Comm- issioner Vandeventer, Commissioner Vollmer, City Manager Frys1ie. Ass't. City Manager Keyes, Acting ActtngCity Attorney 0' Connell and the Clerk. Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held 26 July 1972 were approved as read. ~y tl2..orize. Abs-!.nce of Commissirmer Lehrkind, 2 August 1972: In concurrence with the recommendation of the City Manager, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the absence of Commissioner Lehrkind be authorized in compliance with Section 11-3245. R.C.M., 1947. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Vandeventer and Mayor Grabow; those voting No, none. R~!.~_~~ to Conduct BIke RaIley on Cit~ Streets 20 August 1972 - Bozeman" .Jaycees: r A letter received from Pete Ridgeway, Bike Rally Co-Chairman. requesting permission to conduct a bike rally on Sunday, 20 August 1972, the race to begin on West Main Street in front of the Safeway Store and conclude on North Seventh Avenue at KBMN Radio ~tation was presented. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy. seconded by Commissioner Vandeventer, that the Jaycees be granted permission to conduct the bike rally and that they adapt to the traffic control. The motion was carried by the following Aye and No vote: those voting Aye being COmmissioner Sedivy, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Request for Curb Opening Variance - Harmony House: A letter received from Howard H. Nelson, 923 North Seventh Avenue requesting a curb opening var- iance from the forty feet to sixty-five feet for the new MOntgomery Ward store located at 923 North Seventh Avenue was presented. Following a discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that a variance of an additional rwenty-five feet be granted to the new Montgomery Ward store being constructed at 923 North Seventh Avenue and that in the future the Commission should refrain from grant- ing these variances. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer. Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Request for Sign Code Variance. Standard Oil Company: A letter received from T. Garry Earl, Marketing Representative for Standard Oil Company requesting a variance to the existing sign ordinance that would allow them to raise their sign to a height of 60' was presented. The City Manager stated that according to Chapter 14.16.475 (a) of the Bozeman Muni- cipal Code, no sign shall be erected to a height exceeding forty-feet above the ground. Following a discussion, the Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, , that the request for a var- iance to the existing sign ordinance to allow them to raise their sign to a height of 60' be denied and the motion was carried by the following Aye and No vote, those voting Aye being Commissioner Voll- mer, Commissioner Sedivy, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Request for Variance to Sidewalk Order, Mrs. J. Maurice Jones: A letter received from Mrs. J. Maurice Jones in behalf of Mrs. Barbara Judd Hauseman, requesting that the work on the sidewalk around the property at 420 South Willson be delayed for a period of one year was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Vandeventer, that they approve Mrs. Jones request to grant a variance on the construction of the sidewalks around the property located at 420 South Willson Avenue for a period of one year and the motion was carried by the following Aye and No vote: those voting Aye being COmmissioner Sedivy, Commissioner Vandeventer Commissioner Vollmer and Mayor Grabow; those voting No, none. Proposal to Extend Hours at Swimming Pool: A request from the Gallatin Council on Health and Drugs with a proposal to extend the swimming hours at the Bozeman Public Pool was presented. The funds for this proposal would be made available through the Gallatin Council on Health and Drugs and deposited with the City of Bozeman. The person- nel to be hi~red as City Employees on the same basis as other City personnel and under the direction of the City Recreation Department. Following a discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the City Commission approve the proposal on a trial basis during the month of August. 302 1972, at no cost to the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Authority to Install Exhaust System - Fire Station $3,192.00; A letter received from Fire Chief Jack Huber whereby he found that the present fans would not keep the carbon monoxide fumes from going upstairs and several members having complained of headaches from the fumes, he requested authority to install the exhaust system at an estimated cost of $3,192.00 from Willson Company as an item of the 1972-l973 budget. Following a thorough discussion, it was moved by COmmissioner Vollmer, seconded by Commissioner Sedivy, that the bid of the Willson Company, it being the lowest bi , they be awarded the contract to install the exhaust at an estimated cost of $3,l92.00 contingent upon the final approval of the budget for the fiscal year 1972-l973. