The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 21 June 1972, at l:l5 o'clock p.m. Present were Mayor Grabow, Commissioner Lehrkind, Comm-
issioner Vandeventer, Commissioner Vollmer, Acting City Manager Keyes, Acting City Attorney O'Connell
and the Clerk.
Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held l4 June 1972 were approved as read.
Bid Openj~_:_1972 Walks and Curbs Construction Program:
This was the time and place set for receiving bids for the repairing and reconstruction of
miscellaneous sidewalks and curbs. Affidavit of publication of "Notice to Bidders" was presented
and it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the bid of w.
D. Howells, Bozeman, be opened and read and the motion was carriedby the following voting Aye:
Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting
No, none.

The Commission concurred with the recommendation of the Acting City Manager and it was moved
by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the bid of W. D. Howells, Bozeman
be referred to the City Engineer for study and final recommendation and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer,
Commissioner Lehrkind and Mayor Grabow; those voting No, none.
Award of Fuel Purchases for Fiscal Year 1973:

The Commission was referred to the opening of bids from Gasoline, No. 2 Diesel and No. 1 Diesel
suppliers to furnish approximately 65,000 gallon gasoline, approximately l5,OOO gallon No. 2 Diesel
and approximately l.OOO gallon No.1 Diesel Fuel to 30 June 1973. The bids having been anay1zed by
the Acting City Manager and the City Engineer, they recommended that the purchase of approximately
65,000 gallons regular gasoline in the amount of $0.2037 be awarded to Continental Oil Company, it
being the lowest and best bid and equaling specifications as contained in the "Call for Bids," and
that the purchase of approximately 15,000 gallon No.2 diesel fuel in the amount of $0.1205 and 1,000
gallon No.1 diesel fuel in the amount of $0.1255 per gallon be awarded to Chevron Oil Company on the
basis of their bid, it being the lowest and best bid and equaling specifications as conatined in the
"Call for Bids." The Commission concurred in the recommendation of the Acting City Manager and it
was moved by Commissioner Vollmer, seconded by Commissioner Lehrkind. that the purchase of the gas-
oline. No.2 diesel and No.1 diesel be awarded to the above suppliers and the motion was carried

The following applications for City Beer License, together with the required fees were presented.

The Acting City Manager and Cheif of Police stated they were not aware of any incidents that
would warrant disapproval of the applications. It was moved by Commissioner Lehrkind, seconded by
Commissioner Vandeventer, that the above applications be approved and the Director of Finace be dir-
ected to issue license in accordance therewith and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer,
and Mayor Grabow; those voting No, none.
Discussion of Bozeman Creek Hatershed Ross McPherson:

District Forester Ross McPherson appeared before the Commission to discuss the Cooperative
Agreement now in affect and to explain the existing conditions in connection with the watershed.
Following a discussion, the Acting City Manager concurred with the Commission and recommended that a
a new Agreement with similar terms of the old one be drawn up.

Auth~yization to Order Catapilar No. 977 (On Lease) for Landfill:
The landfill has a desperate need for a new piece of equipment and the Acting City Manager
has investigated various ways of getting this equipment. Following a thorough discussion, it was
moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that they lease Model 977 Cater-
pillar Front End Loader from Tractor and Equipment Company, Billings, Montana, on a three year basis
at $1,513.00 per month. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Lehrkind and Mayor Grabow; those
voting No, none.
j\tvard Contract for 1971 Halks & Curbs Construction Program - W. D. Hotvells:
The City Engineer having completed his study of the bids for construction of Walks & Curbs for
1972, recommended that W. D. Howells be awarded the bids for the sidewalk construction on the basis

of his bid as set forth above. The Acting City Manager concurred in the recommendation of the City
Engineer and it was moved by Commissioner Vollmer, seconded by Commissioner Lehrkind, that the bids
be awarded to W. D. Howells on the basis of his bid and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Vollmer, Commissioner Lehrkin~ Commissioner Vande-

A letter received from Gary C. Richards, President of Bozeman Softball Association. requesting I
permission to control the traffic on the streets bordering the North Grand Ball Parks on 22 June 1972
from 6:30 P.M. until approximately 9:30 P.M. and again on 7 July 1972 in the evening and 8-9 July
during the day and evening while ball games are scheduled was presented. It was moved by Commission-
er Lehrkind, seconded by Commissioner Vandeventer, that they control the traffic on the streets bor-
dering the North Grand B<!ll Parks on the above dates as requested and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer,
Commissioner Vollmer and Mayor Grabow; those voting No, none.

Hayor Grabow announced his proclamation designating the Fourth of July 1972, as the day for
"Ringing of Bells" and urged all citizens of the Ci ty of Bozeman to participate in the ringing of
bells to let the ~\1orld know that patriotism lives within the heart of every citizen of this city.
It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that they concur in the
Mayor's proclamation and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Lehrkind and Mayor Grabow; those
voting No, none.

In compliance wi th Chapter l6 of the Bozeman Municipal Code, the Certificate of Joe Bolin,
Willow Creek, in the amount of $5,000.00 was presented. The Acting City Manager reported the Building
Inspector had approved the certificate and the Acting City Attorney had approved the bond as to form.
It was moved by Commissioner Vollmer, seconded by Commissioner Lehrkind, that the license bond be
approved and the motion was carried by the following Aye and No vote: those voting Aye being Commiss-
ioner Vollmer, Con1miss ioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none.
