The Commission of the City of Bozeman met in regular session Wednesday, 14 February 1973, at
1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Commissioner Vandeventer, Comm-
issioner Vollmer, Acting City Manager Keyes, Acting City Attorney O'Connell and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were
had.

Minutes of the regular meeting of 7 February 1973 were approved as read.
Authorize Absence of Commiss oner Lehrkind
Upon the recommendation of the Acting City Manager, it was moved by Commissioner Sedivy, se-
conded by Commissioner Vandeventer, that the absence of Commissioner Lehrkind be authorized in com-
pliance with Section 11-3245, R.C.M., 1947 and the motion ~.,as carried by the following Aye and No
vote: those voting Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner Vollmer,
and Mayor Grabow; those voting No, none.
Proclamation - "Distributive Education Heek" 5-10 March 1973
Mayor Grabow proclaimed 5-10 March 1973 to be Distributive Education Week in the City of Bozeman
in keeping with National Deca Week in accordance with the request of the Deca club of Bozeman Distri-
butive Education. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that
the Mayor's proclamation be endorsed and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and
Mayor Grabow; those voting No, none.
In concurrence with the request of the Deca club of Bozeman Distributive Education, it was
moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that their request to place a two
sided banner across Main Street of Bozeman, during the week of 4-10 March be approved and the per-
mit fee waived contingent upon meeting the requirements of the Bozeman Sign Code with the under-
standing that the sign be removed immediately following National Deca Week and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy,
Commissioner Vandeventer and Mayor Grabow; those voting No, none.
Commission Resolution No. 1~62, Intent to Vacate Port:Lon of West Birch Street, Hearing lL. I-larcn 1973 I.
The City County Planning Board having reviewed the request of Mr. Westlake for the vacation of
a portion of West Birch Street recommended to the City Commission the vacation of that portion of
West Birch Street.
COMMISSION RESOLUTION NO. l562
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO VACATE ALL
THAT PORTION OF WEST BIRCH STREET LYING BETWEEN BLOCKS ONE AND
'lWO OF WESTLAKE"S SECOND SUBDIVISION OF THE CITY OF BOZEMAN, MONTANA.
prepared by the Acting City Attorney as directed by the Commission to vacate a portion of West
Birch Street and the circular turn around on the East side thereof as heretofore dedicated and
platted in connection with platting Westlakes Second Subdivision was presented. It was moved by
Commissioner Sedivy, seconded by Commissioner Vandeventer, that Commission Resolution No. 1562 be
passed and adopted and lLf March be set as the date for public hearing and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vande-
venter, CommissionerVollmer and Mayor Grabow, those voting No, none.
lnten~to Change Zone, Tract East of Westlake's Second Subdivision
The request from Myron M. & Aura D. Westlake, that a tract of land 533 feet in width East and
West adjoining Lots 2, 3, 4, 5 and 6 in Block 1 and Lots I, 2, 3, 4, and 5 in Block 2 of Westlakes
Second Subdivision be changed from "B" residence to "MB" motor business zone having been referred
to the Bozeman City-County Planning Board for its consideration and recommendation was again pre-
sented with a favorable recommendation for the zone change from the City County Planning Board.
The Acting City Manager recommended that the City Commission hold a public hearing whereby I
interested parties may make their views known on this proposed zoning change.
Following a discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner
Vollmer, that the Commission concur with the recommendation of the Acting City Manager to hold a public
hearing and that the Clerk of the Commission be instructed and directed to publish a "Notice of Public
Hearing" to be held in the Commission Room at 1:30 o'clock p.m. on the 14th day of March 1973. The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer,
Commissioner Vollmer, Commissioner Sedivy, and Mayor Grabow; those voting No, none.

