The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 20 December 1972, at 1:15 o'clock p.m. Present were Commissioner Sedivy, Commissioner
Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Acting City Attorney
O'Connell and the Acting Clerk.
Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held Wednesday, 13 December 1972, were approved as read.
Authorize Absence of Mayor Grabow and Designate Commissioner Sedivy President ~ro Tempore:
Due to the absence of Mayor Grabow and upon the recommendation of the City Manager, it was moved
by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that his absence be authorized in
compliance with Section 11-3245 R.C.M. 1947 and Commissioner Sedivy be appointed President Pro Tempore
through 31 December 1972 and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Lehrkind, Commissioner Vandeventer and Commissioner Vollmer; Commissioner
Sedivy abstained.
Appointment of Robert F. Keyes as Acting Clerk of the Commission:
Due to the vacation of Clerk of the Commission, Erna V. Harding, and upon the recommendation of
the City Manager, it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that
Assistant City Manager Robert F. Keyes be appointed Acting Clerk of the Commission during her absence
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vandeventer, Commissioner Vollmer, Commissioner Lehrkind and Acting Mayor Sedivy; those voting No, none.
Appointment of M.S.U. Security Officers as Special City Policemen:
,The City Manager read a letter which he had received from Harold W. Pettys, Acting Chief of the
University Police, requesting that the named Security Officers be appointed Special City Police for
the purpose of issuing moving traffic violations for 1973. Officer Pettys also expressed his app-
reciation for the splendid assistance and cooperation the M.S.U. Security Force receives from the
Bozeman Police Department. The City Manager stated that this has been done annually and has worked
satisfactorily in the past and recommended that the Commission again appoint these officers as Special
City Policemen. It was moved by Commissioner Vollmer, seconded by Commissioner Lehrkind, that the
Commission appoint the named University Security Officers as Special City Policemen for the purpose
of issuing moving traffic violations only for 1973 and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Vollmer, Commissioner Lehrkind, Commissioner Vande-
venter and Commissioner Sedivy; those voting No, none.
Change Order No's 3 & 4 to SID 502 - WSF-MT-08-00-0017, $4,295.95 and $788.14:
The City Manager presented to the Commission Change Orders No's 3 & 4 to SID 502 -(WSF-MT-08-
00-0017) totaling $4,295.95 and $788.14 respectively which had been prepared by the Consulting En-
gineers and executed by the Contractor. Following an explanation of the items covered by these
Change Orders, it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that
Change Orders be approved and that Commissioner Sedivy be authorized to execute these documents on
behalf of the City and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Commissioner Sedivy;
those voting No, none.
Bond Sale - SID 518 - $16,000.00:
The City Manager stated that according to the affidavit of publication this is the time and place
for the sale of bonds to finance the cost of park improvements in Special Improvement District No. 518
and recommended that the Commission authorize the bidding to proceed. It was moved by Commissioner
Vandeventer, seconded by Commissioner Vollmer, the bidding proceed and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer,
Commissioner Lehrkind and Commissioner Sedivy; those voting No, none.
Two bidders were present, Mr. Dave Orlady of First National Bank, Bozeman and Mr. Arnold Benson
of Dillon, and deposited the required bid security with the Acting Clerk. Bidding then proceeded
with the lowest bid submitted as follows:

The City Manager, after a conference with the Director of Finance, recommended that First National
Bank of Bozeman be sold the bonds on the basis of their low bid of 5.1% interest.
It was then moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that First
National Bank be sold the bonds on the basis of their low bid of 5.1% and the bid security of Mr.

Benson be returned and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Lehrkind and Commissioner Sed-
ivy; those voting No, none.
Request for SID - Water Main on North 19th Avenue:
The City Manager read a letter from Eugene Graf, Jr. requesting a Special Improvement District
to install a water main on North 19th Avenue, between Beall and Durston Road. The City Manager
stated that there may be problems if these residential lots fronting on-North 19th are developed on
a gravel street. He suggested that the Commission table for one week action on this request to allow
him to discuss this problem with Mr. Graf. It was moved by Commissioner Vollmer, seconded by Comm-
issioner Lehrkind that this item be tabled for one week and the motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Lehrkind, Commissioner
Vandeventer and Commissioner Sedivy; those voting No, none.
West Main Street - South 11th Avenue Projects Agreements and Plans for Approval:
plans and Agreements prepared by the Department of Highways for the widening of West Main Street
from 15th Avenue westerly (Project No. U-203(10)l, South Eleventh Avenue Construction (US449(2)) and
West College Street and U.S. 191 intersection (EHST9012(1)) were presented to the Commission. During
the discussion on these projects the City Manager read a copy of a memorandum from Dennis Williams,
Supervisor, Division Construction Section, concerning minor changes that would be included in the
final plans or corrected in the construction stage of these projects. It waS moved by Commissioner
Lehrkind, seconded by Commissioner Vandeventer, that the plans and agreements be approved and that
Commissioner Sedivy and the Acting Clerk be authorized and instructed to execute these plans and
agreements on behalf of the City and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Commiss-
ioner Sedivy; those voting No, none.
Proposed Land Trade - Bozeman Creek Watershed:
The City Manager read a letter from Ross MacPherson, District Ranger of the Gallatin National
Forest, inquiring if the City would be interested in trading City-owned lands in the Bozeman Creek
Watershed for Forest Service Lands near the water intakes on Bozeman Creek and Hyalite Creek or possi-
bly engaging in a tripartate exchange of timber sales elsewhere to purchase the City-owned land as has
been discussed on several occasions in the past.
Following a discussion on this proposal, it was moved by Commissioner Vandeventer, seconded by
Commissioner Vollmer, that the City Manager be authorized to continue negotiations with the Forest
Service concerning this proposed land trade and present a suggested transaction to the Commission as
soon as possible and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vandeventer, Commissioner Vollmer, Commissioner Lehrkind and Commissioner Sedivy; those
voting No, none.

The City Manager commented on the reports and recommended approval thereof. It was moved by
Commissioner Vollmer, seconded by Commissioner Lehrkind, that the reports be approved and ordered

ioner Vollmer, Commissioner Lehrkind, Commissioner Vandeventer and Commissioner Sedivy; those voting
No, none.
Unnumbered Commission Resolution Supporting Funding of M.S.U.:
The City Manager presented a resolution expressing support of adequate funding for Montana State
University entitled:

MONTANA STATE UNIVERSITY.
It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the resolu-
