The City Hanager concurred in the recommendation of the engineers and re- commended that the project be accepted and approved by the City Commission and final payment made. This final acceptance and payment does not relieve the contractor of responsibility for negligence or faulty materials or workmanship to the extent and period provided by la\V'. The contractor has furnished a performance bond equal to the total contract bid to guarantee materials and workmanship for a one year period commencing upon final acceptance. Affidavit of publication of notice was presented. No one appeared to protest and no written protests having been recieved, Commission Resolution No. 1539 was presented for final passage. The Commission concurred with the recommendation of theCity Manager and granted Fire Chief Huber authority to attend the meeting and, it being in the public interest his expenses be paid from the General fund and the motion ~"'aS carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. S. Department of HOllsing and Urban Development Circular MPD 6415-2A was presented. The plan shall consider the entire jurisdictional Brea of the Gallatin-Bozeman City-County Planning Board and include the following: existing facilities, plan for immediate need, five to ten year plan, and a long range plan. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the contract agreement by and between the City of Bozeman, and Thomas, Dean & Hoskins, Inc., of Great Falls be entered into and the Mayor and Clerk of the Commission be directed to sign for the City. The motion was carried by the following Aye and No vote: Those voting Aye being Commissioner Sedivy, Commissioner Vandeventer and Mayor Grabow; those Voting No, Commissioner Lehrkind and Commissioner Vollmer abstained.
