The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building. l7 May 1972, at l:l5 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Commi-
ssioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Acting City Manager Keyes, Acting
City Attorney O'Connell and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held lO May 1972 were approved as read.
Discussion on Annexation of Tange's Addition:
Mr. Carl Tange, Jr., along with Mr. Don Nell and Mr. H. B. Landoe again a~ared before the
Commission in regard to annexing a tract of land of approximately thirty acres lying northerly and
westerly of the present city limits and known as the Tange Addition and to become aportion of the
City of Bozeman.
A letter received from Mr. Tange whereby he agreed to negotiate a settlement on Oak Street
through his property on North Seventh Avenue per the alignment shown in the plat "Tange's Addition"
where Oak Street goes straight through to Seventh Avenue, subject to the following conditions was read:
l. All reference to alternate routing to be deletea from the plat and agreement
and Oak Street must go straight through along the City limits.
2. Any and all excess property given to the City of Bozeman for Oak Street will
revert back to Tange if Oak is not completed within 10 years from the date
of the agreement.
3. A rectangular piece of property north of the Humble Station with dimensions
approximately 40 feet on North Seventh and 150 feet deep will be deeded to
the City of Bozeman for purposes of trading for sufficient footage from
Humble to allow Oak St. to go straight through. This deeding of property
will be subject to the reversion clause (2) above.
4. All requirements for giving land for Park shall be dropped.
5. The City of Bozeman will not require any further streets in this Tange Addi-
tion without Tange's approval for same for future development on this
property.
In effect, we are agreeing to exchange our Park requirement of about 3~ acres
valued at a few thousand dollars for 40 feet of frontage on North Seventh valued
at a minimum of $30,000.00. We feel this trade is placing an unfair burden on
the Tange Addition, rather than on Humble where it rightfully belongs, but we are
willing to make this concession to hopefully settle a very sticky and difficult
problem and to assist in consumating a well planned commercial development along
North Seventh at Baxter lane.
Following a thorough discussion, it was moved by Commissioner Sedivy, seconded by COmmissioner
Lehrkind, that we acknowledge receipt of the reworded proposal and that we try in every way to have
an answer for the best interest of all concerned by next Wednesday. The motion was carried by the
following Aye and No vote: Those voting Aye being Commissioner Sedivy, Commissioner Lehrkind,
Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none.
Terry Tierney - Regarding the Accountants Computations on Refinance Waste Water Treatment Plant:
Mr. Terry Tierney appeared before the Commission to discuss the final computations as prepared
by the Certified Public Accountants in regard to the proposed escrow fund transactions for 23 May
1972 to 1 July 1976 and the proposed debt payment schedules involving the refinancing of the
$l,325,OOO.00 Sewerage System Revenue Bonds dated as of 1 July 1969.
The Commission extended a vote of thanks to Mr. Tierney for making this presentation.

In concurrence with the recommendation of the Acting City Manager, it was moved by Commissioner
Lehrkind, seconded by Commissioner Vandeventer, that Commission Resolution No. l5l2 be passed and
adopted and that Wednesday, 7 June 1972, be the date set for public hearing and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Lehrkind. Commissioner Vande-
venter, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none.

Request for City License, Good Humor Truck (Dahl Wagon).
It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the License appli-
cation of the Good Humor Truck (formerly the Dahl Wagon)be approved and a license issued to the owner
of the unit as she had complied with all stipulations made pertaining to the application and the

motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer,

Request to Install Temporary Sign for College National Finals Rodeo, Lions Club:
A letter received from the Bozeman Gallatin Empire Lions Club requesting permission to place a
sign over Main Street on the Chamber of Commerce cables for the purpose of advertising the College
National Finals Rodeo was presented. The sign is to be erected on Monday, 12 June 1972, and removed
Monday, 26 June 1972. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that
the request be approved and the permit fee waived contingent upon meeting the requirements of the
Bozeman Sign Code with the understanding that the sign be removed immediately following the Rodeo
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those
voting No, none.
License Bonds: J. W. Tschache, Gas Fitter (Continuation)
Image National Inc., - Sign Erector:
In compliance with Chapter 15 of the Bozeman Municipal Code, the continuation of the gas fitter
bond of J. W. Tschache, Bozeman was presented. The Acting City Manager stated the Building Inspector
had recommended approval of the above mentioned bond and the Acting City Attorney had approved the
bond as to form. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the
aforementioned bond be approved and the motion was carried by the following Aye and No vote: those
voting aye being Commissioner Sedivy, Comissioner Lehrkind, Commissioner Vandeventer, Commissioner
Vollmer and Mayor Grabow; those voting No, none.
In complaince with Chapter 14 of the Bozeman Municipal Code, the Sign Erector Bond of Image
National Inc., Billings, was presented. The Acting City Manager stated the Building Inspector has
recommended approval of the above mentioned bond and the Acting City Attorney had approved the bond
as to form. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the
aforementioned bond be apPIOved and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commission-
er Sedivy and Mayor Grabow; those voting No, none.

There being no further business to come before the Commission at this time, it was moved by
Commissioner Vollmer, seconded by Commissioner Sedivy, that the meeting be adjourned and the motion
