HomeMy WebLinkAbout1973-05-09 I 1 I Bozeman, Montana 9 May 1973 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 9 May 1973, at 1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Commiss- ioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't. City Manager Keyes, Acting City Attorney O'Connell and the Clerk. Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had. Minutes of the meeting held Wednesday, 2 May 1973 were approved as read. Open Bids Annual Fuel Supply - Gasoline, No.2 Diesel & No. I Diesel to 6-30-7!1 This was the time and place set for opening bids from Gasoline, No.2 Diesel and No.1 Diesel suppliers to furnish the City of Bozeman approximately 70,000 gallons regular gasoline, 15,OOO gal- lons No.2 diesel and 1,500 gallons No.1 diesel fuel to 30 June 1974. The affidavit of publica- tion of the "Call for Bids" was presented. It was moved by Commissioner Sedivy, seconded by Comm- issioner Lehrkind, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Vollmer and Mayor Grabow; those voting No, none. The following bids were then opened and read: Chevron Oil Company Regular Gas 4t2 Diesel Fuel 4ft Diesel Fuel Regular Gas #2 Diesel Fuel 4tl Diesel Fuel No Bid .169 .175 .28t No Bid No Bid Continental Oil Company Upon recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the bids be referred to the Ass't. City Manager and the City Engineer for checking and recommendation to be made to the Commission on Wednesday, 16 May 1973 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Comm- issioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Consideration of SILD No. 508 - Street Lighting, Resolution No. 1573 Creating Action on Commission Resolution No. 1570, Special Improvement Lighting District No. 508 for the purpose of construction of lights on North 15th Avenue from Main Street to Durston Road, North 16th and North 17th Avenue from Beall Street to Durston Road, a portion of Beall Street and a portion of Durston Road having been delayed for a week for further study and consideration was again presented. The City Manager reported that further investigation revealed that the lighting in Buttrey's parking lot was so located so as not to conform to minimum street lighting standards and that they are not lit all night as they are on a time clock. In view of these findings the City Manager recommended that the Commission concur in his re- commendation and create Special Improvement Lighting District No. 508. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the protests be considered insufficient and that Commission Resolution No. 1573 creating Special Improvement District No. 508 as prepared by the Acting City Attorney be passed and adopted. COMMISSION RESOLUTION NO. 1573 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 508 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF OPERATING AND MAINTAINING A STREET LIGHTING SYSTEM TO LIGHT NORm 15TH AVENUE FROM MAIN STREET TO DURSTON ROAD, 16TH AVENUE FROM BEALL STREET TO DURSTON ROAD, 17TH AVENUE FROM BEALL STREET TO DURSTON ROAD, DURSTON ROAD FROM 15TH AVENUE TO 17TH AVENUE AND BEALL STREET FROM 15TH AVENUE TO ALLEY BEn-mEN 17TH AND 18TH AVENUES, SAID STREET LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE MONTANA POWER COMPANY ALL UNDER AUTHORITY OF AND IN CONFORMITY WITH SECTIONS 11-2245 to 11-2257 INCLUSIVE, OF THE REVISED CODES OF MONTANA, 1947. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, and Hayor Grabow; those voting No, none. Proclam~io~~ Safe~y Awareness Days 11-19 May, 1973 Vehicle Safety Check 11-12 May 1973 International Shrine Hospital Days 20 May 1973 Mayor Grabow proclaimed 11-19 May 1973 as "Safety Awareness Days" and urged the citizens of Bozeman, young and old, to get involved, participate and support all activities during Safety Aware- ness Days and all year long. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that they concur in the Mayors proclamation as requested and the motion was carried by the Following 4:15 416 Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. In accordance with the Jaycees, Mayor Grabow proclaimed ll-12 May 1973 as "Vehicle Safety Check Days" and urged all traffic organization, public officials, schools and churches and all cit- izens to take an active part in this traffic safety program and help everybody to "get the Safety habit~" It was moved by Commissioner Sedivy, secondedby Commissioner Lehrkind, that the Mayor's proclamation be endorsed as requested by the Jaycees and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Mayor Grabow proclaimed Sunday, 20 May 1973 as International Shrine Hospital Day in Bozeman and asked that all citizens join in paying tribute to the Shrine of North America. It was moved by Commissioner Lehrkind. seconded by Commissioner Vandeventer, that the Mayor's proclamation be en- .dorsed as requested by the Algeria Temple on the 51st anniversary of the opening of the Shriners Hospital. The motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Lehrkind, Commissioner Vandeventer. Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. petition for SID - Paving Circle Drive A petition signed by several property owners requesting the creation of a special improvement district for the paving of Circle Drive was presented. Following a discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that they concur in the recommendation of the City Manager and instruct the Acting City Attorney to prepare the resolution of intention to create this Special Improvement District and also to prepare a resolution creating the district. