HomeMy WebLinkAbout1973-01-03 I I I 361 Bozeman, Montana 3 January 1973 The Commission of the City of Bozeman met in regular session Wednesday, 3 January 1973, at 1:15 o'clock P.M. Present were Mayor Grabow, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vdlmer, City Manager Fryslie, Acting City Attorney O'Connell and the Acting Clerk. Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting of 27 December 1972 were approved as read. Application for Beer License - 1973: The City Manager presented the application and the appropriate fee for a 1973 Beer License for the Knotty Keg and recommended the approval thereof. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the application be approved and the Director of Finance be instructed to issue the license and the motion was carried by the following Aye and No vote. those voting Aye , being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Proclamation: Alien Address Month - January: Mayor Grabow, in response to a request from the United States Department of Justice, proclaimed the month of January to be Alien Address Month in the City of Bozeman and requested that all aliens residing within the City report their addresses to the U. S. Post Office or Immigration and Natura- lization Service during this month. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the Commission concur in the Mayor's proclamation and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Request to Vacate Streets & Alley - Block "c" Rouse's Second Addition: Two letters which had been received from Mr. Paul W. Scott, Western Director of the Real Estate, Economic & Resource Development Department of the Chicago, Milwaukee, St. Paul and Pacific Railroad Company, were read by the City Manager requesting the permanent vacation of that portion of East Olive and East Curtiss Streets lying between Wallace Avenue and the west line of vacated Ida Avenue, the alley lying between these streets in Block C, Rouse's 2nd Addition, and the portion of South Ida Street from the south line of East Main Street to the south line of East Curtiss, to enable the Railroad Company to sell a portion of this land to Mr. Frank R. Harrington. These streets and the alley had been vacated by Ordinance 402, passed by the City Council on 3 May 1900 but contained a reversion clause whereby the vacated streets and alley will revert back to the City if the Gallatin Valley Electric Railway or their successors discontinue to use the land for railway purposes. During the discussion on this request, the City Manager was instructed to contact the Railroad Company regarding a request which had been made by the City for permission to extend South Black Avenue and South Rouse Avenue across the railroad right-of-way in the vicinity of the University Subdivision and other land currently under lease to the City and used as a portion of Lindley Park. It was also brought out by the City Manager, that he did recommend vacating South Ida at this time as this could provide another future access to Lindley Park. In response to the recommendation of the City Manager, it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the City Attorney be instructed to draw a Resolution of Intention to vacate the above requested streets and alley with the exception of South Ida and the City Manager was instructed to negotiate with the Railroad Company prior to final action on this request and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Reports: The following reports for the month of December were submitted: Fire Chief Building Inspector The City Manager commented on the above reports and it was moved by Commissioner Vollmer, se- conded by Commissioner Sedivy, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Commission Resolution No. 1557 - Confirming the Sale of $331,000 Bonds in SID 511: The City Manager presented and recommended adoption of Commission Resolution No. 1557 which had been prepared by the firm of Dorsey, Marqu~rt, Windhorst, West & Halladay of Minneapolis, Minnesota, 362 which firm has been retained as bond counsel by D. A. Davidson, Inc., the purchasers of these bonds. COMMISSION RESOLUTION NO. 1557 RESOLUTION CONFIRMING SALE OF $33I,OOO SPECIAL IMPROVEMENT DISTRICT NO. 5ll BONDS, AND PRESCRIBING THEIR FORMS AND TERMS AND COVENANTS OF THE CITY FOR THE SECURITY OF THE HOLDERS THEREOF. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that Resolution No. 1557 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Adjournment: There being no further business to come before the Commission at this time, it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none.
