HomeMy WebLinkAbout1973-03-28 396 Bozeman, Montana 28 March 1973 The Commission of the City of Bozeman met in regular session Wednesday, 28 March 1973, at 1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't. City Manager Keyes, Acting City Att- orney O'Connell and the Clerk. Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting of 2l March 1973 were approved as read. I Open Bids, Water System Hyalite Park - SID 518 This was the time and place set for opening bids for the construction of Hyalite Park Water System, SID No. 518. Affidavit of publication of "Notice to Bidders" was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Bob's Landscaping, Bozeman Total Base Price $9,834.00 Automatic Drains 259.00 Alternate $9,575.00 Joe Yurek, Bozeman Total Base Price $11,303.34 Alternate 110.53 $11,192.81 The Commission concurred with the recommendation of the City Manager, and it was moved by Comm- issioner Lehrkind, seconded by Commissioner Vandeventer, that the bids be referred to the Recreation Director and the City Engineer for final tabulation and recommendation and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vande- venter, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Open Bids, Playground Equipment, HyaUte Park - SID No. 518 This was the time and place set for openeing bids for the playground equipment for the Hyalite Park. Affidavit of publication of "Notice to Bidders" was presented. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the bid of Niedermeyer-Martin, Portland, Oregon, 1 being the only bid submitted be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Timberform division (Niedermeyer-Martin) $8,820.00 Portland, Oregon The Commission concurred with the recommendation of the City Manager and it was moved by Comm- issioner Vollmer, seconded by Commissioner Lehrkind, that the bid of Niedermeyer-Martin be referred to the Recreation Director and the City Engineer for study and final recommendation. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Grabow; those voting No, none. Authority to Attend Arson School - 21-25 May 1973, Helena, Patrolman Darvin Hanson The Fourth Annual Arson School conducted by the State Department of Public Instruction and the State Fire Marshall's Office is scheduled to be held in Helena, 21-25 May 1973 and the Chief of Police requested authorization to send First Class Patrolman Darvin Hanson to this school. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that First Class Patrolman Darvin Hanson be authorized to attend this school and, it being in the public interes his expenses be paid from the General fund and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Chamber of Commerce - Erect Signs, College National Finals Rodeo, 15-16 June 1973 Wally Byam Caravan Club 28 June - 6 July 1973 A letter received from the Bozeman Chamber of Commerce requesting permission toerect signs ac- I ross Main Street on East Main and West Main and on North Seventh Avenue on the Chamber of Commerce poles to welcome the College National Finals Rodeo during l5-l6 June and the Wally Byam Caravaners also during June and through 6 July 1973 was presented. Following a discussion, the Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the request to erect the welcoming signs be approved and that they be given permission to erect these signs at an earlier date if they so wish. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. I I I 397 Ordinance No. 927 - Automobile Repair Reporting ORDINANCE NO. 927 AN ORDINANCE AMENDING TITLE 11, CHAPTER 11.04 OF 'lllE BOZEMAN MUNICIPAL CODE TO REQUIRE GARAGE OWNERS AND REPAIR SHOPS TO REPORT AUTOMOBILE ACCIDENTS AND DAMAGE TO AUTOMOBILES CAUSED BY BULLET HOLES..:.:. PENALTY as prepared by the Acting City Attorney was presented. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Vande- venter, seconded by Commissioner Vollmer, that Ordinance No. 927 to require garage owners and repair shops to report automobile accidents and damage to automobiles caused by bullet holes and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. License Bonds - Epcon Co., $2,000.00 In compliance with Chapter 14 of the Bozeman Municipal Code, the sign bond of Epcon Company in the amount of $2,000.00 was presented. The City Manager stated the Building Inspector had recommended approval thereof, and the Acting City Attorney had approved the bond as to form. