HomeMy WebLinkAbout1972-06-14 I I I Bozeman, Montana Ih .Tune 1972 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 14 June 1972, at l:lS o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Commiss- ioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't. City Manager Keyes, Acting City Attorney O'Connell and the Clerk. Commissioner Sedivy opened the meeting with a prayer and the following proceed ings were had: Minutes of the regular meeting held 7 June 1972 were approved as read. Q.pen Bids Gasoline, No. 2J.Diesel and No. 1 Diesel Supply to 30 Jun..e 1973..-:.. This was the time and place set for opening bids from Gasoline, No.2 Diesel and No. 1 Diesel ,;.<> suppliers, furnish the City of Bozeman approximately 65,000 gallons Regular Gasoline, 15,000 Gallons No.2 Diesel Fuel and l,OOO gallons No. 1. Diesel to 30 June 1973. The affidavit of publication of the "Call for Bids'J was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Lehr- kind, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Comm- issioner Vollmer and Mayor Grabow; those voting No, none. City Manager and the City Engineer for checking and recommendation to be made to the Commission on Wednesday, 2l June 1972 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commiss- ioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Continued Hearing, Resolution No. l5l3, Intent to Create SID No. 509, Hater & Sewer: The City Manager presented to the Commission a draft of a written Agreement between the property owners of Lots 3 thru 10, Block 2, University Subdivision which was requested by the Commission during their hearing on Commission Resolution No. l5l3 at the meeting last week. 1) No structures will be erected on Lots 3 through lO inclusive of Block 2, University Subdivision, without the expressed written approval of the City of Bozeman over and above any requirements imposed by Zoning or Build ing Codes. 2) At such time as a majority of the owners of Lots 3 through lO, Block 2, Universi ty Subd ivision, wish to utilize said lots for building purposes, thus requiring water, sanitary sewer, storm drainage or paving improve- ments in the abutting portion of Tracy Avenue, 100% of the cost of such improvement will be borne by Lots 3 through lO of Block 2, University Addition. 3) The Petitioners in this matter agree that screening will be placed along the west line of Lots 3 through lO, Block 2, University Subdivision, by the City of Bozeman and the cost of said screening will be borne by the owners of said lots. The Screening will be of a hedge type or as an alternate a rustic fence. 4) The petitioners will save the City free and harmless from any claims of damage that may result from this agreement and related actions. 5) Necessary agreement covenant and/or contract documents will be prepared at the expense of the petitioners in this matter. The hearing on Commission Resolution No. l5l3 which was delayed last week was again continued with several of the above mentioned owners and potential owners present to reaffirm their request 275 276 to be removed from this district. Following a discussion, the City Manager stated that he recommended against altering the distrit boundaries as a matter of policy, but further stated that if the Commission chose to do so they should do so on an isolated basis and should not allow this to set a precedent. It was moved by Commiss- ioner Vandeventer, seconded by Commissioner Vollmer, that Special Improvement District No. 509 not be created and the City Engineer be instructed to furnish the Acting City Attorney with revised boundaries of this district reflecting the removal of the improvements and assessments from these above mentioned properties and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. No "__)514, Intent __to CI'e~te SID N~lJi).L P<.lYi-~p'rai~-,:~_~: This was the time and place set in Commission Resolution No. ISl4 to hear protests to the creation of Special Improvement District No. slO. Affidavit of publication of Notice and the Clerks Mailing certificate stating that all property owners had been notified as required by law were presented. There were no written protests on file. Several property owners were present to discuss the Special Improvement District. Following a discussion and considering the action taken on Special Improvement District No. 509, the City Manager recommended that Special Improvement District No. 510 for the paving and drainage of Thompson's Fourth Addition, University Subdivision and University Subdivision No.2 not be created. The Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that Special Improvement District No. 510 not be created and that the City Engineer be instructed to furnish the Acting City Attorney with revised boundaries eliminating the improvements on South Tracy Avenue fronting Lots 2 through ll. Block 2, University Subdivision No.2 and Lot 2 of Block I of Thompson's Fourth Addition and that the above lots be re- moved from the assessment in the ne~\I district. In concurrence with the engineers, the City Manager recommended that the plans and specifications as presented be approved and that a "Call for Bids" for the project be authorized. Commissioner Vandeventer and Commissioner Vollmer and Mayor Grabow; those voting No, none. City Manager Keyes be designated to perform the duties of the City Manager during this period. It was moved by Commiss- ioner Vandevent(!r, seconded by Commissioner Vollmer, that the above request be granted and that Ass't. City Manager Keyes be designated as Acting City Manager during this period and the motion was carrie by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Exchange---2-~ Land on Switzler Street for Curtiss Street: It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the City Manager be authorized and directed to obtain Lot 6 of Block C Marwyn Rearrangement of Block 13, 1~-, IS, l8, 19 and 20 of the Northern Pacific Addition in exchange for a portion of vacated Curtiss Street and a portion of the Old Elks Club property.
