The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, q October 1972, at 1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Comm-
issioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Frys1ie, Acting City
Attorney 0' Connell and the Clerk.
Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held Wednesday, 27 September1972 were approved as read.

The engineers representing consulting Thomas, Dean & Hoskins, Inc., and the City Engineer having
completed their study of the bids submitted for the construction of sanitary sewers through the Rem-
ington Addition to Bozeman SID No. 514, construction of sanitary sewers from South Nineteenth Avenue
to Lincoln Road a distance of 2,450 feet, SID No. 516, and for the construction of sanitary sewers
to serve Tai Lane Addition and a portion of Boylans Addition, SID No. 517, and having prepared a
final tabulation of the bids recommended that C. W. Schmid, Inc., Missoula, Montana, be awarded the
contract for the construction of SID NO's. 514, 516, and 517 on the basis of their low and best bid
in the amount of $60,063.53 contingent upon the successful sale of the district bonds and the bid
security be returned to the unsuccessful bidders.
The City Manager concurred with the recommendation of the consulting engineers and the City
Engineer and it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the con-
tract be awarded to C. W. Schmid, Inc., of Missoula on the basis of their low bid as noted above and
the bid security be returned to the unsuccessful bidders and C. hr. Schmid, Inc., be given authority
to proceed with the construction of the sanitary sewer construction of SID's 514, 516 and 517 contin-
gent upon the successful sale of the district bonds and the motion was carried by.the following Aye
and No vote: those voting Aye being Commissioner Sed ivy, Commiss ioner Lehrkind, Commissioner Van-
deventer, Commissioner Vollmer and Mayor Grabow; those voting No, none.

This was the time and place set for public hearing on levying the estimated assessment for con-
struction of Special Improvement District No. S02 in the estimated amount of $!}30,OOO.00. Affidavit
of publication of Notice was presented. No one appreared to protest and there being no written protests
on file, Commission Resolution No. 1544 provisionally passed and adopted on 27 September 1972 was
presented for final passage. It was moved by Commissioner Lehrkind, seconded by Commissioner Van-
deventer, that the resolution be finally passed and adopted and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Comm-
issioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none.

This was the time and place set for public hearing on levying the final assessment for con-
struction of Special Improvement District No. 505 in the final amount of $30,000.00. Affidavit of
publication of Notice was presented. No one was present to protest and there being no written protes~s
on file, Commission Resolution no. l5!fS provisionally passed and adopted on 27 September 1972 was
presented for final passage. It was moved by Commissioner Vandeventer, seconded by Commissioner
Vollmer, that the resolution be finally passed and adopted and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Vommissioner Vandeventer, Commissioner Vollmer, Commiss-
ioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none.

Commission Resolution No. 1546 levying final assessment for the paving of a portion of West
Aspen Street and Tamarack Street between North Fifth and North Seventh Avenue, SID No. 504 in the
total amount of $62,000.00 was presented; entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING,
AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN
SPECIAL IMPROVEMENT DISTRICT NO. 504 IN THE CITY OF BOZEMAN, COUNTY OF
GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND
MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 504.
It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the resolution be
provisionally passed and adopted and 11 October 1972, be set as the date for public hearing and the
motion was carried by the following Aye and No Vote: those voting Aye being Commissioner Vollmer,
Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting
No, none

This was the time and place set for the sale of the bonds of Special Improvement District No.