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the bond of the Epcon Company be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. HB-254 Agreement: Engineering for Montana Highway Project 212(22) Construction of Streets Project Agreement HB254 for the Montana Highway Project No. 212(22) for the construction over and upon streets of Bozeman and including engineering costs for widening of 20th Avenue, widening of Wallace, from Main to Lamme Street and seal coat work by Thomas, Dean & Hoskins, Inc., in the amount of $19,366.00 was presented. The Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the Project Agreement HB254 be approved as presented and that the Mayor and Clerk of the City Commission be auth- orized and directed to sign the Agreement for the City and the motion was carried by the following Aye and No Vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Approval of March of Dimes Fund Drive - 19 May 1973 A letter received from Mr. & Mrs. Douglas Ferkin, requesting permission to conduct a March of Dimes Walkathon in Bozeman 19 May 1973 for the purpose of raising funds for the March of Dimes was presen ted . It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the request to hold the fund drive be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Request for Water & Sewer SID - Graf's Third & Figgins Addition A letter received from Eugene Graf, Jr., requesting a Special Improvement District for constr- uction of water and sewer on Graf's Third and Figgins Addition was presented. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the City Manager acknowledge receipt of the request and instruct theCity Attorney to prepare a resolution of intention when the City Engi- neer has provided him with the necessary information. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, COlnmissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Sour Dough Creek Properties Subdivision No. 10 - Final Plat The final plat of the Sour Dough Creek properties subdivision No. 10 was presented along with the favorable recOmmendation of the City County Planning Board. Noting that the plat conformed generally with the master plat, the City Manager recommended that the plat be approved as presented. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the plat be approved as recommended and that the City Manager be authorized and directed to sign the plat as the Director of Public Service and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehr- kind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Award Contracts - Water System Hyalite Park, SID No. 518 and Playground Equipment The Recreation Director and the Acting City Engineer having completed their study of the bids 398 for the construction of Hyalite Park Water System, SID No. 518 and the playground equipment for the park and having prepared a final tabulation of the bids recommended that Bob's Landscaping, Bozeman, be awarded the contract on the basis of their low bid in the amount of $9,575.00 and that Timberform Division (Niedermeyer-Martin) be awarded the contract for the playground equipment on the basis of their bid in the amount of $8,820.00, it being the only bid submitted. In concurrence with the recommendation of the Assistant City Engineer, the Recreation Director also concurred in by the City Manager, it was moved by Commissioner Vandeventer, seconded by Comm- issioner Vollmer, that the contracts be awarded as recommended and that the bid security of the un- successful bidder be returned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Request for B.O.R. Payment #3 - Recreation Complex, $6,178.15 The applicants Billing No. 3 and payment request in accordance with the Land and Water Conser- vation Fund Project No. 30-00171, Bozeman Recreation Complex in the amount of $6,178.15 was presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the application for Billing No. 2 for Project No. 30-00171, Bozeman Recreation Complex in the amount of $6,178.15 be approved and forwarded to the State of Montana Department of Fish & Game, Helena, for consideration and payment. The motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Commissioner Sedivy and Mayor Grabow, those voting No, none. Re-Appointment to Cemetery Board: Mrs. F. I. Sabo, Mrs. Earl Bradford & Rev. Lyle Onstad Mayor Grabow announced his reappointment to the Cemetery Board as follows: Cemetery Board - Mrs. F. I. Sabo to 31 December 1975 Mrs. Earl G. Bradford 31 December 1975 Rev. Lyle J. Onstad 31 December 1975 It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that they concur in Mayor Grabow's re-appointment to the Cemetery Board and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Report - Librarian The City Manager commented on the report of the Librarian and recommended approval thereof. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the report be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Vandeventer, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Authority to Attend AWWA & WPCA Meetings - Fargo & Dunahoo, Missoula, 28-30 March 1973 The American Water Works Association and MOntana Water Pullution Control Association Convention is scheduled to be held in Missoula, 28-30 March 1973 and in concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the City Engineer and the Water Superintendent be authorized to attend the convention and, it being in the public interest their expenses be charged to the appropriate fund and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. .
