HomeMy WebLinkAbout1972-08-30 Bozeman, M.ontana 30 August 1972 316 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 30 August 1972,at 1:15 o'clock p.m. Present wer Commissioner Sedivy, Commissioner Lehr- kind, Commissioner Vandeventer, Commissioner Vollmer, Acting City Manager Keyes, Acting City Attorney O'Connell and the Clerk. Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had: Minutes of the regular session held Wednesday, 23 August 1972, were approved as read. I Absence of Mayor:. Grabow and CHy l-lanager Fryslie: In concurrence with the recommendation of the Acting City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the absence of Mayor Grabow and City Manager Fryslie be authorized in compliance with Section 11-3245, R.C.M., 1947, and that Commissioner Sedivy be designated to act as President Pro Tempore of the Commission and that Ass't. City Manager Keyes be designated as Acting City Manager during their absence and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commiss- ioner Vollmer and Commissioner Sedivy, those voting No, none. Hearing, Commission Resolution No. 1528 - Intent to Create SID 514, Lots 1,2,3 Remington Addn. Commission Resolution No. 1'-)36 - Creating SID 514, $15,000.00: This was the time and place set in Commission Resolution No. 1528 to hear protests to the crea- tion of Special Improvement District No. 514. Affidavit of publication of Notice and the Clerks mailing certificate stating that all property owners had been notified as required by law were presented. The Acting City Manager informed the Commission that of 5:00 o'clock p.m., 28 August 1972, there were no protests on file and no one appeared to verbally protest the creation of the District. Comm- ission Resolution No. 1536 creating the District, entitled: COMMISSION RESOLUTION NO. 1536 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 514 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF A SANITARY SEWER LAT- ERAL MAIN AND APPURTENANCES TO SERVE SAID ADDITION, MORE SPECIFICALLY AS FOLLOWS, AN EIGHT INCH SANITARY SEWER MAIN TO BE LAID WITHIN AN EASEMENT TO I BE GRANTED THROUGH REMINGTON ADDITION FOR SUCH PURPOSES THE CONSTRUCTION AND INSTALLATION OF SUCH IMPROVEMENT TO INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIALS, SANITARY SEWER PIPE, NECESSARY WYES AND MANHOLES AND OTHER NECESSARY APPURTENANCES. as prepared by the Acting City Attorney was presented. In concurrence with the recommendation of the Acting City Manager, it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the resolution be passed and adopted to create Special Improvement District No. 514 and the motion waS carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Commissioner Lehrkind; those voting No, none. Final Acceptance SID No. 504 - Long Construction Company: The certificate of the engineer of Thomas, Dean & Hoskins, Inc., on Special Improvement District No. 504 stating the construction has been completed in accordance with the plans and specifications was presented. The Acting City Manager concurred with the engineers in the recommendation, that the project b~ accepted and approved by the City Commission and final payment made. This final acceptance and payment does not relieve the contractor of the responsibility for negligence or fau1y materials or workmanship within the extent and period provided by law. The contractor has furnished a perform- ance bond equal to the total contract bid to guarantee materials and workmanshp for a one year period commencing upon final acceptance. It was moved by Commissioner Vollmer, seconded by Commissioner Lehrkind, that as recommended the project be accepted as completed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Lehrkind, Comm~ issioner Vandeventer and Mayor Sedivy; those voting No, none. Authority to Call for Bids for Front End Loader, Tractor & Post Hole Digger, Street Dcpt. - Opening I 20 SE:l'~: The Street department has need for a new tractor, loader and post hole digger and the Acting City Manager requested authority to call for bids for the purchase of the tractor, front end loader and post hole digger. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer. that the purchase of the tractor, front end loader and post hole digger be authorized and the Clerk of the Commission be directed to issue a "Call for Bids" for the purchase to be received and opened 20 September 1972 and the motion was carried by the following Aye and No vote: thae voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Sedivy; those voting no, none. I I I Request to Attend Arson School - 7-9 September 1972, Billings, Wruck & Johnson: The third annual Fire and Arson Seminar is scheduled to be held in Billings, 7-9 September 1972, and the Fire Chief requested authority to send Captain Wruck and Fire Fighter Johnson to the seminar and, it being in the public interest their expenses be paid from the General fund. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the above request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Lehrkind and Commissioner Sedivy; those voting No, none. Request to Conduct Hawk Booster Drive: A letter received from the Bozeman Hawk Boosters requesting permission to conduct a financial drive for assistance to athletic endeavors of the Bozeman Senior High School boys and girls 31 August to 8 September 1972 was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Lehrkind, that permission to conduct the financial drive be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Lehrkind, Commissioner Vandeventer and Commissioner Sedivy; those voting No, none. Proclamation "Constitution Week" 17-23 September 1972: A proclamation proclaiming 17-23 September as "Constitution Week" as requested by the Montana Society of the National Society of the Sons of the American Revolution was presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that they endorse Mayor Grabow's proclamation as presented and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Commissioner Sedivy; those voting No, none. Reports: The following reports were presented: Director of Finance Librarian The Acting City Manager commented on the reports and recommended approval thereof. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Lehrkind and Commissioner Sedivy; those voting No, none. f!ogress Report on Comprehensive Master Plan - Rick Mayfield: City County Planning Director Rick Mayfield appeared before the Commission to present a pre- liminary Progress Report on the Comprehensive Master Plan of the Bozeman Area as prepared by the Bozeman City-County Planning Staff. The Commission thanked Mr. Mayfield for presenting such an extensive report. Ad journmen t: There being no further business to come before the Commission at this time, it was moved by Commissioner Vollmer, seconded by Commissioner Lehrkind, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Lehrkind, Commissioner Vandeventer and Commissioner Sedivy; those voting none.
