HomeMy WebLinkAbout1972-12-06 351 Bozeman, Montana 6 December 1972 I The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 6 December 1972, at 1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't. City Manager Keyes, Acting City Attorney O'Connell and the Clerk. Commissioner Sedivy opened the meeting with a prayer and the following proceed ins were had: Minutes of the regular meeting held Wednesday, 29 November 1972 were approved as read. Resolution No. 1555 - Certification of Delinquent City Special Assessments for 1972 - $52,196.10: Commission Resolution No. 1555 certifying delinquent taxes in the amount of $52,196.10 to the Gallatin County Treasurer was presented, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DECLARING CERTAIN SPECIAL ASSESSMENTS AND INSTALLMENTS OF SPECIAL ASSESSMENTS, DUE AND PAYABLE 30 NOVEMBER 1972, AND UNPAID AS OF THAT DATE, AND CERTAIN OTHER SPECIAL ASSESSMENTS AND INSTALLMENTS OF SPECIAL ASSESSMENTS, DUE AND PAYABLE 30 NOVEMBER 1972, AND UNPAID, DELINQUENT, AS PROVIDED BY CHAPTER 2.32 OF THE BOZEMAN MUNICIPAL CODE AND SECTION 11-2233, POLITICAL CODE, R. C . M., 1947. Upon recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Comm- issioner Lehrkind, that the resolution be passed and adopted and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeve~ter, Commissioner Vollmer and Mayor Grabow; those voting No, none. The motion was carried by the following Aye and No vote: those Voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Open Bids, Cast Iron Pipe & Fittings: This was the time and place set for opening bids for the purchase of Cast Iron Pipe, Gate Valves, together with sundry fittings for installation at the Bozeman Softball Complex and for use by the Water Department. The affidavit of publication of the "Call for Bids was presented. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vande- venter, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. The following bids were then opened and Grinnell Corporation Northwest Pipe Fittings Waterworks Equipment Co. Waterworks Supplies Co. read: Billings Billings Great Falls Billings 352 It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the bids be re- ferred to the City Engineer and the Water Superintendent for tabulation and recommendation to be made to the Commission and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vande- venter and Mayor Grabow; those voting No, none. Open Bids - Sodium Silicof1uo~ide for Water Department: This was the time and place set for opening bids for the purchase of 50,OOOY Sodium Silico- fluoride. The affidavit of publication of the "Call for Bids" was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the bids be \ opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. MacKenzie & Fermann, Limited, Calgary 11.61 II II Northwest Distributing Company 10.80 II " In concurrence with the recommendation of the City Manger, it was moved by Commissioner Lehr- kind, seconded by Commissioner Vandeventer, that the bids be referred to the City Engineer and the Water Superintendent for tabulation and recommendation to be made to the Commission and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Comm- issioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy; those voting No, none. :Request for Change of Zonin~, "A" Residential to "B" Residential, Tracts between Apollo Subdv. & Gray Tract: A letter received from Attorney's Holter and Heath on behalf of the Collins Construction Com- pany requesting a change of Zoning from "A" Residential to "B" Residential Zone on a tract between Apollo Subdivision and Gray Tract was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the City Commission acknowledge receipt of the request and that the request for zoning change to allow for multi family dwellings be returned to the City County Planning Board for consideration and recommendation. The motion was carried by the following Aye and No vote; those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Request to cover steps, building at Tracy & Main with Steel Gage cover, McRay Evans: A letter received from McRay Evans with a request to cover the steps that lead to the basement of the building at Tracy Avenue and Main Street, referred to as the former Gallatin Bank Building, with steel of a strong gage for the protection of the public who use them was presented. Following a discussion, it was moved by Commissioner Lehrkind, seconded by Commissioner Vande- venter, that the City Manager be directed to address a letter to Mr. Evans acknowledging receipt of the request and that the request be delayed for further study and recommendation. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Comm- issioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Easement Agreemen t - 6" We termain - Allen & Mi 1dred Visocan: An easement and Right of Way Agreement for a 6" watermain from Allen J. ~ Mildred E. Visocan for the purpose of installing, operating, using, repairing, maintaining and removing a six inch watermain thereto upon and across the above described property lying within the City of Bozeman, County of Gallatin was presented. The City Manager recommended that the City enter into the Easement Agreement approved as to form by the Acting City Attorney and it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the Easement Agreement be entered into by the City and the Mayor and Clerk of the Commission be authorized and directed to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Repo~: I The following reports were presented; Building Inspector Chief of Police Director of Public Service The City Manager commented on the above reports and recommended approval thereof. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Vollmer, Commissioner Sedivy, Commiss- ioner Lehrkind, and Mayor Grabow; those voting No, none. Reports of National League of Cities Meeting - Commissioner Sedivy: Commissioner Sedivy reported on his attendance of the 49th National League of Cities meeting held in Indianapolis 26 to 30 November 1972. Mayor Grabow extended the appreciation of the Comm- ission on Commissioner Sedivys comprehensive report. Adjournment: There being no further business to come before the Commission at this time, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Comm- issioner Sedivy.
