The Commission of the City of Bozeman met in regular session Wednesday, 17 January 1973, at
1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Commissioner Lehrkind, Commiss-
ioner Vandeventer, Commissioner Vollmer, Ci ty Manager Fryslie, Ass' t. City Manager Keys, Ac ting City
Attorney O'Connell and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting of Wednesday, 10 January 1973, weE' approved as corrected.
Requisition for Final Grant Payment - W.S.F. MT 08-000017, SID 502 $58,275.33: West SIde Water Project:
The Requisition iF4 for Grant Payment, Project No. ~\lSF-MT-08-000017, Contract No. DEN-079 enabling
the City of Bozeman to draw the final grant payment allocated to them in the amount of $58,275.33 for
the construction of Special Improvement District No. 502, West Side Water Main Project was presented.
Following a discussion, the City Manager recommended that the City Commission approve Requisi-
tion #4 for the final grant payment in the amount of $58,275.33 and it was moved by Commissioner Sed-
ivy, seconded by Commissioner Lehrkind, that they approve the above requisition and that the City
Manager be authorized and instructed to execu~ the requisition on behalf of the City and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commiss-
ioner Lehrkirt\ Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none.
proclamahon - ''World Religion Day" 21 January 1973:
Mayor Grabow announced his proclamation of 21 January 1973 as '~orld Religion Da~' in the City
of Bozeman in the fervent hope that it will direct attention on the indivisibility of human well being
stimulate them to a renewed interest in religion and it's potential as a dynamic force to move man-
kind towards it's goal of universal peace and unity as requested by members of the Bahai' Faith. It
was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that they concur in the
Mayors proclamation and the motion was carried by the following Aye and No vote; those voting Aye
being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy,
and Mayor Grabow; those voting No, none.
proclamation - "Jaycee Week" 21-27 January 1973, Prayer Breakfast 22 January 1973:
In accordance with the Bozeman Jaycees, Mayor Grabow proclaimed the week of 21-27 January 1973
as "Jaycee Week" urging all citizens of the community to give full regard to the past servicesof the
Bozeman Jaycees. The Bozeman Jaycees have designated Monday, 22 January 1973, at 7:00 o'clock A.M.
as the day for holding the third annual Mayor's Prayer Breakfast. It was moved by Commissioner Van-
deventer, seconded by Commissioner Vollmer, that the Mayor's proclamation be endorsed in accordance
with the Bozeman Jaycees and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind
and Mayor Grabow; those voting No, none.
~:!..thority to Connect Auxiliary Pm"er Supply, Police Fire Building - $2,350.00:
The City Manager requested authorization to connect the auxiliary power supply plant at the
police fire fuilding to be used as a standby generator in the event there is a power failure.
Following a dfscussion and upon the recommendation of the City Manager, it was moved by Comm-
issioner Vollmer, seconded by Commissioner SediVY, that the bid of "New" Manni.x Electric, Inc., in
the amount of $2,350.00 be accepted and authorization be given "New" Mannix Electric, Inc., to pro-
ceed with the installation of the manual transfer switch, 600 amp, including all material and labor
to make the necessary connections and checking the generator out completely electrically. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commiss-
ioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none.

The City Manager commented on the reports and recommended approval thereof. It was moved by
Commissioner Sedivy, seconded by Commissioner Lehrkind, that the reports be approved and ordered
filed and the motion was carried by the following Aye and No vote: those voting Aye being Commiss-
ioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissi.oner Vollmer and Mayor Grabow;
those vo t ing No, none.

The applicants Billing #2 and Final payment request in accordance with the Bureau of Outdoor
Recreation approved Project Agreement #2 Mont 30-00156 covering the planter and fountain construction,

park in the amount of $1,162.42 was presented.
Following a discussion, it was moved by Commissioner Lehrkind, seconded by Comm:i.ssioner Van-
deventer, that the application for Billing in for the final payment of the Bureau of Outdoor Recrea-
tion approved project Agreement #2 Mont 30~00156 in the amount of $1,162.42 be approved and forwarded
to the State of Montana Department of Fish & Game, Recreation & Parks Division, Helena, Montana, for
consideration and final payment and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Lehrkind, Commissioner Vandeventer. Commissioner Vollmer, Commissioner
Sedivy and Mayor Grabow: those voting No, none.
~lication for,Kennel Lieen~Mrs. R,lph Kenck, 1317 Hest Alderson:
An application received from Mrs. Ralph Kenck, l317 West Alderson, requesting a kennel license
in accordance with Ordinance No. 857, Section 5.16.040 of the Bozeman Municipal Code, together with
the required fee was presented. The City Manager and the Chief of Police stated they were not aware
of any reason to deny the kennel license and it was moved by Commissioner Vandeventer, seconded by
Commissioner Vollmer, that the above application be approved and the Director of Finance be instru-
cted and directed to issue a license in accordance therewith. The motion was carried by the follow-
ing Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer,
Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none.

It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the Commission
declare a recess for the purpose of a meeting of the Police Reserve Board of Trus tees. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commiss-
ioner Sedivy, Commissi.oner Lehrkind, Commissi.oner Vandeventer and Mayor Grabow; those voting No, none.

A letter dated 8 January 1973 from Captain Earl G. Smiley along with a letter from Captain
Smiley's physician and addressed to the City Manager and requesting that he be passed from the active
police force to the Police Reserve in accordance with Section 11-1820, R.C.M., 1947'lWas presented.
The police commissioners at their meeting held Thursday, 11 January 1973, and the Board of
Trustees of the Police Reserve Fund at their meeting held during the recess recommended that Captain
Smiley's request be approved by the City Commissi_on.
Mayor Grabow on behalf of the City Commission paid tribute to Captain Smiley for his outstanding
services and commended him for his devotion to duty during his term wi th the Active Police Department.
The Mayor on behalf of the Commission expressed regret that Captain Smiley's retirement had to be
through disability.
City Manager Fryslie also paid tribute to Captain Smiley and stated that in his opinion he knew
him to be one of the most sincerely dedicated and conscientious officers Bozeman has had and eommented
on the efficient and courteous manner in which he performed his duties as a police officer. He ad-
vised the Commission that it is with regret that he recommend that Captain Smiley be removed from
active duty and placed on the reserve list of the Bozeman Police Department.
The CommiS5ion concurred with the recommendation of the Police Commission, the Board of Trustees
of the Police Reserve Fund and the City Manager and it was moved by Commissioner Sedivy, seconded by
Commissioner Lehrkind, that Captain Smiley be passed from the active Police Force to the Police Reserve.
The motion was carried by the followi_ng Aye and No vote: those voting Aye being Commissioner Sedivy,
Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Lehrkind and Mayor
Grabow; those voting No, none.
~oi.ntmen t of Sergeal2..~ Harold McDowell and Police Officer Ronald D. Green:
The City Manager announced his promotion of Sergeant Harold McDowell to Captain of the Police
Department and his promoti.on of Police Officer Ronald D. Green to Sergeant of the Police Department
of the City of Bozeman effective 15 January 1973.
The Commission concurred in the City Managers appointment and it was moved by Commissioner Lehr-
kind, seconded by Commissioner Vandeventer, that the City Manager's appointment of Harold McDowell to
Police Captain and Ronald D. Green to Sergeant, effective 15 January 1973 be approved and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner
Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none.
Mayor Grabow, on behalf of the Commission congratulated Captain Harold McDowell and Sergeant
Ronald Green on their promotion.

Commissioner Vandeventer, seconded by Commissioner Vollmer, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vande-