514, 516 and 517. Affidavit of publication of Notice of the sale of bonds was presented.
The Mayor and the City Manager outlined the proceedure for conducting this bond sale and stated
that the amount of bonds to be sold for each district would be adjusted in accordance with low con-
struction bids received as follmvs:

mitted, the sale of the bonds be awarded to Fletcher Hare and the bid security of the unsuccessful
bidders be returned and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, G,ommissioner Vollmer
and Mayor Grabow; those voting No, none.
Mayor Grabow announced the City was ready to conduct oral bidding on the bonds of Special Im-

Following the recommendation of the City Manager. it was moved by Commissioner Lehrkind, seconded
by Commissioner Vandeventer, that the bid of Mark Patton, Bozeman, being the lowest and best bid sub-
mitted, the sale of the bonds be awarded to Mark Patton and the bid security of the unsuccessful
bidders be returned and the motion \vas carried by the following Aye and No vote: those voting Aye being
Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor
Grabow; those voting No, none.
Mayor Grabow announced the City was ready t conduct oral bidding on the bonds of Special Improve-

Following the recommendation of the City Manager, it was moved by Commissioner Vandeventer,
seconded by Commissioner Vollmer, that the bid of Fletcher Hare, Bozeman, being the lowest and best
bid submitted, the sale of the bonds be awarded to Fletcher Hare and the bid security of the unsuccess-
full bidder be returned and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and
Mayor Grabow; those voting No, none.

A letter received from the Gallatin Empire Lions Club and the Bridger Bowl Ski Club requesting
authority to complete the following three phases of the proposed building plan this fall to develop
a ski jump on the City leased property adjacent to Lindley Park was presented.
1. Formation of the hill. This involves about 2000 yards of dirt moving.
2. The installation of 2 light poles on the leased property. The powerlines
will run overhead to cross the creek and originally reach the leased land.
(subject to the approval of Montana Power)
3. Limited crowd control split rail fences.
Required insurance will be underwritten by the two clubs for the first year.
(Oct. 1, 1972 to Sept. 30, 1973) The expenses associated with the completion
of the above projects will be underwritten by the two clubs.
Following a review of the proposed project and a discussion with the Recreational Director A.
Glen White, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the Gallatin
Empire Lions Club proposal to construct the ski jump be approved as requested IlTith a co:tingency that
the City enter into an agreement with the Gallatin Empire Lions Club and the Bridger Bowl Ski Club,
that they leave the City free and harmless on any violations. The motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner
Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none.

Mayor Grabow announced his proclamation designating the week of 9-14 October 1972 as "Fire
Prevention Week." The Fire Chief reported a breakfast to which the public is invited, will be
served at the Bozeman Fire Hall on Monday, 9 October 1972, from 6:30 o'clock a.m. to kick off the
annual Fire Prevention Week activities and that the City Fire Department has scheduled a full program
for the entire week. It was moved by Comnli ssioner Sedivy, seconded by Commissioner Lehrkind, that
the Mayor's proclamation and the program of the Fire Department be concurred in and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner
Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none.

The Water department has need for a "Pipe Puller" in the approximate amount of $1,550.00 and
the City Manager requested authority to place an order for the "pipe puller" It was moved by Comm-
issioner Lehrkind, seconded by Commissioner Vandeventer, that the City Manager be granted permission
to purchase the 'Pipe Puller' in the approximate amount of $1,550.00 and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer,
Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none.
Fin.al Acceptll.Ps~and~oval of Payment - 1972 Seal Coat Projec~,O~.2l:
The certtificate of the engineer of Thomas, Dean & Hoskins, Inc., stating the construction of
the Seal Coat Street Improvements by Bozeman Sand and Gravel, Inc., have been completed in accordance
IlTith the terms and stipulations given in the plans and specifications for such work was presented.
The City Manager concurred in the recommendation of the consulting engineers and recommended approval
and final acceptance of the project with recommendation to the Montana State Highway Department, that
full and complete payment be made from HB436-254 Funds for Project No. 212(16).
The final acceptance does not relieve the contractor of responsibility for ne3ligence, or faulty
materials or workmanship within the extent and period provided by latlT. The contractor has furnished
a performance bond equal to the total contract bid to guarantee materials and workmanship for a one-

The City Hanager checked the claims and found them to be true and lm-1ful claims against the
City and recommended they be approved and the Director of Finance be directed to issue warrants in
