ADD APPROPRIATIONS FOR FEDERAL EMERGENCY MANAGEMENT
AGENCY (FEMA) FLOODPLAIN MAP APPEAL PROJECT IN FISCAL YEAR

RECOMMENDATION: Approve Resolution No. 4756 - AMENDING THE CITY’S ANNUAL BUDGET AND DOWNTOWN TAX INCREMENT DISTRICT
WORKPLAN TO ADD APPROPRIATIONS FOR FEDERAL EMERGENCY
MANAGEMENT AGENCY (FEMA) FLOODPLAIN MAP APPEAL PROJECT IN
FISCAL YEAR ENDING JUNE 30, 2017. BACKGROUND: The City wants to appeal FEMA’s new floodplain maps, to
facilitate continued development and ensure an accurate record of existing conditions.
The Downtown Tax Increment District will pay approximately 48% of the total
estimated project costs.
Source Amount
Downtown Tax Increment District $42,000
City Engineering – FY17 budget $25,000
Downtown Business Improvement District $20,000
Total $87,000
The Downtown Tax Increment District’s work-plan and budget must be amended to include their share of the project. The Engineering budget and the Downtown Business Improvement District
have sufficient appropriations to pay their share in the current fiscal year.

Note: At the time this budget amendment was advertised, it was thought that approximately
$65,000 would come from the Downtown Tax Increment District. However, since that time, the
Downtown Business Improvement District has offered to cover $20,000 of the project costs with
their cash on hand. UNRESOLVED ISSUES: This resolution makes the necessary budget amendment. A
following agenda item will approve the contract for services.
ALTERNATIVES: As suggested by the City Commission.
FISCAL EFFECTS: The Downtown Tax Increment District appropriations will increase
by $42,000 for Fiscal Year 2017. Cash-on-hand will be used to support the spending increase.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, AMENDING THE CITY’S ANNUAL BUDGET AND
DOWNTOWN TAX INCREMENT DISTRICT WORKPLAN TO ADD APPROPRIATIONS FOR FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA) FLOODPLAIN MAP APPEAL PROJECT IN FISCAL YEAR ENDING JUNE 30, 2017.
WHEREAS, the City Commission did, on the 20th day of June, 2016, after due and proper legal
notice, conduct a public hearing and adopt a municipal budget for Fiscal Year 2016-2017 (Fiscal Year
2017); and
WHEREAS, the need to add the project “Federal Emergency Management Agency (FEMA)
Floodplain Map Appeal” to the approved Fiscal Year 2017 work-plan for the Downtown Tax Increment
District funding now exists; and
WHEREAS, the need to add the project “Federal Emergency Management Agency (FEMA)
Floodplain Map Appeal” to the approved Fiscal Year 2017 budget in the amount of $42,000 for the
Downtown Tax Increment District fund now exists; and
WHEREAS, the City Commission did, on the 28th day of November, 2016, after due and proper
legal notice, conduct a public hearing on proposed amending the Downtown Tax Increment District work-
plan and municipal budget.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, to wit:
Section 1 – Appropriation Changes
The City Commission of the City of Bozeman, Montana, does hereby authorize the following changes to expenditures in the Downtown Tax Increment Finance Fund:

Additions: The project and amount is added to the FY17 work-plan and budget.
Floodplain Map Appeal – Study and Mapping $42,000 Total Appropriations Changes: $42,000
Section 2 – Use of Cash on Hand in the Downtown Tax Increment District Fund
The increased appropriation will be funded with cash on hand in the Downtown Tax
Increment District Fund.
Section 3 Pursuant to Section 7-6-4030, M.C.A., this resolution, upon its passage, shall be in full force
and effect on July 1, 2016.
Section 4 That should it be found by any court of competent jurisdiction that any section, clause, portion, sentence, word, or phrase of this resolution is deemed to be contrary to any existing law or regulations,
that in this instance, it is the intent of the City Commission of the City of Bozeman, Montana, that all
other portions, sections, words, clauses, phrases, or paragraphs of this document shall remain in full force
and effect.
PASSED AND APPROVED by the City Commission of the City of Bozeman, Montana, at a
regular session thereof held on the 28th day of November, 2016.

RE: BID Funding for Formal Appeal of FEMA’s Proposed Bozeman Creek Floodplain Map
City of Bozeman:
I am writing on behalf of the Downtown Business Improvement District (BID) Board to inform
you they have allocated Twenty Thousand dollars ($20,000.00) for the formal appeal of the
proposed Bozeman Creek FEMA floodplain map.
The BID Board agreed to make a $10,000 payment upon the execution of the consultant’s
contract and the second $10,000 payment upon the completion of the consultant’s contract.
The BID Board recognizes that the regulations stipulated by the proposed FEMA floodplain map would significantly impact a portion of downtown including the eastern section of the Main Street
Historic District. Not only does the expanded floodplain impact current downtown property
owners, but also has serious implications for future development and therefore the very vitality
of the downtown district.
I will coordinate with the Public Works and Finance Departments to make the pledged
contributions.

have allocated Forty-One Thousand Six-Hundred and Seventy-Four dollars ($41,674.00) for the
formal appeal of the proposed Bozeman Creek FEMA floodplain map.
The TIF Board recognizes that the regulations stipulated by the proposed FEMA floodplain map
would significantly impact a portion of downtown including the eastern section of the Main Street
Historic District. Not only does the expanded floodplain impact current downtown property
owners, but also has serious implications for future development and therefore the very vitality of the downtown district.
I will coordinate with the Public Works and Finance Departments to make the necessary budget
amendment and fiscal transfer at a time mutually agreed upon by all parties.