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Authority to Attend A.W.W.A. Conention in Las Vegas 13-18 May 1973 - R. Dunahoo, Water Supt. The American Water Works National convention is scheduled to be held in Las Vegas, Nevada, 13-l8 May 1973 and in concurrence with the recommendation of the City Manager, it was moved by Commissioner Vollmer. seconded by Commissioner Sedivy, that Ralph Dunahoo be authorized to attend the convention and, it being in the public interest his expenses be paid from the water fund and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Resolution No. 1572 - Establish Date & Maturity Date of Bonds, SID No. 523 COMMISSION RESOLUTION NO. 1572 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN FIXING TIlE DATE, MATURITY DATE AND THE PRINCIPAL AMOUNT OF BONDS TO BE ISSUED IN SPECIAL IMPROVEMENT DISTRICT NO. 523. I 1 It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that Commission Re- solution No. 1572 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Comm- issioner Vollmer and Mayor Grabow; those voting No, none. Reports The following reports were presented. Cashier Fluoridation Chief of Police Police Judge The City Manager commented on the reports and recommended approval thereof. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Lehrkind, Commissioner Vandeventer. Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. I Request to Vacate Alley - Westlakes First Addition A letter received from Collins Construction Company requesting that the alley north and border- ing Block No.2 of Westlake's First Addition between Fourth and Fifth Avenue be vacated to enable them to build a 99 unit senior citizens apartment house was presented. The Board of Adjustment granted all the variances necessary to permit the construction of this building, which is contingent on the City vacating this alley. Following a discussion, it was moved by Commissioner Lehrkind, seconded by Commissioner Vande- venter. that they concur in the City Managers recommendation and instruct the Acting City Attorney to draw up a resolution of intention to vacate the alley north and bordering Block 2 of Westlake's I 1 I First addition between North Fourth and North Fifth Avenue. The motion was carried by the follow- ing Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Comm- issioner Vollmer, Commissioner Sedivy and Mayor Grabow: those voting No, none. Request to Variance to Sign Code - Rainbow Signs: A letter received from the Rainbow Sign, Inc., requesting a variance to erect a sign for and on the Security Bank & Trust Company lot was presented. Following a discussion, the City Manager recommended that the variance to the sign code be approved. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that Rain- bow Sign, Inc., be granted a variance of the Sign Code 14.16.420 of the Bozeman Municipal Code so that they may proceed with this project and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Comm- issioner Lehrkind and Mayor Grabow; those voting No, none. Utility Easement - Graf's 3rd & Figgins Addition Easements and Right of Way Agreements for the purpose of constructing and installing water and sewer lines and necessary appurtenances to serve various properties located within southwest and southerly portions of the City of Bozeman County of Gallatin, was presented. The City Manager re- commended that the City enter into the Easement Agreements approved as to form by the Acting City Attorney and it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the Ease- ment Agreements be entered into by the City of BozeMan and the Mayor and Clerk of the Commission by authorized and directed to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Vandeventer, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Contract Documents for Execution - SID No. 523 Water Ma ns The contract documents for the construction of Water Mains on North 19th Avenue between Beall and Durston Road on the basis of their low bid in the amount of $11,054.00 was presented. The City manager recommended that the Contract Documents approved as to form by the Acting City Attorney be approved. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the contract documents be approved and that the Mayor and Clerk of the Commission be authorized and directed to sign the contract for the City of Bozeman and that Johnston Excavating, Inc., of Bozeman be auth- orized to proceed with the construction and the pledge for bid security be returned to Johnston Excavating, Inc., and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Addendum to Inter-Local Agreement to Provide for Joint Community Recreation Department An Addendum to the Inter-local Agreement for a Joint Community Recreation Department entered into on 21 March 1973 by School District No.7, Gallatin County and the City of Bozeman was presented. Following a discussion, the Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the City enter into the Addendum to the Inter-Local Agreement with School District No. 7 and the Board of County Commissioners of Gallatin County and that the Mayor and Clerk of the Commission be authorized and directed to execute the Agreement on behalf of the City and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Comm- issioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Fund Drive - MSU Music Students A request from the Music Department of the Montana State University, Bozeman requesting per- mission to conduct a fund drive for the purpose of purchasing a new concert grand piano was presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that they approve the fund drive and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow: those voting No, none. Claims Claim No's 15327 through 15545 and 3984 thru 4121 inclusive were presented. The City Manager checked the claims and found them to be true and lawful claims against the City and recommended they be approve and the director of finance be directed to issue warrants in payment. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, 417 418 No, none.
