HomeMy WebLinkAbout1973-08-01 466 Bozeman, Montana 1 August 1973 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 1 August 1973, at 1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Com- missioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Frys1ie, Ass't City Manager Keyes, City Attorney O'Connell and the Clerk. Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held 25 July 1973 were approved as read. Completion and Final P~ent - Hyalite Park Sprink1in~ System The certificate of the city engineer on Special Improvement District No. 518 stating that the water improvements by Bob's Landscaping Service, Inc., has been completed in accordance with the terms and stipulations given in the plans and specifications was presented. The City Manager concurred in the recommendation of the engineers and recommended that the project be accepted and approved by the City Commission and final payment made within thirty days. This final acceptance does not relieve the contractor of responsibility for negligence and faulty materials or workmanship to the extent and period provided by law. The contractor has furnished a performance bond equal to the total contract bid to guarantee materials and workmanship for a one year period commencing upon final acceptance. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that as recommended Special Improvement District No. 518, New Hyalite Park Sprinkling installation be accepted as completed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, and Mayor Grabow; those voting No, none. Application for Kennel License - Coral Holland, 414 North 20th Avenue The application from Coral Holland, 414 North Twentieth Avenue, Bozeman, requesting a Kennel license in accordance with Ordinance No. 857, Section 5.16.040 of the Bozeman Municipal Code, together with the required fee was presented. The Chief of Police advised the Commission that they had investigated the application and found that a number of the neighbors objected to the issuance of the license. Following a discussion and in concurrence with the recommendation of the Chief of Police, also concurred in by the City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the application for a kennel license be denied and that a letter be addressed to Mrs. Coral E. Holland calling her attention to Chapter 5.16.040 of the Bozeman Municipal Code which declares the keeping of three or more dogs without first obtaining a license to be a nuisance. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Sedivy, Commissioner Vollmer, and Mayor Grabow; those voting No, none. John Price - Discussion re~arding Traffic on West Main Street John Price appeared before the Commission to discuss the traffic situation on West Main Street. The Commdssion informed Mr. Price that the City does not have any jurisdiction to do anything in regard to the traffic condition without first contacting the Montana State Highway Department which is being accomplished. The Commission thanked Mr. Price for attending the meeting and for his concern in this matter. I I I I I I Commission Resolution No. 1598~ Amendin~ Commission Resolution No. 1579~ SIn 512 Commission Resolution No. 1598 amending Commission Resolution No. 1579~ resolution of intention to create SID No. 512 as prepared by the firm of Dorsey, Marquart ~ Windhorst, West Ire Halladay of Minneapolis~ Minnesota was presented: Commission Resolution No. 1598 set forth in full: BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN~ MONTANA THAT COMMIS- SION RESOLUTION NO. 1579 ~ DATED MAY 23 ~ 1973, ENTITLED RESOLUTION CONFIRMING SALE OF $688,000 SPECIAL IMPROVEMENT DISTRICT NO. 512 BONDS, AND PRESCRIBING THEIR FORMS AND TERMS AND COVENANTS OF THE CITY FOR THE SECURITY OF THE HOLDERS THEREOF ~ IS AMENDED. The City Manager recommended that the Commission adopt Commission Resolution No. 1598 amending Commission Resolution No. 1579. It was moved by Commissioner Vandeventer, seconded by Commissioner VOllmer, that Commission Resolution No. 1598 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Voll- mer~ Commissioner Lehrkind, Commissioner Sedivy, and Mayor Grabow; those voting No, none. Commission Resolution No. 1599, Amendin~ Commission Resolution No. 1580, SID 520 Commission Resolution No. 1599 amending Commission Resolution No. 1580, resolution of intention to create SID No. 520 as prepared by the fim of Dorsey~ Marquart, Windhorst ~ West Ire Halladay of Min- neapolis, Minnesota was presented as set forth in full: COMMISSION RESOLUTION NO. 1599 BE IT RESOLVED BY THE CITY COMMISSIQJ'fOFTHE CITYOl!' The City Manager recommended that the Commission Resolution No. 1599 amending Commission Resolution No. 1580 and it was moved by Commissioner Vollmer~ seconded by Commissioner Sedivy~ that Commission Resolution No. 1599 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, and Mayor Grabow; those voting No, none. Agreement with State Department of Highw~s - TOPIC Funds An Agreement between the Department of Highways of the State of Montana and the City . of Bozeman whereby it is mutually agreed between the respective parties hereto that the City of Bozeman, Montana~ will continue to maintain the City streets indicated on the City Plat attached thereto which are not located on State Highw~ systems and which will be included 1n the Federal Aid Urban System andlor the Federal Aid TOPICS System was presented. It was moved by Commissioner Sedivy~ seconded by Commissioner Lehrkind, that the Agree- ment be entered into and the Mayor and City Engineer be directed to sign the Agreement for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy~ Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, and Mayor Grabow; those voting No~ none. Promotion of Police Officers: Officer Darvin Hanson to Serflieant Sergeant Harold Veltkamp to Captain The City Manager announced his promotion of Officer Darvin Hanson to Sergeant of the Police Department and his promotion of Sergeant Harold Ve1tkamp to Captain of the Police Depart- ment effective 1 August 1973. 467 468 The Commission concurred in the City Managers appointment and it was moved by Commis- sioner Lehrkind, seconded by Commissioner Vandeventer, that the City Managers appointment of Officer Darvin Hanson to Sergeant and Sergeant Harold Veltkamp to Captain of the Police Depart- ment effective 1 August 1973 be concurred in and that Sergeant Hanson and Captain Veltkamp be con- gratulated on their promotion. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Sedivy, Commissioner Vollmer, and Mayor Grabow; those voting No, none. Report of the Building Inspector The City Manager commented on the report of the Building Inspector and recommended approval thereof. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the report of the Building Inspector be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, and Mayor Grabow; those voting No, none. Request Variance to Curb Cut and Driveway Ordinance - Donald Heath A letter received from Donald Heath of 1308 South Black Avenue requesting a Zoning Code Curb Cut and Driveway Variance from ten feet to twelve feet was presented. Following a discussion, it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that they concur with the recommendation of the City ~!a.nager and approve the Curb Cut and Driveway variance at 1308 South Black Avenue and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Com- missioner Vollmer, and Mayor Grabow; those voting No, none. Retirement of Wilma Sandaker - 31 July 1973 The City Manager announced that Wilma Sandaker who had served the City Manager and the City Commission for thirty-three years has retired. Following adjournment of the Commission meeting, arrangements have been made for appropriate recognition on her behalf. Adjournment There being no further business to come before the Commission at this time, it was moved by Com- missioner Lehrkind, seconded by Commissioner Vandeventer, that the meeting be adjourned and the mo- tion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Sedivy, Commissioner Vollmer, Mayor Grabow; those voting No, none.
