SUBJECT: Final Plat for the Shonkwiler Addition Lot 1A Subdivision
MEETING DATE: December 5, 2016

RECOMMENDATION: That the City Commission approve the Final Plat for the Shonkwiler
Addition Lot 1A Subdivision and authorize the Director of Public Works to execute the same on behalf of the City of Bozeman.
BACKGROUND: The City Commission granted preliminary plat approval for the Shonkwiler
Addition Lot 1A Minor Subdivision on August 17, 2015, by a 5-0 vote.
§76-3-611(1), MCA, provides that the City Commission shall approve the plat only if:
(a) it conforms to the conditions of approval set forth on the preliminary plat and to the terms of this chapter and regulations adopted pursuant to this chapter; and
(b) the county treasurer has certified that all real property taxes and special assessments assessed
and levied on the land to be subdivided have been paid.

and levied on the land to subdivide have been paid. Attached is a memorandum from Mitch WerBell, Assistant Planner, stating the staff has concluded that all terms and conditions of the
preliminary plat approval have been met.
UNRESOLVED ISSUES: None identified.
ALTERNATIVES: None suggested or proposed.
FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased property tax revenues from new development, along with increased costs to deliver municipal
services to the property.

SUBJECT: FINAL PLAT REVIEW FOR THE SHONKWILER ADDITION LOT 1A MINOR SUBDIVISION, APPLICATION 16056
DATE: OCTOBER 28, 2016
Sanderson Stewart, on behalf of Kimmet Properties, LLC, 2501 Saint Johns Avenue, Billings, Montana 59102, has made application to the City of Bozeman Department of Community Development for Final Plat review and approval for the Shonkwiler Addition Lot 1A Minor Subdivision, a two lot minor subdivision. The Shonkwiler Addition Lot 1A minor subdivision will subdivide an existing 0.946 acre lot to create two commercial lots. Attached is a copy of the signed Findings of Fact and Order dated September 21, 2015. An Improvements Agreement is required for this subdivision for the installation of sanitary sewer and water services to Lot 1A-2. All other necessary infrastructure improvements are constructed. An executed Improvements Agreement and an irrevocable standby Letter of Credit have been received to financially guarantee the remaining improvements. Based on the summary review provided below, the Development Review Committee, the City Engineering’s Department and Department of Community Development have reviewed the application against the conditions of preliminary plat approval; and as a result, find that the final plat application may be approved by the City Commission. Three (3) original mylars of the Final Plat, original Platting Certificate, copy of application and applicant’s written narrative, copy of the Findings of Fact and Order, copy of Improvements Agreement, copy of Letter of Credit #4090020425, copy of Perpetual Use Easement, and draft cover memo are attached for your review. The Improvements Agreement, Perpetual Use Easement and other applicable documents will be recorded and filed with the final plat at the Clerk and Recorder’s Office. The Community Development staff respectfully requests that you prepare a City
Attorney's Certificate using the attached original Platting Certificate; approve the

Certificates of Director of Public Works and Certificate of Completion "as to form". The final City signatures will be obtained once the City Commission has approved the final plat. The final plat application was submitted to the Community Development Department on February 3, 2016 and amended on October 12 and October 27, 2016. Based on the applicant having submitted a complete application on October 27, 2016 for final plat review and approval, and further finding that after receiving supplemental information, the application was deemed complete on October 28, 2016, the 45-working day review period for this final plat would expire on
January 8, 2017.
The item has been submitted for City Commission action on December 12, 2016.
