HomeMy WebLinkAbout1972-11-22 348 Bozeman, Montana 22 November 1972 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 22 November 1972, at 1:15 o'clock p. m. Present were Mayor Grabow, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't. City Manager Keyers~ Acting City Attorney O'Connell and the Clerk. Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held Wednesday, 15 November 1972. were approved as read. Request to Vacate Alley - Juniper to Aspen Street between North Seventh & Eighth Avenue; The request from Douglas Drysdale on behalf of Howard H. Nelson, requesting that the alley from Juniper to Aspen Streets between North Seventh and North Eighth Avenue within the City of Bozeman be vacated waS removed from the table for fuxher discussion and consideration. Following a thorough discussion, the Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that they deny the request to vacate the alley from Juniper Street to Aspen Street between North Seventh and North Eighth Avenue and that they instruct the City Manager to address a letter to Douglas Drysdale on be- half of Howard H. Nelson advising him that the City has denied the request as presented. However if and when his clients develop a specific building proposal, the City would then be open to consider- ation of a request from them for an encroachment permit. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vand- eventer, Commissioner Vollmer and Mayor Grabow; those voting N~, none. Public Hearing, Proposal to Create Gallatin Airport Authority: Res. 1553 - Joint City-County Conveyance to Gallatin Airport Authority: This was the time and place designated by the City Commission, Bozeman, and the Board of County Commissioners, Gallatin County, Montana, to hear protests to the creation of a municipal airport authority pursuant to Chapter 9, Title l, Revised Codes of Montana 1947, as amended. Affidavit of publication of Notice in the Gallatin County Tribune issue of 9 November 1972 as required by law was presented. Following a discussion, it was moved by Commissioner Lehrkind, seconded by Commissioner Vande- venter, that the City of Bozeman and the County of Gallatin enter into a joint resolution No. 1553 entitled: I I COMMISSION RESOLUTION NO. 1553 JOINT RESOLUTION OF THE COUNTY OF GALLATIN, MONTANA, AND CITY OF BOZEMAN, MONTANA, CONVEYING AND TRANSFERRING THEIR INTERESTS IN AND OBLIGATION WITH RESPECT TO GALLATIN FIELD TO THE GALLATIN AIRPORT AUTHORITY. as prepared by the Gallatin County Attorney repealing Joint Resolution No. 512 and that the Mayor and Clerk of the Commission be authorized and directed to sign the Joint Resolution No. 1553 for the City of Bozeman. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandventer, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Bob Marshall - Interest in Crushing and Disposing of Car Bodies: Bob Marshall appeared before the Commission to discuss the possibility of leasing some land at the site of the old dump ground to be used for the purpose of crushing and disposing of car bodies. Following a discussion, Mr. Marshall was informed that the City will await the action of the 1973 Legislature concerning disposal of car bodies. Authority to Purchase Copper Pipe - Approximately $3,500.00: The City Manager requested authority to purchase Copper Pipe in the approximate amount of $3,500.00. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the City Manager be granted authority to purchase the Copper Pipe and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, I Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Authority to Advertise Sale of Bonds, SID No. 518, $16,000.00 - 20 December 1972: The Bureau of Outdoor Recreation and the State Fish and Game Commission having approved the application for funds for the development of a neighborhood park, the plans and specifications for the installation of playground equipment, bicycle and pedestrian pathways, irrigation systems and landscapping prepared by Thomas, Dean & Hoskins, Inc., was placed before the Commission. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the Clerk of the Commission be authorized and directed to advertise for bids for the Sale of Bonds of SID No. 518 in the amount I I I of $16,000.00 to be received and opened on Wednesday. 20 December 1972. The motion was carried by by the following Aye and No vote; those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Final Plat: Bridger View Mobile Home Court No.3: The final plat of the Bridger View Mobile Home Court No. 3 being developed by Montana Industrial Development Corporation was presented along with the favorable recommendation of the City-County Plann- ing Board. Following a discussion, the Commission concurred in the recommendation of the City Manager and it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the approval of the plat be tabled pending clerification of some ques tions. The motion was carried by the following Aye and No. vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. License Bond - Intermountain Electric, Manhattan - $5,000.00: In compliance with Chapter 15 of the Bozeman Municipal Code, the certificate of Intermountain Electric, Inc., of Manhattan in the amount of $5,000.00 was presented. The City Manager reported that the Building Inspector had recommended approval of the bond and the Acting City Attorney had approved the bond as to form. It was moved by Commissioner Lehrkind, seconded by Commissioner Van- deventer, that the bond of Intermountain Electric be approved and accepted and the motion was carr- ied by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, and Mayor Grabow; those voting No, none. Softball Complex - Request for B.O.R. Matching Funds, $9,144.27: The City Manager reported that the Softball Complex Project has expended $19,455.90 to date and recommended that the Commission grant him permission to submit a request to the Bureau of Outdoor Recreation for payment of matching funds in the amount of $9,144.27. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the City Manager begranted permission to submit a request to the bureau of Outdoor Recreation for payment of the matching funds in the amount of $9,144.27. The motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Reports: The following reports were presented: Librarian Police Judge Water Collector Director of Finance The City Manager commented on the reports and recommended approval thereof. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Vollmer, Commissioner Sedivy, Commissioner Vandeventer, Commissioner Lebrkind; those voting No, none. Call for Bids - Cast Iron Pipe and Sundry Fittings: The City has need for Cast Iron Pipe, Gate Valves, together with sundry fittings for install- ation at the Bozeman Softball Complex and for use by the water department and the City Manager re- quested that the purchase of Cast Iron Pipe and Sundry Fittings be authorized. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the purchase as requested be authorized and the Clerk of the Commission be directed to issue a "Call for Bids" for the purchase of Cast Iron Pipe, Gate Valves and Sundry Fittings to be opened 6 December 1972 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Adjournment: There being'no further business to come before the Commission at this time, it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting .
