HomeMy WebLinkAbout1973-04-04 I 1 I 399 Bozeman, Montana 4 April 1973 The Commission of the City of Bozeman met in regular session Wednesday, 4 April 1973, at 1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't City Manager Keyes, Acting City Attorney O'Connell and the Clerk. Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting of 28 March 1973 were approved as corrected. Authorize Absence of Commissioner Lehrkind Upon recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Corom - issioner Vandeventer, that the absence of Commissioner Lehrkind be authorized in compliance with Section 11-3245, R.C.H., 1947 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Petition Opposing Existing Zoning - Kagy Blvd & Willson Avenue A petition signed by property owners and residents living near Kagy Blvd. between South Tracy Avenue and South Willson Avenue opposing the impending development as a shopping center and the exist- ing zoning was presented. A petition signed by property owners living in a different area but opposing the existing zoning on Kagy Blvd. between South Tracy and South Willson Avenue was also presented. Several of the property owners from the above area were present to express their interest and concern in regard to the impending development of this area. Mayor Grabow pointed out that if someone wanted to build a shopping center or similar type of establishment the City would have no recourse but to issue a permit assuming all aspects of the current zoning code are met. The existing code is under revision and the proposed new zoning code will come up for public hearing in the near future and this group should attend these hearings and make their views known at that time. Following an extensive discussion, it was moved by Commissioner Vandeventer, seconded by Comm- issioner Vollmer, that they acknowledge receipt of the petition and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, and Mayor Grabow; those voting No, none. Bicycle Path plan A plan for a Bozeman Bikeway Path along with maps, recommendations and priorities was presented. An extensive discussion followed and it was moved by Commissioner Vollmer, seconded by Commiss- ioner Sedivy, that the City accept with gratitude the study presented by Pat Carroll, Doug Toland, Harvey Moen and Rich Itoh and that they be commended on their work and efforts in assembling the plan The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Peter B. Doty, Stop Signs - Corner of 6th Avenue & Koch Street A letter received from Peter B. Doty requesting that a stop sign be installed at the corner of South Sixth Avenue and Koch Street and that the City speed limit be lowered to 20 miles per hour on all but major thoroughfares was presented. Mr. Doty was also present in regard to the request. The Commission advised Mr. Doty that they would take his request under advisement. Authority to Attend Training Sessions - Sgt. Green, Dangerous Drugs, Boise, 20 May 1973 Police Dispatchers - Helena, 12 April 1973, Stebbins & Bender A letter received from the Chief of Police requesting permission to send Sergeant Ronald Green to Boise, Idaho, 20 May - 2 June and authority to send Eva Stebbins and Helen Bender to the Law En- forcement Training School and the National Crime Index Center, Helena, Montana, 12-13 April was pre- sented. It was moved by Commissioner Sedivy, seconded by Commissioner Vandeventer, that permission to send Sergeant Green to Boise and Eve Stebbins and Helen Bender to Helena be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Request to Vacate Portion of Cottonwood Street A letter received from Robert E. Heath on behalf of Hager's Body Shop, Inc., Bozeman requesting that a piece approximately 25' X 30' of Cottonwood Street near the present intersection of Cottonwood and Plum Street within the City of Bozeman be vacated was presented. The Commission concurred with the recommendation of the City Manager and it was moved by Commiss- ioner Vandevente~ seconded by Commissioner Vollmer, that the City Manager acknowledge receipt of the request and that it be tabled for a week for investigation and staff recommendation and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Comm- issioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. 400 Transfer of Beer License - From Vergil Hough to Patricia Joy Thompson "Knotty Keg" It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the Application for transfer of the Beer License from Vergil Hough to Patricia Joy Thompson new owner of the Knotty Keg as per their request in accordance with Chapter 4.04.060 of the Bozeman Municipal Code be approved and the Director of Finance be directed to issue a license in accordance therewith. