HomeMy WebLinkAbout1973-05-23 I Bozeman, Montana 23 May 1973 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, Wednesday, 23 May 1973, at 1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, City Attorney O'Connell and the Clerk. Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held Wednesday, 16 May 1973, were approved as corrected. Consideration of Construction Bids - SIn's 512, 519, 520 & North Wallace Ave. The engineers representing consultants Thomas, Dean & Hoskins, Inc., the City Engineer and the City Attorney having completed their study of the bids submitted for the construction of paving and storm drain, Thompson's No. l~ SID No. 512, for the construction of paving West Mendenhall and West Lamme Street between North Tenth and North Eleventh SID No. 519, for the construction of paving North Twentieth Avenue from Main Street to Beall Street SID No. 520 and the construction of widening curb and gutter and paving North Wallace Avenue between Main Street and Lamme Street and having prepared a final tabulation of the bids recommended that Long Construction Company of Billings, Montana, be awarded the contract for the construction of Special Improvement District No's. 512, 519, and 520 in the total amount of $496,728.20 and the construction of North \~allace Avenue between Main Street and Lamme Street in the amount of$38,131.50 contingent upon the approval of the Montana State Highway Department, and that the bid security of the unsuccessful bidders be returned. The City Manager also concurred in the above recommendation and it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind-, that Long Construction Company be awarded the construction of Special Improvement District No's. 512, 519, 520 and the construction of North Wallace Avenue on the basis of their low bid as stated above and that the bid security of the unsuccessful bidder be returned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, and Mayor Grabow; those voting No, none. Open Bids 1973 Seal Coat Project This was the time and place set for receiving bids for HB-436-254, Seal Coat Project, May 1973 for Bl,B3tr square yards seal coating as approved by the Montana State Highway Department. Affidavit of publication of "Notice to the Bidders" was presented. Three sealed bids were on file and it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the bids filed with the Clerk of the Commission be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, and Mayor Grabow; those voting No, none. The following bids were then opened and read: Bozeman Sand & Gravel $30,000.00 Bozeman Black Top 30,125.00 Long Construction Co., 32,500.00 The Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the bids be referred to the City Engineer for his study and final recommendation on Wednesday, 30 May 1973, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, and Mayor Grabow; those voting No. none. Commercial ,'\rea Kagy Boulevard & Willson Avenue - Protest On-Premise Pool Hall A large group of interested property owners and residents from the Kagy Boulevard-Willson Avenue area appeared before the Commission to protest the construction of a pool hall and to oppose the issuance of an on-premise beer license on a commercial site on the corner of Kagy Boulevard and Wi llson Avenue. The City Manager concurred in the views of those protesting to sell beer for on-premise consumption. Following a thorough discussion, the Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the City file a formal protest with the Montana Liquor Control Office. The Motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner vandeventer, and Mayor Grabow; those voting No, none. Truck Traffic on North 20th Avenue - Petition signed by 36 Protestors A petition signed by 36 property owners and residents of North Twentieth Avenue protesting the 1 I 425 4:26 use of heavy equipment and trucks on North Twentieth and West Beall Street was presented. A number on interested persons were also present to discuss the dangers of trucks and heavy equipment and the noise created thereby and ask that they use the business route rather than the residential street. Following a thorough discussion, it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the City Manager be instructed to address a letter to the various firms requesting that they des tribute traffic routes when possible so as to minimize the burden upon North 20th Avenue. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, and Mayor Grabow; those voting No, none. Commission Resolution No. 1577, Intent to Vacate Streets & Alleys Rouses 2nd Hear~20 June 1973 A letter received from Robert Heath in behalf of Harrington's, Inc., requesting the vacation of a small portion of a street adjacent to Block B of Rouse's Second Addition was presented. Following a discussion, the Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that Commission Resolution No. 1577 as prepared by the City Attorney be passed and adopted and 20 June 1973 be set as the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, and Mayor Grabow; those voting No, none. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the Commission Resolution No. 1578 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, and Mayor Grabow; those voting No, none. Commission Resolution No. 1579, Confirmi:.E.8_ the sale of $688,000 Bonds - SID sl2 The City Manager presented Commission Resolution No. 1579 confirming the sale of $688,000 Special Improvement District No. 512 Bonds, and prescribing the maturity date, terms and covenants of the City and recommended approval thereof. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the Commission Reso1tuion No. 1579 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, and Mayor Grabow,; those voting No, none. I 1 I I 1 I 427 Commission Resolution No. 1580, Confirming Sale of $67,000 Bonds, SID 520 The City Manager presented Commission Resolution No. 1580 confirming the sale of $67,000 Special Improvement District No. 520 bonds and prescribing the maturity date, terms and covenants of the City and recommended approval thereof. Commission Resolution No. 1580 set forth in full: RESOLUTION CONFIRMING SALE OF $67,000.00 SPECIAL IMPROVEMENT DISTRICT NO. 520 BONDS, AND PRESCRIBING THEIR FORMS AND TERMS AND COVENANTS OF THE CITY FOR THE SECURITY OF THE HOLDERS THEREOF It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that Commission Resolution No. 1580 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, and Mayor Grabow; those voting No, none. Ordinance No. 926, Vacate portion of Birch Street Ordinance No. 926 set forth in full: AN ORDINANCE OF THE CITY OF BOZEMAN VACATING THAT PORTION OF WEST BIRCH STREET LYING BETWEEN BLOCKS ONE AND TWO OF WESTLAKE'S SECOND SUBDIVISION OF THE CITY OF BOZEMAN, MONTANA. as prepared by the City Attorney as directed by the City Commission was presented. The Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that Ordinance No. 926 vacating Birch Street be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, and Mayor Grabow; those voting No, none. License Bonds, Midland Electric - $5,000.00 In compliance with Chapter 15 of the Bozeman Municipal Code, the Electrical Bond of Midland Electric in the amount of $5,000 was presented. The Building Inspector had recommended approval of the Bond and the City Attorney approved the bond as to form. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the Electrical License Bond of Mi.dland Electric be approved and the motion was carried by the followi.ng Aye and No vote: those voting Aye being Commissioner Vandeventer, Commi.ssioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Area Wide Water Plan: Thomas, Dean & Hoskins The Area Wide Water Plan having been completed by Thomas, Dean & Hoskins was presented. The City Manager suggested that the Commission go over the proposed Wide Water plan and be prepared to ask any question that they might have generated. Reports The following reports were presented. Director of Public Service Water Collector Cemetery The City Manager commented on the above reports and recommended approval thereof. It was moved by Commissi.oner Vollmer, seconded by Commissioner Sedivy, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, and Mayor Grabow; those voting No, none. !i73_Si~ewal~ Program - Open Bids 20 June 1973 The City Engineer completed his survey of Walks and Curbs within the City of Bozeman and recommendation for repair and/or installation for the year 1973. Following a thorough discussion, the Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the City Engineers recommendation for repair and/or installation of "Walks and Curbs" within the City for the year 1973 be taken under advisement but that the Clerk of the Commission be authorized to "Call for Bids" for repair and/or installation of "Walks and Curbs" to be opened on 20 June 1973. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner, Vandeventer, Commissioner Vollmer, and Mayor Grabow; those voting No, none. ~djournment:.
