The Commission of the City of Bozeman met in regular session Hednesday, 7 March 1973, at 1:15
o'clock p.m. Present Here Hayor Grabow, Commissioner Sedivy, Commissioner Lehrkind, Commissioner
Vandeventer, Commissioner Vollmer. City Manager Fryslie. Ass't. City Hanager Keyes. Deputy City
Attorney Berg and the Clerk.
Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had:

An Easement and Right of Way Agreement for utility lines and construction purposes between the
Roman Catholic Bishop of Helena. Montana. and the City of Bozeman for the purpose of installing.
operating. using. repairing, maintaining and removing utilities thereto upon and across the property
situated in the S~. swt of Section l~. Township 2 South. Range 5 East to the City of Bozeman was
presentf'd.
The City Manager recommended that the City enter into the Easement and Right of Way Agreement
approved as to form by the Acting City Attorney and it was moved by Commissioner Sedivy. seconded
by Commissioner Lehrkind. that the Easement and Right of 1.\fay Agreement for utility lines and con-
struction purposes be entered into by the CHy and the 11ayor and Clerk of the Commission be authori-
zed and directed to sign for the City and the Motion was carried by the following Aye and No vote:

The City has need for 250 lengths of sewer rod in the approximate amount of $1,000.00 and the
City Manager requested authority to purchase the sewer rods. It hlas moved by Commissioner Lehrkind.
seconded by Commissioner Vandeventer, that the City Manager be given authority to purchase the sewer
rods at an approximate cost of $1,000.00 and the motion \~as carried by the following Aye and No vote:

A letter received from Hr. Allan W. Green of 122 South Willson Avenue requesting a variance to
the Sign Code Ilf.16.380 of the Bozeman Municipal Code for the erection of a timber sign to be located
at 122 South Hillson Avenue wa.s presented. The sign would be of bridge timbers or rough sawn timbers.
(probably 6' X 6') and located approximately eight to ten feet from the main structure. A bench where
people could sit and relax and enjoy the landscape would be part of the sign.
Donald Marks Has present and protested the variance to the Sign Code which the Mayor took under
admisemen t.
The Commission concurred with the recommendation of the City Manager and it was moved by Comm-
issioner Vandeventer. seconded by Commissioner Vollmer. that Allan Green be granted a variance of the
Sign Code 14.16.380 of the Bozeman Municipal Code for the installation of the free standing sign and
the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vande-
venter, Commissioner Vollmer, Commissioner Sedivy. Commissioner Lehrkind and Mayor Grabow; those
voting No, none.
A letter received from Thomas A. Olson requesting a variance of the Sign Code 1~.16 of the
Bozeman Municipal Code to retain a sign erected in front of their building located at 309 West Men-
denhall Street was presented.
Donald Marks was present and verbally protested the variance to the Sign Code which the Mayor
took under advisement.
Following a thorough discussion, it was moved by Commissioner Vollmer, seconded by Commissioner
Sedivy, that the request for the sign code variance be approved and the motion was carried by the I
following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Scd ivy. Comm-
issioner Lehrkind, Commissioner Vandeventer and Mayor Grabo\.J; those voting No, none.

In compliance with Chapter 16 of the Bozeman Hunicipal Code, the plumbing and heating bonds of
New Budd Plumbing and Heating and the Bolin Plumbing and Heating in the amount of $5,000.00 was
presented. The Building Inspector had recommended approval of the above mentioned bonds and the
City Attorney had approved the bonds as to form. It was moved by Commissioner Sedivy, seconded by

Commiss ioner Lehrkind, that the bonds be approved and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Van-
deventer, Commissioner Vollmer, and Mayor Grabow; those voting No, none.
Pr~g.E.ess Report - "Ha terS tudy" - T. H. Thomas
Mr. T. H. Thomas of Thomas, Dean & Hoskins appeared before the Commission to bring an up to
date report on the progress of the Water System Study. The Commission thanked Mr. Thomas for his
very informative report.

The City Manager commented on the reports and recommended approval thereof. It was moved by
Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the reports be approved and or-
dered filed and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and
Mayor Grabow; those voting No, none.
Claims
Claim No's. 14956 through 15126 and 3690 through 3820 inclusive were presented. The City
Manager checked the claims and found them to be true and lawful claims against the City and re-
commended they be approved and the Director of Finance be directed to issue warrants in payment.

be approved and ordered filed and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner
Lehrkind and Mayor Grabow; those voting No, none.
