HomeMy WebLinkAbout1973-04-18 I 1 I Bozeman, Montana 18 April 1973 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 18 April 1973, at 1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Comm- issioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't. City Manager Keyes, Acting City Attorney O'Connell and the Clerk. Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had Minutes of the regular meeting held Wednesday, II April 1973 were approved as read. Consideration of Construction Bids - SID No. 523, Watermains on North 19th Avenue The engineers representing consultants Thomas, Dean & Hoskins, Inc., and the City Engineer having completed their study of the bids submitted for the construction of watermains on North 19th Avenue lying between Beall Street and Durston Road, SID No. 523 and having prepared a final tabulation of the bids recommended that the bid be awarded to Johnston Excavating, Inc., Bozeman, on the basis of their low bid in the amount of $11,054.00 contingent upon the successful sale of the bonds on 25 April 1973. The Commission concurred with the recommendation of the engineers, also concurred in by the City Manager and it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that Johnston Excavating, Inc., of Bozeman be awarded the bid on the basis of their low bid contingent upon the successful sale of the bonds and that the bid security of the unsuccessful bidders be returned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting, No; none. Request for Carnival License - Bozeman Softball Association The request for permission to sponsor a carnival at the Gallatin County Fair Grounds from 17 to 22 July, and that the City Commission waive the license fee for this event, having been tabled for a period of one week to obtain further information, was again presented for discussion. The Bozeman softball association explained that they are sponsoring the carnival for the purpose of raising monety to complete the construction of the Bozeman Recreation Complex. Mr. Purdy of the Montana State University Fieldhouse has been contacted and is agreeable to the City of Bozeman issuing the Bozeman Softball Association a license to sponsor the carnival from 17-22 July 1973. The City Manager recommended that the Bozeman Softball Association be given permission to sponsor the carnival, but that the City Commission not waive the requirements for purchasing a city license for this event but that they set a reduced fee for this five day period of only $200.00 in place of completely waiving the fee. The Commission concurred with the recommendation of the City Manager and it was moved by Comm- issioner Lehrkind, seconded by Commissioner Vandeventer, that the request be removed from the table and they set a reduced fee for the five day period of only $200.00 in place of completely waiving the fee. The motion was carried by the following Aye and No. vote: those voting Aye being Commiss- ioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Petition for Annexation - Adjacent to 7th Avenue Interechange A petition signed by seven property owners north of the present City Limits adjacent to or in the vicinity of North Seventh Avenu~, Bozeman, Montana, and as such petitioning the City to initiate such action as is required to extend the City Limits of Bozeman was presented. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the City Manager acknowledge receipt of the petition and instruct the staff to investigate what would be an appropriate area to annex and begin proceedingson the intent to annex the area. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Request for Variance to Sign Code - Chevron Oil Company A letter received from Stephen D. Clark, Marketing Representative for Chevron Oil Company re- questing a variance to the sign code to remove the existing sign at the Chevron Station located at 711 East Main Street and install a new C-99-S Hallmark sign was presented. Following a discussion, the Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that they deny the request as they did not feel that complying with the code would create an undue hardship to the peoplr 9r the property owners nor did it seem proper to deviate from the sign code on the basis of competition in advertising. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. 405 406 Confirma tion of Police Officer - James M. Stanley The Chief of Police reported that Police Officer James M. Stanley had satisfactorily completed the required six month probationary period and recommended that Officer Stanley be confirmed as a regular officer of the Police Department effective 22 April 1973. The City Manager concurred in the recommendation of the Chief of Police and it was moved by Commissioner Sedivy, seconded by Comm- issioner Lehrkind, that the confirmation of Police Officer Stanley be approved and that he be con- gratulated on completing the six month probationary period and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner I Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. AeE.oLngment of Municipal Band Director 1973 - Gordon Wickham A letter received from Ralph C. Challender, Secretary of the Bozeman Municipal Band, stating the City Municipal Band Board of Directors selected Mr. Gordon Wickham as Director of the Bozeman Municipal Band for the 1973-1974 season, the term covering a period of one year ending April 1974. It was moved by Commissioner Lehrkind. seconded by Commissioner Vandeventer, that the Commission concur in the selection of Mr. Wickham and that they also approve the concert schedule when it is set. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. License Bond: Jack D. Richmond. $5,000.00 Electrician In compliance with Chapter 15 of the Bozeman Municipal Code, the electricians bond of Jack D. Richmond in the amount of $5,000.00 was presented. The Building Inspector had recommended approval of the above mentioned bond and the Acting City Attorney had approved the bond as to form. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the bond be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Autho!.i.!.Lto Call for Construction Bids - SID 512, 519, 520, & No. Wallace, Open 16 May 1973 Authority to c-"n for Bond Sale - SID 512, 519,')20 on 16 May 1973 plans and specifications covering the proposed improvement in Special Improvement District No. 512 for the construction of paving and storm drain, Thompson's #4, SID No. 519 for the construction of paving West Mendenhall and West Lammed Streets between No. Tenth and No. Eleventh Avenue, SID No. 520 for the construction of paving North Twentieth Avenue from Main street to Beall Street, and construction of widening. curb & Gutter and paving North Wallace Avenue between Main and Lamme Street as prepared by Thomas, Dean & Hoskins, Inc., consulting engineers was placed before the Commission. In concurrence with the consulting engineers. the City Manager recommended that the plans and speci- fications as presented be approved and that a call for construction bids and the sale of bonds for SID No. 512 in the maximum amount of $688,000.00, SID No. 519 in the maximum amount of $25,000.00 and SID No. 520 in the maximum amount of $92,000.00 be authorized. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the plans and speci- fications be approved and the Clerk of the Commission be authorized and directed to publish a "Call for Bids" for the construction of Special Improvement District No. 512, 519, 520 and Street widening, Curb & Gutter and paving of North Wallace Avenue between Main Street and Lamme Street with an opening date of 16 May 1973 and to advertise for bids for the sale of the bonds in the amount of $688,000.00 for SID No. 502, $25,000.00 for SID No. 519 and $67,000.00 for SID No. 520 to be received 16 May 1973 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner i."~ Vollmer. Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, and Mayor Grabow; hose voting No, none. Reports The following reports were presented: Police Court Director of Finance Director of Public Service Cemetery Cashiers Report Water Collector The City Manager commented on the above reports and recommended approval thereof. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy. Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Change Narne of Hereford Stree t to Hoffman Drive A letter received from Albert & Mildred Vadheim and Herbert L Thompson, owners and developers of Block Three of Thompson's Addition No.4 and the Secretary of the Thompson Hereford Ranches, Inc., 1 I I 1 I petitioning the necessary resolution that will change the name of Hereford Street of said Addition to Hoffman Drive was presented. Following a thorough discussion, it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer. that they recommend the name of Hereford Street be designated as Hoffman Drive and inst- ruct the Acting City Attorney to draw up a resolution enacting from Hereford Street to Hoffman Drive and the motion was carried by the following Aye and No vote: those Voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. ~te Zoning Change It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer. that the Acting City Attorney be instructed to draw up an ordinance to create a zoning Commission in continuity to the zoning change and the motion was carried by the following Aye snd No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Examination of Depository Securities: In compliance with the provisions of Section 16-2618, R.C.M., 1947, the City Commission pro- ceeded to examine the receipts of Depository Bonds and Securities held by the Director of Finsnce as Security for City Funds deposited in Bozeman banks. It was moved by Commissioner Vollmer, sec~ onded by Commissioner Sedivy, that the securities be approved and a list of these be set forth in full in the minutes of the meeting and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none.
