HomeMy WebLinkAbout1973-04-11 402 Bozeman, Montana 11 April 1973 The Commission of the City of Bozeman met in regular session, Wednesday, 11 April 1973, at 1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't. City Manager Keyes, Acting City Attorney O'Connell and the Clerk. Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting of 4 April 1973 were approved as read. Open Bids - Water Main Construction North 19th Ave., SID 523 This was the time and place set for opening bids for the construction of watermains on North 19b Avenue lying between Beall Street and Durston Road, SID No. 523. Affidavi t of publication of "Notice to Bidders" was presented. Schmid, Inc Missoula, Montana 11,267.00 Utility Builders Great Falls, Montana l7,79l.00 The Commission concurred with the recommendation of the City Manager and it was moved by Commiss- ioner Sedivy, seconded by Commissioner Lehrkind, that the bids be referred to the consulting engineers for Thomas, Dean & Hoskins and the City Engineer for final tabulation and recommendation and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Gallatin Humane Society - Parade 5 May 1973 - Proclamation "Be Kind to Animals Week." A letter received from Mrs. Robert E. Lord, Secretary of the Humane Society of Gallatin Valley requesting permission to hold a pet parade on Saturday, 5 May 1973 at 10:00 o'clock a.m. was presented. The parade is to begin at the parking lot of the Montana Bank on Third Avenue and Main Street and proceed down Main Street to Black Avenue and turn south to the First National Bank parking lot. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that permission to hold the pet parade on Saturday, 5 May be granted. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. In accordance with the request of the Humane Society of Gallatin Valley, Mayor Grabow proclaimed the week of 5-12 May 1973 as "Be Kind to Animal Week", in Bozeman and urged all citizens of this community to participate in all events related thereto. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that they concur in the proclamation as requested and the motion was carried by the following Aye and No vote: those voting Aye were Commissioner Vandeventer, Comm- issioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Bo%eman Softball Association - Activities for Approval A letter received from Gary C. Richards, President of the Bozeman Softball Association, re- questing the following was presented. l. Permission to hold a Marathon Softball game at the North Grand field beginning 4 May 1973 at 6:00 o'clock p.m. 2. Permission to sponsor a donkey softball game at the North Grand field on 20 June 1973. Permission to channel the flow of traffic in a manner best suited to the needs of the Softball Association. 3 Permission to sponsor a carnival at the Gallatin County Fair Grounds from 17 to 22 July, and that the City Commission waive the license fee for this event. Following a discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that they concur in the recommendation of the City Manager and approve items No. 1 and 2 and table item No.3. The motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Certificate of Completion & Final Acceptance, SID No. 502 The certificate of the engineer of Thomas, Dean & Hoskins, Inc. on Special Improvement District No. 502 stating the construction of the watermainimprovements by C. W. Schmid, Inc. had been completed in accordance with the terms and stipulations given in the plans and specifications was presented. I 1 I I 1 I 403 The City Manager concurred in the recommendation of the engineers and recommended that the project be accepted and approved by the City Commission and final payment made. This final acceptance and payment does not relieve the Contractor of the responsibility for negligence or faulty material or workmanship for a one year period comencing upon final acceptance. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that as recommended the project be accepted as completed and the director of finance be directed to issue warrants for final payment. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. petition for SID's Water, Sewer, Paving, North 21st Avenue A letter received from the Western General Enterprises petitioning the City of Bozeman to create a Special Improvement District from Beall to Durston on 21st Avenue for Sanitary Sewer, Water, Curb & Gutter and Paving construction was presented. The Commission concurred with the recommendation of the City Manager and it was moved by Commiss- ioner Lehrk~nd, seconded by Commissioner Vandeventer, that they acknowledge the petition to create a Special Improvement District and instruct the City Attorney to prepare a resolution of intention to create the district and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, and Mayor Grabow; those voting No, none. _ .~ ~ 1. r License Bond - Capitol Neon, Inc., $2,000.00 'I'~h ..-.., -.... ..._..~-.. ---- In compliance with Chapter 14 of the Bozeman Municipal Code, the sign bond of Capitol Neon, Inc., in the amount of $2,000.00 was presented. The City Manager stated the Building Inspector had recommended approval of the bond and the Acting City Attorney had approved the bond as to form. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the bond of the Capitol Neon, Inc., be approved and the motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Fund Raising Program - Miss MonLana Pageant A letter received from Kerry L. Cummings, Director for the 1973 Miss Montana Pageant requesting permission to conduct a fund drive from 11 April to 5 May to raise money for a scholarship for the winner of Miss Montana was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the request to conduct the fund drive be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Comm- issioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that Commission Resolution No. 1570 be passed and adopted and 2 May 1973 be the date set for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Comm- issioner Vollmer and Mayor Grabow; those voting No, none. Report - Chief of Police The City Manager commented on the report of the Chief of Police and recommended approval thereof. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the report of the Chief of Police be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer Commissioner Sedivy and Mayor Grabow; those voting No, none. Authorization to Call for Bids - Annual Fuel Supply to 1974 The City Manager requested authority to call for bids for Gasoline No. 2 diesel fuel and No. 1 404 diesel fuel suppliers to furnish the City of Bozeman for a period of one year through 30 June 1974 with approximately 70,000 gallons of gasoline, approximately 15,000 gallons of No. 2 diesel fuel and approximately 1,500 gallons of No.1 diesel fuel. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the request be approved and the Clerk of the Commission be directed to issue a "Call for Bids" to be opened 9 May 1973 and the motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none.
