The Commission of the City of Bozeman met in regular session Wednesday, 7 February 1973, at
1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Commissioner Lehrkind, Commiss-
ioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't. City Manager Keyes, Acting
City Attorney O'Connell and the Clerk.
Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held Wednesday, 31 January 1973, were approved as read.
Reso!ution No. 1561., Creating SID 519, Pave Mendenhall & Lamme Street, 10th to 11th Avenue
Commission Resolution No. 1561 creating SID No. 519, paving Mendenhall and Lamme Street between
10th and llth Avenue, entitled:

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING
A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DIS-
TRICT NO. 519 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTION
AND INSTALLING AN ASPHALTIC CONCRETE PAVING, CONCRETE INTEGRAL CURBS
AND GUTTERS, NECESSARY APPURTENANCES THERETO, ALSO CONSTRUCTION AND
INSTALLATION OF NECESSARY STORM DRAINAGE PIPE, INLETS, MANHOLES, DITCHES
AND ANY OTHER APPURTENANCES TO THE STORM DRAINAGE SYSTEM ON WEST

as prepared by the Acting City Attorney was presented. It was moved by Commissioner Sedivy, seconded
by Commissioner Lehrkind, that the resolution be passed and adopted to create Special Improvement
District No. 519 and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner SediVY, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and
Mayor Grabow; those voting No, none.
~ication for Beer License- Super America Station
The City Manager presented the application and the appropriate fee for a 1973 beer license for
the Super America Station and recommended the approval thereof. It was moved by Commissioner Lehrkind,
seconded by Commissioner Vandeventer, that the application be approved and the Director of Finance
be instructed to issue the license and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner
Sedivy and Mayor Grabow; those voting No, none.
Application for Circus License - MSU Fieldhouse - 13 July 1973
A letter received from Mr. Bud Purdy, Fieldhouse Manager of the Montana State University re-
questing permission to sponsor Hubert Castles International Circus in the Montana State University
Fieldhouse, 13 July 1973, for a matinee and an evening performance was presented. He also requested
the Commission to protect Montana State University two weeks prior and two weeks after the circus
by not issuing a license for a carnival or circus.
Following a discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner
Vollmer, that the subject request be approved with the instructions that this circus be fully lic-
ensed in the total amount of $220.00 in compliance with the provisions of Chapter 3.04.080 of the
Bozeman Municipal Code and stated that if similar applications were received within the above period
the request would be considered at that time and the motion was carried by the following Aye and
No vote; those voting Aye being Commissioner Vandeventer, Commissi.oner Vollmer, Commissioner Sedivy
Commissioner Lehrkind and Commissi.oner Grabow; those voting No, none.
Re-.1!:J~st fqr Variance to Si.gn Code for Ramada Inn

A letter received from Mr. H. L. Swartzendruber, Trustee of Ramada Inn requesting a variance of
the Sign Code 14.16.420 (b) of the Bozeman Municipal Code for moving the Phillips sign approximately
165 feet straight south of its present location and retain its present height was presented.
In addition to improving the access of the Ramada Inn property, it would also clear the view
between the Phillips' station and the Holiday Inn.
Following a discussion, the City Manager recommended that the variance to the Sign Code from
Mr. H. L. Swartzendruber, Trustee of Ramada Inn be approved as presented. It was moved by Commiss-
ioner Vollmer, seconded by Commissioner Sedivy, that they concur in the City Managers recommendation
that Ramada Inn be granted a variance of the Sign Code 14.16.420 (b) of the Bozeman Municipal Code
for moving the Phillips sign approximately 165 feet south of i.ts present location and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner
Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none.

Request for Zoning Change - Adjacent to Westlake's Second Addition
A letter received from Myron M. and Aura D. Westlake requesting that a parcel of land 533 feet
in width east and west adjoining Lots 2, 3,4, 5 and 6 in Block 1, and Lots 1, 2, 3, 4 and 5 in Block
2 of Westlake's Second Subdivision be changed from "B" residence to "MB" motor business was presented.
It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the City Manager
be instructed to acknowledge receipt of the request and that the request be referred to the Bozeman
City-County Planning Board for its considerationand recommendation. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Comm-
issioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none.
Re-.9..~~~t to Vacate Birch Street in hlestlake's Second Addition
A letter received from Myron M. & Aura D. Westlake requesting the vacation of West Birch Street
and the circular turn around on the east side thereof as heretofore dedicated and platted in conn-
ection with platting Westlake's Second Subdivision to the City of Bozeman was presented.
Following a discussion, the Commission concurred with the recommendation of the City Manager
and it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that they acknowledge
receipt of the request to vacate West Birch Street and the circular turn around on the east side and
that the request be referred to the Bozeman City County Planning Board for its consideration and
recommendation. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor
Grabow; those voting No, none.
Lease Renewal, Count~ Club Building to United Commercial Travelers
A Lease Agreement between the United Commercial Travelers, Council 721 of Bozeman, and the City
of Bozeman for the renewal of the Lease of the City of Bozeman Country Club Building on East Curtiss
Street and Golf Way for a period of one year from 1 February 1973 thru 31 January 1974 was presented.
The rental of which is $100.00 per month during the term hereof is payable in advance on or before the
10th of each and every month.
The Commission concurred with the recommendation of the City Manager and it was moved by Commiss-
ioner Vandeventer, seconded by Commissioner Vollmer, that the Lease Agreement be approved and that
the Mayor and Clerk of the Commission be authorized and directed to sign the Lease Agreement on be-
half of the Ci.ty and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissi.oner Lehrkind and
Mayor Grabow; those voting No, none.
Lice~ Bond~stern Plumbing & Heating - Plumbing & Heating $5,000.00
In compliance with Chapter 16 of the Bozeman Municipal Code, the plumbing and heating bond of
Western Plumbing and Heating was presented. The City Manager stated the Building Inspector had re-
commended approval of the above mentioned bond and the Acting City Attorney had approved the bond
as to form. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the continu-
ation of the aforementioned bond be approved and the motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Comm-
issioner Vandeventer and Mayor Grabow; those voting No, none.

The City Manager commented on the reports and recommended approval thereof. It was moved by
Commissioner Sedivy, seconded by Commissioner Lehrkind, that the reports be approved and ordered

ioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor
Grabow; those voting No, none.

The City Manager checked the claims and found them to be true and lawful claims against the
City and recommended they be approved and the Director of Finance be directed to issue warrants in
payment. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the
claims be approved and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy,
Commissioner Lehrkind and Mayor Grabow; those voting No, none.
PrC?..BE...ess Repext on Water System Study: Thomas Dean & Hoskins, Inc.
Mr. T. H. Thomas of Thomas, Dean & Hoskins, Inc., appeared before the Commission to present
a progress report on the Water System Study and presented various maps concerning their preliminary
find ings .

There being no further business to come before the Commission at this time, it was moved by
Commissioner Vandeventer, seconded by Commissioner Vollmer, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vande-