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Westlake Third Addition: Approval & Annexation: The final plat of a tract of land consisting of approximately 7.8l acres in the NE l/4 Sec. l, T2S, R5E, M.P.M., Westlakes Third Addition together with a letter from Rick Mayfield, Planning Director of the Bozeman City-County Planning Board was presented along with a favorable recommendation of the City County Planning Board. The City-County Planning Board further recommended that this be the last small plat in this area and that any future platting will have to adhere full subdivision regulations and park dedication. In concurrence with the recommendation of the City County Planning Board, the City Manager recommended that the plat be approved as presented and that the records show that this be the last short plat that will be favorable considered until Mr. Westlake complys with the Planning Boards request. It was moved by Commissioner Sedivy, seconded by Commissioner Vandeventer, that the above plat be approved as presented and that the City Commission do approve the plat hereto annexed and that the City Manager be directed to sign the Plat as Director of Public Service and the motion was carried by the following Aye and No vote: those voting Aye being COmmissioner Sedivy, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Grabow; those voting No, none. License Bond - PalaKi Plumbing & Heating - $5,000.00: In compliance with Chapter l6, of the Bozeman Municipal Code, the plumbing bond of palagi Plumbing and Heating, Great Falls, MOntana, in the amount of $5,000.00 was presented. The City Manager stated the Building Inspector had recommended approval of the bond and the Acting City Attorney had approved the bond as to form. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the bond be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, & Mayor Grabow; those voting No, none. Request for Effluent Discharge to Waste Water Riverside Country Club: The request from Clarence Jensen, Chairman of the Riverside Country Club Board of Directors, for permission to use the facilities of the Sewage Treatment Plant of the City of Bozeman to discharge treated sewage effluent into the outfall of the Bozeman Waste Water Treatment Plant receiving chlori- nation at the contact unit of the City's facility was presented. Following a thorough study of the above matter, the Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the request be denied at this time on the basis of the following consideration. The Motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Vandeventer and Mayor Grabow; those voting No, none. l) Orderly growth and development of the City of Bozeman, it is felt that providing sewage treatement services for property of the Riverside Country Club would vio- late planning principles because the property is located in excess of two and one-half (2 l/2) miles outside the present corporate limits of Bozeman. I 2) The Department of Health and environmental sciences indicated that the City of Bozeman should make plans for treatment of all raw sewage generated from the Riverside Country Club when developing expansion of the Waste Water Treatment Plant. If this official recommendation is accepted it will result in a major change to the engineering planning for future expansion of the Bozeman Waste Water Treatment Plant. This is true because it will also be necessary then for the City to plan sufficient capacity so that all properties who are located so that they may be served by the Sewage Treatment Plant of the City Also be given authorization to connect to the City's Sanitary Sewer System. If an expansion program of this magnitude is to be undertaken, then it is very probably we will need to propose a metropolitan sewer district so that the costs involved can be equitably distri- buted among those property owners who are to be benefited. I I I I I 3) As of this time our Engineers inform us that the present treatment capacity of the Bozeman Waste Water Treatment Plant is fully commttted to properties that are currently within the corporate limits of Bozeman or in the process fu of being annexed. Reports: The following reports were presented: Librarian Fire Chief Building Inspector Fluoridation The City Manager commented on the claims and recommended approval thereof. It was moved by Commissioner Sedivy, seconded by COmmissioner Vandeventer, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vandeventer, Co mmissioner Vollmer and Mayor Grabow; those voting No, none. Police Protective Association - 2-4 August 1972, McKays Intermountain Carnival: A letter received from Dar Hanson, President of Bozeman Police Protective Association, requesting permission and authorization to obtain a City License to hold the McKays Intermountain Carnival in Bozeman, 2-4 August 1972, was presented. It was moved by Commissioner Sedivy, seconded by Commissioner fee con~ideration as a charitable project and Vandeventer that the above request be approved with a $50.00 license/the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner Vollmer, and Mayor Grabow; those voting No, none.
