The Commission of the City of Bozeman met in reqular session in the Commission Room, Municipal
Building, 19 April 1972, at l:l5 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, COmm-
issioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Acting City Manager Keyes, Acting
City Attorney Andriolo and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had:
Minutes of the meeting held l2 April 1972 were approved as read.
Award purchase of 1/2 Ton Truck - Owenhouse Hardware, $2,855.00:
After tabulation and checking the bids for the 1972 Model 1/2 Ton Pickup Truck with a six foot
fleet side pickup box for use by the Park Department, that were opened l2 April 1972, the Acting
City Manager concurring with the Park Superintendent and the City Engineer, recommended that the
purchase be awarded to Owenhouse Hardware Company, Bozeman, in the amount of $2,855.00, it being the
lowest bid received and equaling or exceeding the specifications as contained in the "Call for Bids."
It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the award be made to
Owenhouse Hardware Company in the amount of $2,855.00 and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner
Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none.
Request to Place Modular Home at 1004 L. Street:
It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the request from
Gary France, 1010 L. Street, Bozeman, for permission to install a modular home on their property at
l004 L. Street be removed from the table for further consideration. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Comm-
issioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none.
The City Attorney in his legal opinion suggested that the proper appeal proceedure would be
to form a Board of Appeals as provided by the Uniform Building Code to hear this type of appeal.
This board if formed would provide a body more qualified than the City Commission to rule on such
items. The Mayor stated that this would be the last time the City Commission would sit as the Board
of Appeals on such matters.
Following a further discussion, it was moved by Commissioner Lehrkind, seconded by COmmissioner
Vandeventer, that Gary France be allowed to install the modular home on their property at 1004 L.
Street and the motion was carried by the following Aye and No vote: those voting Aye being Commiss-
ioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; Commissioner Sedivy
abs tained.
Commissioner Sedivy stated his reason for abstaining was that he did not feel qualified to render
a judgement on a building technical quality construction matter.
Authorize "Call for Bids" for 85,000 lbs. Liquid Chlorine, Bid Opening 3 May 1972:
The Water department and the Waste Water Treatment Plant has need for approximately 85,000 lbs.
liquid chlorine and the Acting City Manager requested that the purchase of 85,000 lbs be authorized.
It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the purchase as requested
be authorized and the Clerk of the Commission be directed to issue a "Call for Bids" for the pur-
chase of 85,000 lbs. liquid chlorine to be opened 3 May 1972 and the motion was carried by the follow-
ing vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind,
Commissioner Vandeventer and Mayor Grabow; those voting No, none.
Authorize Purchase of 2,000 Ft. Copper Pipe - Approximately $2,500.00:
The Water department has need for 2,000 f~Copper Pipe and the Acting City Manager requested
authority to purchase the pipe at an approximate cost of $2,500.00. It was moved by Commissioner
Sedivy, seconded by Commissioner Lehrkind, that the Acting City Manager be authorized to purchase
the copper pipe and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, and
Mayor Grabow; those voting No, none.
Request to Vacate and Rededicate Alley, Security Bank & Trust Company:
A letter received from the Security Bank & Trust Company, Bozeman, requesting permission to
vacate the dedicated alley running north and south from its present location to a position approx-
imately seven feet east was presented. The new location of the alley will be in line with the lanes
of traffic from their permanent parking stalls. They do not propose to close the alley, but merely
rededicate it.
Following a thorough discussion, the Commission concurred with the recommendation of the Acting

