HomeMy WebLinkAbout1972-06-28 I I I Bozeman, Montana 28 June 1972 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 28 June 1972, at l:l5 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Commiss- ioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Acting City Manager Keyes, Acting City Attorney O'Connell and the Clerk. Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held 2l June 1972 were approved as read. Ex~c:.~1J::io~l._of_(~qntrac~ Documents - l~a1ks & Curbs, H. D. Hm'lells: The performance bond and contract documents for the contract of W. D. Howells awarded 21 June 1972 for the construction of miscellaneous walks and curbs within the City of Bozeman for the year 1972 was presented. The bond and contract were approved as to form by the Acting City Attorney and the Acting City Manager reported that the City had evidence the contractor is adequately insured and recommended the documents be approved. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the contract be so approved as presented and the Mayor and the Clerk be authorized and directed to sign the contract for the City and W. D. Howells be authorized to proceed with the construction of the miscellaneous sidewalks and curbs and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commiss~ ioner Lehrkind and Mayor Grabow; those voting No, none. Following a discussion, it ~.,as moved by Commissioner Vollmer. seconded by Commissioner Lehrkind, that the Acting City Manager be directed to check out all of the facts and figures concerning the carni~ val and contact the City Commissioners for their concurrence or for a vote either way. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Cclander: An Easement and Right~of-Way Agreement from Montana Industrial Development Corporation and an Easement and Right-of-Way Agreement from C. H. Crabb and Irene J. Crabb and Harley Celander and Jose- phine L. Celander for the purpose of installing, operating, using, repairing, replacing, maintaining and removing said sewer lines and appurtenances thereto upon and across their property lying within the City of Bozeman, County of Gallatin, State of Montana, was presented. The Acting City Manager recommended that the City enter into the Agreements approved as to form by the Acting City Attorney and it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the Easement Agreements be entered into by the City and the Mayor and Clerk of the Commission be 11' authorized and directed to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Re~~~s.l..~ion tor lUJD FU1:!.ds - $75,000.00 SID No. 502: West Side: Pr'?JE.~~__~.!~_~X:.J::1T::-..Q_8-00-00l7_;_ The Requisition No.2 and Voucher for Grant Payment, Project No. WSF-MT-08-00-00l7, Contract No. DEN-079 enabling the City of Bozeman to draw $75,000 allocated to them for the construction pay estimates on Special Improvement District No. 502, \\Test Side Water Main Project was presented. Following a discussion, the Acting City Manager recommended that the City Commission approve the Requisition No.2 and Voucher for Grant Payment and it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that they approve the above requisition and that the Mayor be authorized to execute the Requisition for $75,000 in behalf of the City and that the forms be returned to the Depart- ment of Housing and Urban Development for processing and the motion \.,as carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. ~pJ~.i:s:_~_~ig_~,-__~_~~-.!-!!D:>__G.E.?~~_--=--_Y ate r & S ewe r Pro j e c t, $ 3 7 ~O 0 0 ~ E.~_!____ The Acting City Manager presented an application to be submitted to the HousinB and Urban Develop- ment Administration requesting Federal Assistance for public works and facility-type projects in the amount of $370,000.00. The project is for trunk sanitary sewersm serve existing and new growth areas and to intercept future flmvs in to the exis ting sys tern, and also includes feeder \.,otcrmains to serve new and existing growth areas and to increase available flows within the existing distribution system. Elks Club No. 463, 106 East Babcock Street requesting abatement of an order to reconstruct side\-lalks in this area was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Vandeventer, that the request to delay the sidewalk replacement on Babcock between South Black and South Bozeman Avenue be granted for a period of one (1) year due to the current building plans that the B.P.O.E. Elks Club No. 463 have for a new building on the site. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. b) A letter received from Mr. David A. Osterman, Box 7l3, Bozeman, requesting abatement of an order to construct sidewalks on the property on Lots 2 and 3 of Block 3, Kirk's Second Subdivision for a period of one year was presented. It \-las moved by Commissioner Lehrkind. seconded by Commissioner Vandeventer, that the order to install side\-lalks at the Osterman property be revoked for this year and the motion was carried by the follo\-ling Aye and No vote: those voting Aye being Commissioner Lehrkind, Commiss- ioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. c) A letter received from J. Paul Peterson, 19 East Garfield Street, requesting permission to place a new sidewalk next to the curb on the east side of Tracy and extending over to South Black Avenue on Garfield Street was presented. Follot-ling a discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that they table Mr. Peterson's request for a period of one week in order that they might make an on the ground inspection of the area. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer. Upon recommendation of the Fire Chief, concurred in by the /\cting City Hanager, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that Ass't. Fire Chief Hoey and Fire Fighter Johnson be authorized to attend the conference and the expenses incurred by such attend- ance be paid out of the General fund and the motion was carried by the following Aye and No vote~ those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vand- eventer and Mayor Grabow; those voting No~ none. ~e~af'ts : The Acting City Manager presented the following reports.