Permission to Conduct Parade - College National Finals Rodeo, 19 June 1973
A letter received from Wayne Gibson, Chairman of the College National Finals Committee request-
ing permission to hold a parade on 19 June 1973, at 1:00 p.m. \l1as presented. It was moved by Comm-
issioner Vollmer, seconded by Commissioner Sedivy, that permission be granted to conduct the College
National Finals Rodeo Parade and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Vandeventer and Mayor
Grabow; those voting No, none.
Authority to Purchase Pickup, Water Department - $2,862.69
The Water Department has need for a 1/2 ton long wide box pickup and the Acting City Manager
requested authority to purchase a 1973 GMC 1/2 ton long wide box pickup in the amount of $2,862.69
as quoted by Robert F. Dye, Inc., it being the lowest and best quote submitted. It was moved by
Commissioner Sedivy, seconded by Commissioner Vandeventer, that authority to purchase the GMC Truck
in the amount of $2,862.69 from Robert F. Dye, Inc., be granted and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Sed ivy, Commissioner Vandeventer,
Commissioner Vollmer and Mayor Grabow; those voting No, none.

The applications as priority number 1-1973 for the widening of North Wallace Avenue and Eng-
ineering at an estimated cost of $55,000.00, the Extra Width on North Twentieth Avenue and Engineer-
ing at an estimated cost of $28,000.00 and the Seal Coating and Engineering at an estimated cost of
$34,000.00 to be paid for from the Gas Tax funds allocated to the City of Bozeman under provisions
of House Bill No. 42-Lf36 & 254 and complying with Rules and Regulations promulgated by the Montana
State Department of Highways for administration of the Act was presented. It was moved by Comm-
issioner Vandeventer, seconded by Commissioner Vollmer, that the applications for the projects be
executed by the members of the City Commission and submitted to the Montana State Highway Commission
as presented and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting
No, none.
Bond - Tatarka Const_ruction Plumbing and Mechanical Contractor
In compliance with Chapter 16 of the Bozeman Municipal Code, the plumbing and mechanical con-
tractor bond of Tatarka Construction was presented. The Acting City Manager stated the Building
Inspector had recommended approval of the above mentioned bond and the Acting City Attorney had app-
roved the bond as to form. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy,
that the aforementioned bond be approved and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Vandeventer, Comm-
issioner Grabow; those voting No, none.
Reports - Casher's
The Acting City Manager commented on the report of the Cashier and recommended approval thereof.
It was moved by Commissioner Sedivy, seconded by Commissioner Vandeventer, that the report of the
cashier be approved and ordered filed and the motion was carried by the following Aye and No vote

Mayor Grabow; those voting No, none.
Announcement of the Retirement of the Fire Chief - Jack Huber
A letter dated 13 February 1973 from Fire Chief Huber announcing his resignation as Chief of
the Bozeman Fire Department effective 28 February 1973 was presented.
A letter from Fire Chief Huber's physician was presented. Also a letter from the Fire Relief
Association of the Bozeman Fire Department stating that they had accepted Fire Chief Huber's re-
signation in accordance with Section 11-1926, R.C.M., 1947, was presented.
Mayor Grabow on behalf of the City Commission paid tribute to Fire Chief Huber for his out-
standing services and commended him on the many years given the City of Bozeman and stated that it
was with regret that they accepted his resignation.
Acting City Manager Keyes also paid tribute to Fire Chief Huber and advised the Commission that
it is with deep regret that the City of Bozeman accept his resignation in accordance with Section
11-1926, R.C.M., 1947.

It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that they accept
Fire Chief Huber's resignation effective 28 February 1973 and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Comm-
issioner Sedivy and Mayor Grabow; those voting No, none.
AULhori:ty to Attend Construction Inspector's Short Course I - Ass'tCiLy Engineer, Robert Thomson,

There has been a Construction Inspector's Short Course I scheduled to be held in Helena, 20-21
February 1973 and the Acting City Manager requested that Ass't. City Engineer Robert Thomson be
authorized to attend the meeting and that it being in the public interest his expenses be paid
from the appropriate fund. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy,
that permission be granted Ass't. City Engineer Robert Thomson to attend the Short Course I and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer,
Commissioner Sedivy, Commissioner Vandeventer and Mayor Grabow; those voting No, none.

Commissioner Sedivy, seconded by Commissioner Vandeventer, that the meeting be adjourned and the
