The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
BUilding, 2 May 1973, at 1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Commiss-
ioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't. City Manager Keyes, Acting
City Attorney O'Connell and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held Wednesday, 25 May 1973 were approved as read. I
Authorize Absence of Commissioner Lehrkind
Upon recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Comm-
issioner Vandeventer, that the absence of Commissioner Lehrkind be authori.zed in compliance with
Section 11-3245, R.C.M., 1947 and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner Vollmer, and Mayor
Grabow; those voting No, none.
Hearin~, Commission Resolution No. 1570 - SILD No. 508, North 16th, 17th & 15th
This was the time and place set in Commission Resolution No. 1565 to hear protests to the crea-
tion of Special Improvement District No. 508 for the purpose of construction of lights on North 15th,
16th and 17th Avenue from Main Street to Durston Road. Affidavit of publication of Notice and the
Clerks mailing certificate stating that all property owners had been notified as required by law
were presented. The City Engineer presented protests filed with the Clerk of the Commission repre-
senting 5.15% of the proposed district.
Several of the property owners protesting the creation of a portion of the lighting district
on North 15th Avenue from Main Street to Beall Street were also present to discuss the protests.
Following a discussion and in concurrence with the recommendation of the City Manager, it was
Moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that they acknowledge receipt
of the protests and delay action on creation of SILD No. 508 for a period of one week. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer,
Commissioner Vollmer, Commissioner Sedivy, and Mayor Grabow; those voting No, none.
Bridger View Mobile Home Park No.3 - Final Plat I
The final plat of the Bridger View Mobile Home Court No. 3 was presented along with a favorable
recommendation of the City County Planning Board.
In concurrence with the recommendation of the City-County Planning Board the City Manager re-
commended that the plat be approved as presented. It was moved by Commissioner Vollmer, seconded
by Commissioner Sedivy, that the above plat be approved as presented and that the City Manager be
directed to sign the plat as Director of Public Service and the motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner
Vandeventer and Mayor Grabow; those voting No, none.
Authority toPurchase Fitness Machines - Approximately $1 ,000.00
It was moved by Commissioner Sedivy, seconded by Commissioner Vandeventer, that the City Police
Department be given authority to purchase fitness equipment in the approximate amount of $1,000.00 .
This equipment is to be used to assist members of these departments in meeting fitness standards now
being established as part of department regulations. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner
Vollmer and Mayor Grabow; those voting No, none.
Engineering Contract - City-Schoo I-County Surfacing Project
A contract Agreement for engineering services by and between the City of Bozeman, County of
Gallatin and School District No.7 and Thomas, Dean & Hoskins for paving of multi-purpose recreation
area improvements included in the Bureau of Outdoor Recreation Project 1973 was presented. It was
moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the Contract for Engineer-
ing Services with Thomas, Dean & Hoskins, Inc., of Great Falls, be entered into and the Mayor and I
Clerk of the Commission be directed and instructed to sign for the City and the Motion was carried'
by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Voll-
mer, Commissioner Sedivy and Mayor Grabow; those voting No, none.
Kite Flying Contest - Old Elks Club Property, 5 May 1973
A letter received from Mrs. Barbara Hackbart, Branch Secretary of Aid Association for Lutherans
requesting permission to sponsor a Kite Flying Contest for the children of the community was presented.
It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that they declare Satur-
day, 5 May 1973, as "Go Fly a Ki te Day" and that the children participate in the Kite flying contes t

at the Old Elks Country Club and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Vandeventer and Mayor
Grabow; those voting No, none.
Fund Raising Activities - Gallatin Association for Mental Health
A letter received from Pat McGillvray, Chairman of the Gallatin Bell-Ringer Campaign requesting
permission to hold a pigeon Drive on Saturday, 12 May 1973, at noon in conjunction with Mental Health
Month and the Gallatin Association for Mental Health was presented. It was moved by Commissioner
Sedivy, seconded by Commissioner Vandeventer, that the request to sponsor activities for the pur-
pose of raising funds to assist the mentally retarded be approved and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vandeventer,
Commissioner Vollmer and Mayor Grabow; those voting No, none.
Proclamations: Radio Month - May, Poppy Day - 25-26 May 1973, Veterans Recognition Month - May,
Weight Watchers Week, 7-14 May:
Mayor Grabow proclaimed the month of Mayas "National Radio Month" and called upon all people
to note the record of achievements of the radio broadcasting industry, its personnel and the theme
Radio Free America. It was moved by Commissioner Sedivy, seconded by Commissioner Vandeventer, that
they concur in the mayors proclamation as requested and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner
Vollmer and Mayor Grabow; those voting No, none.
In accordance with a letter received from Mrs. Isam Love, Poppy Chairman, American Legion Aux-
iliary, Mayor Grabow proclaimed 25-26 May 1973 as "Poppy Day" in the City of Bozeman urged every
citizen to give generous recognition to this program and to obtain and wear a Memorial Red Poppy on
these days. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the Mayor-s
proclamation be endorsed and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Vandeventer and Mayor Grabow;
those voting No, none.
In accordance with Mr. Steven Johnson of the Veterans Employment Service, Mayor Grabow proclaim-
ed the month of Mayas "Veteran' Recognition Month" and called upon all citizens and private emp-
loyers in this City to render every assistance and cooperation in developing job opportunities for
the veterans and assisting them in making the transition from military to civilian life. It was
moved by Commissioner Sedivy, seconded by Commissioner Vandeventer, that they endorse the Mayors
proclamation as requested and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow;
those voting No, none.
Mayor Grabow proclaimed 7-13 May 1973 as ''Weight Watchers Week" and urged all citizens of this
community to support and give recognition to the aims and achievements of this needed community
effort to promote the health and well being of our citizens in making this worthy cause a success.
It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that they concur in
the Mayors proclamation and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, and Mayor Grabow;
those voting No, none.

The City Manager commented on the above reports and recommended approval thereof. It was moved
by Commissioner Vollmer, seconded by Commissioner Sedivy, that the reports be approved and ordered
filed and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner Vollmer, Commissioner Sedivy, Commissioner Vandeventer and Mayor Grabow; those voting No, none.
Ordinance No. 928 - Creating Zoning Commission

as prepared by the Acting City Attorney for the purpose of creating and establishing a City of Bozeman
Zoning Commission was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Van-
deventer, that the above ordinance be adopted and the motion was carried by the floowing Aye and No

Appointment to Zoning Commission Board
Mayor Grabow announced his appointment of the following to the Zoning Commission Board.

The Commission concurred in the Mayor's appointment and it was moved by Commissioner Vande-

plans & Specifications - Seal Coat Improvements - House Bill No. 1+36-254
Plans and specifications covering House Bill No. 436&254 for 81,834 square yards seal coating
for the construction of Seal Coat Improvements as prepared by Thomas, Dean & Hoskins, Inc., con-
sulting engineers was placed before the Commission. In concurrence with the consulting engineers
the City Manager recommended that the plans and specifications as presented be approved and that
a "Call for Bids" for 81,834 square yards Seal Coat for the construction of Seal Coat Improvements
with an opening date of 23 May 1973 be authorized. It was moved by Commissioner Vollmer, seconded
by Commissioner Sedivy, that they concur in the recommendation of the City Manager and the Clerk
of the Commission be authorized and directed to publish a "Call for Bids" for 81,834 square yards
seal coat with an opening date of 23 May 1973 and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Vandeven-
ter and Mayor Grabow; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Sedivy, seconded by Commissioner Vandeventer, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy,
