The Commission of the City of Bozeman met in regular session Wednesday, 31 January 1973, at
1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Commissioner Lehrkind, Commiss-
ioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't. City Manager Keyes, Acting
City Attorney O'Connell and the Clerk.
Commissi.oner Sedivy opened the meeting with a prayer and the following proceedings were had:

Hearing, Resolution No. 1554, SID 519, Pave Lamme & Nendenhall - 10th & 11th
This was the time and place set in Commission Resolution No. 1554 to hear protests to the crea-
tion of Special Improvement District No. 519. Affidavit of publication end Notice of the Clerks
mailing certificate stating .that all property owners had been notified as required by law was presented.
The City Manager presented protests filed with the Clerk of the City Commission and signed by
owners of property representing 89.29% of the proposed district as determined by the City Engineer.
Several property owners were present to affirm the written protests to the creation of Special Improve-
ment District No. 519.
Following a thorough discussion, the Commission concurred with the recommendation of the City
Manager, that they exercise their prerogative and override the protests representing 89.29% of the ass-
essed property as provided by Section ll-2206, R.C.M., 1947, concerning the paving of one cross block
connecting with the streets already paved for a continuous distance of three or more blocks. It was
moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that they protests be considered
insufficient as provided by Section 11-2206, R.C.M., 1947, and that the Acting City Attorney be in-
structed to draw up a reso1utionm create the district and the motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner
Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none.
Hearing, Resolution No. 1559, SID 521, Water & Sewer Circle Drive
This was the time and place set in Commission Resolution No. 1558 to hear protests to the creation
of Special Improvement District No. 521. Affidavit of publication of Notice of the Clerks mailing
certificate stating that all property owners had been notified as required by law was presented. The I
City Manager presented protests filed with the Clerk of the City Commission and signed by Donald K.
& Martha F. Weaver and representing 100% of the assessed property in Special Improvement District No.
521. Mr. Weaver was also present to discuss the protests to the creation of Special Improvement District
No. 521.
Following a thorough discussion and the City Commission having determined the protests to be
sufficient, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that under the pro-
visions of Section 11-2205, R.C.M., 1947, no further proceedings shall he had under Commission Resol-
ution No. 1558 and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor
Grabow; those voting No, none.
Hearing, Resolution No. 1559, ~ID 522, Paving Circle Drive
This was the time and place set in Commission Resolution No. 1559 to hear protests to the creation
of Special Improvement District No. 522. Affidavit of publication and Noti.ce of the Clerks mailing
certificate stating that all property owners had been notified as required by law was presented. The
City Manager presented protests filed with the Clerk of the City Commission and signed by Donald K.
& Martha F. Weaver and representing 100% of the assessed property in Special Improvement District No.
522. Mr. Weaver was present to discuss the protests to the creation of Special Improvement District
No. 522.
Following a thorough discussion, and the City Commission having determined the protests to be
sufficient, it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that under the
provisions of Section ll-2205, R.C.M., 1947, no further proceedings shall be had under Commission I
Resolution No. 1559 and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and
Mayor Grabow; those voting No, none.
Grant Increase - $2,370.00, Gallatin Field:
A letter addressed to Mr. William Merrick, Chairman, Gallatin Field Airport Board, Bozeman, Mont-
ana, From Mr. Robie B. Strickland, Chief, Airport District Office, Federal Aviation Administration,
requesting the approval of the Grant amendement to increase the Federal Funds for development of
Gallatin Field under FAAP Project 9-24-003-C808 by $2,370.00 by the City of Bozeman and the County of

of Gallatin was presented.
Following a thorough discussion and in concurrence with the recommendation of the City Manager,
it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that Commission Resolu-
tion No. l560 as set forth in full be adopted by the City Commission and that the Mayor and Clerk of
the City of Bozeman Commission be instructed and directed to sign the Resolution, the Certification
and Attestments in behalf of the City of Bozeman and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer,
Commissioner Sedivy and Mayor Grabow; those voting No, none.
Authority to Purchase Truck, Park Department - $3,983.97
The Park department has need for a one ton truck and the City Manager requested authority to
purchase a one ton single rear wheels C 3500 GMC Truck Model TC30903 in the amount of $3,983.97, it
being the lowest and best bid submitted. It was moved by Commissioner Vandeventer, seconded by Comm-
iss oner Vollmer, that authority to purchase the GMC Truck in the amount of $3,983.97 be granted and
the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vande-
venter, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those
voting No, none.
A~thori ty to Confer wi th HUD & EPA in Denver 9 February 1973 - Ci ty Manager FrysEe
The City Manager requested authority to travel to Denver on Friday, 9 February, to confer with
members of the Housing & Urban Development in regard to the final payment on SID No. 502 and the Env-
ironmental Protection Agency in regard to the retroactive payment which the City is entitled to on the
Waste Water Treatment plant. He also requested that he be granted vacation leave of absence from 12
to 16 February and that the Ass't. City Manager be designated to perform the duties of the City Manager
during this time. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the
above requests be granted and Ass't. City ManagerKeyes be designated as Acting City Manager and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer,
Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting
No, none.
Proclamation, 25 February 1973 - Heart Sunday
In accordance with the American Heart Association, Mayor Grabow proclaimed the month of February
as "American Heart Month' and 25 February to be "Heart Sunday." It was moved by Commissioner Sedivy,
seconded by Commissioner Lehrldnd, that the Mayor's proclamation be endorsed and the motion was carried
by the followiog Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind,
Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none.
Continuation Bond - ~ilson & Company
In compliance with Chapter 16 of the Bozeman Municipal Code, the plumbing and heating bond of
Wilson & Company was presented. The City Manager stated the Building Inspector had recommended
approval of the above mentioned bond and the Acting City Attorney had approved the bond as to form.
It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the continuation
of the aforementioned bond be approved and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Comm-
issioner Sedivy and Mayor Grabow; those voting No, none.
Reports
The following reports were presented:
Librarian Chief of Police (Annual)
The City Manager commented on the reports and recommended approval thereof. It was moved by
Commissioner Vandeventer, seconded by Commissioner Vollmer, that the reports be approved and ordered
filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those
voting No, none.

There being no further business to come before the commission at this time, it was moved by Comm-
issioner Vollmer, seconded by Commissioner Sedivy, that the meeting be adjourned and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner
Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayo
