by the following Aye and No vote:

Commissioner Vollmer, and Mayor Grabow: Those voting No being None.
Authority to Advertise Sale of Lot 3 & No.5' Lot 4, Block H, Alderson Addn.
Sale 8 August 1973
The City Manager requested authority to advertise for the sale of Lot 3 and the No.5'
of Lot 4, Block B. Aldersons Addition.
It was moved by Commissioner Vandeventer, seconded by Commissioner VOllmer, that they
approve the City Managers request to advertise the above land for sale and the Clerk of the Com-
mission be authorized and directed to publish a "Call for Bids" for the sale of Lot 3, &, No.5'
Lot 4, Block B, Alderson Addition to be opened 8 August 1973. The motion was carried by the
following Aye and No vote: Those voting Aye being Commissioner Vandeventer, Commissioner Vollmer,
Commissioner Lehrkind, Commissioner Sedivy, and Mayor Grabow: Those voting No being None.

The City Manager commented on the reports and recommended approval thereof. It was moved
by Commissioner Vollmer, seconded by Commissioner Sedivy, that the reports be approved and ordered

Mrs. H. B. Manley - Re~ardin~ Opposition of Auto Graveyard
Mrs. H. B. Manley of North of Bozeman appeared before the Commission to voice the vigorous
opposition of the entire neighborhood as to the use of the Old City Dum.~.as a motor vehicle
graveyard by the County. The Commission thanked Mrs. Manley for coming and stated they would
take the request under advisement.
Sidewalk Order by Larry Green
Mr. Greens request for a variance of the curb, gutter and sidewalk construction ordered
by the City Commission at the corner ot South Willson Avenue and West Olive Street for a period
of one year was removed from the table following an on the ground inspection of the area.
It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that they grant
him a variance for the alteration of South Willson Avenue only for a period ot one year and the
motion was carried by the following Aye and No vote: Those voting Aye being Commissioner Sedivy,
Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, and Mayor Grabow: Those
voting No being None.
Execution of Contract Documents - Sidewalks & Curbs, Binder Construction Co.,
The performance bond and contract documents tor the contract of Binder Construction Com-.
pany, Bozeman, awarded 8 July 1973 for the construction of miscellaneous walks and curbs within
the City of Bozeman for the year 1973. The bond and contract were approved as to form by the
Ci ty Attorney and the City Manager reported that the City had evidence the contractor is adequately
insured and recommended the documents be approved. It was moved by Commissioner Lehrkind, seconded
by Commissioner Vandeventer, that the contract be so approved and the Mayor and Clerk be directed
to sign the contract for the City and Binder Construction Company be authorized to proceed with
the construction of the sidewalks and curbs and the motion was carried by the following Aye and
No vote: Those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner
Sedi vy, Commissioner Vollmer, and Mqor Grabow: Those voting No being None.
Inspection of Old Landfill as Possible Auto Graveyard
The Commission concurred in the City Manager's recommendation and it was moved by Commissioner
Vandeventer, seconded by Commissioner Vollmer, that the meeting be adjourned so that the Commis-
sion m~ proceed to the former City Landfill to inspect it in view of the request from the Gallatin
County Commission to use the 4-5 acre site as the motor vehicle graveyard as required under Chapter
410 of the Montana Law of 1973. The motion was carried by the following Aye and No vote: Those
voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Lehrkind, Commissioner
Sed.! vy, and M8\V'or Grabow: Those voting No being None.

There being no further business to come before the Commission at this time, it was moved