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Authority to Purchase Lawn Mower - $3,495.00 The Park department has need for a lawnmower and requested authority to purchase an XL272 Hustler Hydrostatic Rotary Mower at an approximate cost of $3,495.00. It was moved by Commissioner Sedivy, seconded by Commissioner Vandeventer, that the purchase of the Hustler Hydrostatic Rotary Mower be authorized as an item of the 1972-l973 budget and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Proclamation - Plumbing Industry Week. 15-22 April 1973 In accordance with the National Association of Plumbing ~ Heating - Cooling Contractors. Mayor Grabow proclaimed the week of 15-22 April 1973 as "National Plumbing Industry Week" in Bozeman and urged all citizens to join in giving recognition to this vital profession and to the special events arranged for this period. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that they concur in the proclamation as requested and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. petUion for Stree t Lighting SILD - No. 15th. 16th & 17th A petition signed by 19 property owners requesting the creation of a Special Improvement Lighting District on North 15th Avenue from 175' north of West Main Street to Durston Road, North 16th and North 17th Avenue from West Beall Street to Durston Road, West Beall Street from North 15th to North 17th Avenue and Durston Road from North 15th to North 17th Avenue was presented. Following a discussion. the Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the Commission instruct the City Attorney to prepare the resolution of intention to create this Special Improvement Lighting Dis- trict and the motion was car~ied by. the. following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Request for Variance to Sign Code - Installation at Don Norem Chevrolet A letter received from Don Norem Chevrolet and Buick, requesting a variance from the Bozeman City Code to allow them to install a six foot in height lighted sign instead of the required ten foot in height sign was presented. Following a discussion, the City Manager recommended that the variance to the Sign Code from Don Norem Chevrolet & Buick, 1735 West Main Street, be granted and it was moved by Commissioner Sedivy, seconded by Commissioner Vandeventer, that Don Norem Chevrolet & Buick be granted a variance of the Sign Code l4-l6.475(b) of the Bozeman Municipal Code for the installation of a six foot in height lighted sign in place of the required ten foot sign and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Appointment: Kenneth Simpson. Ass't. Fire Chief Dewey Johnson, Fire Captain The City Manager announced his promotion of Captain Kenneth Simpson to Assistant Fire Chief and his promotion of First Class Fire Fighter Dewey Johnson to Captain of the Bozeman Fire Department effective 1 April 1973. The Commission concurred in the City Magagers appointment and it was moved by Commissioner Van- deventer, seconded by Commissioner Vollmer, that the City Managers appointment of Kenneth Simpson to Assistant Fire Chief and Dewey Johnson to Fire Captain effective 1 April 1973 be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Mayor Grabow on behalf of the City Commission congratulated Assistant Fire Chief Simpson and Captain Johnson on their promotion. Re po r t The following reports were presented. Building Inspector Fluoridation Fire Chief The City Manager commented on the reports and recommended approval thereof. It was moved by I I I I I I Commissioner Vollmer, seconded by Commissioner Sedivy, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Claims for March Claim No's l5l27 through 15324 and 3841 thru 3972 inclusive were presented. Care 45,000.00 Parking Meter 398.51 PERS 2,148.11 Total $148,290.02 The City Manager checked the claims and found them to be true and lawful claims against the City of Bozeman and recommended they be approved and the Director of Finance be directed to issue warrants in payment. It was moved by COmmissioner Sedivy, seconded by Commissioner Vandeventer, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Contract Documents for Execution - Hyalite Park The Contract documents for the construction of Hyalite Park Water System, SID No. 518 as awarded to Bob's Landscaping, Bozeman, on the basis of their low bid in the amount of $9,575.00 was presented. The City Manager recommended that the contract documents approved as to form by theActing City Attorney be approved. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the contract documents be approved and that the Mayor and Clerk of the Commission be authorized and directed to sign the contract for the City of Bozeman and that Bob's Landscaping, Bozeman be authorized to proceed with the construction and that the pledge for bid security be returned to Bob's landscaping. The motion was carried by the following Aye and No vote: those voting Aye being Comrn- issoner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commiss- ioner Sedivy, Commissioner Vandeventer and Mayor Grabow; those voting No, none.
