The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building. 25 July 1973, at 1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Comm-
issioner Lehrkind, Commissioner Vandeventer. Commissioner Vollmer, City Manager Frys1ie, Ass't. City
Manager Keyes, City Attorney O'Connell and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held 18 July 1973 were approved as read.
Acceptance and Final Payment. SID No. 523, Water Main - North 19th Avenue: I
The Certificate of the engineer of Thomas, Dean and Hoskins, Inc., on Special Improvement District
No. 523 stating the construction has been completed in accordance with the plans and specifications
was presented. The City Manager concurred in the recommendation of the engineers and recommended that
the project be accepted and approved by the City Commission and final payment made. This final accept-
ance and payment does not relieve the contractor of responsibility for negligence or faulty materials
or workmanship to the extent and period provided by law. The contractor has furnished a performance
bond equal to the total contract bid to guarantee materials and workmanship for a one year period com-
mencing upon final acceptance. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind,
that as recommended the project be accepted as completed and the motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner
Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none.
Acceptance of Deed for Street Right-of-Way. North Seventh Avenue - Mendenhall Street
A Quit Claim Deed whereby Cam Inc., granted unto the City of Bozeman a portion of Lot Twenty (20)
of Block "E" of Tracy's Second Addition to the City of Bozeman containing within the above described
exterior boundaries 70.66 feet for street purposes was presented.
Following a discussion, it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer
that the Quit Claim Deed be accepted and filed for record with the County Clerk and Recorder and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Comm-
issioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none.
Revised Charges - Residential Water and Sewer Services:
The City Manager reported that it has become necessary to increase the Charges of Residential 1
Water and Sewer Services and presented the following proposed schedule for the consideration of the
Commission.
3/4" Service - Street $110.00 plus pavement cuts
Inside Property $ 2.75 per foot.
4" Connection - Street $105.00 plus pavement cuts
Alley $ 85.00
A general discussion was had and it was moved by Commissioner Vandeventer, seconded by Commiss-
ioner Vollmer, that the above Residential Water and Sewer Services be approved and put into effect
as of 2S July 1973. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor
Grabow; those voting No, none.
Lice"lse Bonds: W. D, Construction - House Mover, $2,000.00 James Caffrey - Plumber, $5.000,00
In accordance with the provisions of Ordinance No.7aS, the certificate for the Building Movers
Bond in the amount of $2,000.00 as surety for moving permit on W. D, Construction, Bozeman, Montana,
and in compliance with Chapter 16 of the Bozeman Municipal Code, the certificate of James Caffrey in
the amount of $5,000.00 was presented. The Building Inspector had recommended the approval of the
bonds and the City Attorney approved the bonds as to form. It was moved by Commissioner Vollmer, se-
conded by Commissioner Sedivy, that the continuation of the bon~ be approved and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy,
Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none.

The City Manager commented on the reports and recommended approval thereof. It was moved by
Commissioner Sedivy, seconded by Commissioner Lehrkind, that the reports be approved and ordered filed
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sed-
ivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those

Consideration of Bids for Gravel:
Having received the approval of the Montana State Highway Department, the City Manager recommended
that Graybill Trucking, Bozeman, be awarded the bid for 2,000 ton 3/4 inch gravel and 4,000 ton 1/2
inch gravel in the amount of $12,700.00. It was moved by Commissioner Lehrkind, seconded by Commiss~
ioner Vandeventer, that the bid for gravel be awarded to Graybill Trucking as recommended by the City
Manager and the Motion was carried by the following Aye and No vote: those voting Aye being Commiss-
ioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow;
those voting No, none.
Authority to Call for bids for Chlorine, Open 15 August 1973:
The water department and waste water treatment plant has need for approximately 90,000 lbs. liquid
chlorine and the City Manager request authorization to purchase the chlorine. It was moved by Comm-
issioner Vandeventer, seconded by Commissioner Vollmer, that the purchase as requested be authorized
and the Clerk of the Commission be directed to issue a "Call for Bids" for the purchase of 90,000 lbs.
liquid chlorine to be opened 15 August 1973 and the motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy.
Commissioner Lehrkind and Mayor Grabow; those voting No, none.
Recess: 1:55 o'clock p.m.:
It was moved by Commissioner Vollmer, seconded by Commissiofier Sedivy, that the Commission
declare a recess for the purpose of a meeting of the Police Reserve Board of Trustees. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commiss-
ioner Vandeventer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none.
Reconvened: 2:20 o'clock p.m.:
A letter dated 10 July 1973 from Captain W. C. Dorman requesting that he be placed on the inactive
Police Reserve starting 1 August 1973 after having completed twenty-one and one-half (21\) years was
presented.
The Board of Trustees of the Police Reserve Fund at their meeting held during the recess recomm-
ended that Captain Dorman request to be place on the inactive Police Reserve starting 1 August 1973
be approved by the City Commission.
Mayor Grabow on behalf of the City Commission paid tribute to Captain Dorman for his outstanding
services and the courteous manner in which he carried out his duties as an officer and his ability to
meet the public. The Mayor on behalf of the Commission stated that it was with reluctance that he
accept Captain Dormans request to be placed on the inactive Police Reserve starting 1 August 1973.
City Manager~yslie also concurred in the Mayors tribute stating that it had been his pleasure
to be a part of the organization fourteen of the twenty one years that Captain Dorman represented
the City in the Police Department and stated he had been impressive in administrative work as well as
in the police work. He commended him on his ability to meet people and to do so courteously. He
advised the Commission that it is with regret that he recommend that Captain Dorman be removed from
active duty.
City Attorney, O'Connell worked with Captain Dorman and stated that he had never met an officer
with more tact or more courtesy and it was with regret that he see him leave the Police Department.
The Commission concurred with the recommendation of the Board of Trustees of the Police Reserve
Fund and the City Manager and it was moved by Commissioner Lehrkind, seconded by Commissioner Van-
deventer, that Captain Dorman be passed from the Active Police Force to the Inactive Police Reserve
and the motion was carried by the following Aye and No vote: Those voting Aye being Commissioner
Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow,
those voting No, none.
Ad jourment:
There being no further business to come before the Commission at this time, it was moved by
Commissioner Vandeventer, seconded by Commissioner Vollmer, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer,
Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No,