City Manager and it was moved by Commissioner Lehrkind, seconded by Commissionel< Vandeventer, that
the request to vacate and rededicate the alley be approved with the provisions that the Security
Bank and Trust Company bear the cost of the curb cuts and the replacement and installation of the
sidewalk for the closing of the one alley and reopening the other alley and that the City Engineer
be instructed to furnish the Acting City Attorney with the necessary information to enable him to
draw up a resolution to accomplish the vacation of the above alley. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer,
Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow: those voting No, none.
Request to Change Zoning from C Residential to Motor Business - David Fraker:
A letter received from David M. Fraker with a request that the City Commission rezone the W~E~
SW~ SE~ of Section ll, Township 2 South, Range 5 East, M.P.M. with the exception of a tract of land
in the southwest corner of the W\ E\ SW~ SE~ of said Section ll, from Class C Residential to Motor
Business was presented. The Commission concurred with the recommendation of the Acting City Manager
and it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the request be
referred to the City-County Planning Board for investigation and recommendation. The motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commiss-
ioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none.
License Bonds: William Merrick, Sign Erector: George Miller, Plumber:
In compliance with Chapter 16 of the Bozeman Municipal Code, the continuation certificate of
the plumbing bond of George C. Miller, Bozeman, was presented. The Building Inspector had recommended
approval of the above mentioned bond and the Acting City Attorney had approved the bond as to form.
It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the plumbing bond be
approved and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor
Grabow; those voting No, none.
In compliance with Chapter l4 of the Bozeman Municipal Code, the sign erection bond of William
Merrick, Bozeman, was presented. The Building Inspector had recommended approval of the above men-
tioned bond and the Acting City Aftorney had approved the bond as to form. It was moved by Comm-
issioner Sedivy, seconded by COmmissioner Lehrkind, that the bond be approved and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner
Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none.
Request to Waive Fees at Landfill - Saturday, 22 April 1972, 4H Club Request:
It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the request
from the 4H Club to open the Landfill on Saturday, 22 April 1972, and to waive the fees for one
day be approved. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and
Mayor Grabow;those voting No, none.

The Acting City Manager commented on the reports and recommended approval thereof. It was
moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the reports be approved
and ordered filed. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and
Mayor Grabow; those voting No, none.
Resolution No. 1509, Intent to Vacate Portion of Alley in Brady's Rearrangement:

A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO VACATE A
PORTION OF THE ALLEY SITUATE IN BRADY'S REARRANGEMENT OF BABCOCK
AND DAVIS ADDITION TO BOZEMAN, MONTANA.
prepared by the Acting City Attorney as directed by the Commission to vacate alleys in Brady's
Rearrangement of the Babcock Davis Addition was presented. It was moved by Commissioner Vollmer,
seconded by Commissioner Sedivy, that Commission Resolution No. 1509 be passed and adopted and
24 May 1972 be set as the date for public hearing and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehr-
kind, Commissioner Vandeventer and Mayor Grabow; those voting No, none.

Ordinance No. 918, Amending Ordinance No. 917: Refinance Sewerage System:
The Acting City Manager introduced in written form a proposed ordinance entitled:
ORDINANCE NO. 918
AN ORDINANCE RELATING TO THE BOZEMAN MUNICIPAL SEWERAGE SYSTEM;
PROVIDING FOR THE ISSUANCE AND SALE OF $1,325,000 SEWERAGE SYSTEM
REFUNDING REVENUE BONDS, THE REFUNDING AND REDEMPTION OF ALL OUT~
STANDING REVENUE BONDS, AND COVENANTS SECURING THE PAYMENT OF
THESE AND FUTURE ISSUES; PLEDGING REVENUES OF THE SYSTEM TO SPEC-
IAL FUNDS AND ACCOUNTS FOR ITS OPERATION, MAINTENANCE, DEBT
SERVICE, REPAIR AND REPLACEMENT; AND RESCINDING ORDINANCES NOS.
887 AND 917.
The ordinance was then read and considered by the Commission. Commissioner Sedivy moved its
final passage and adoption, which motion was seconded by Commissioner Lehrkind, and upon roll call
vote being taken on the motion, the following voted in favor thereof: Commissioner Sedivy, COmm-
issioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; and the follow-
ing voted against the same: None, whereupon the ordinance was declared duly passed and adopted, as
ordered by the affirmative vote of not less than four fifths of the members of the Commission in
accordance with the provisions of Section 11~3250, R.C.M., 1947.
The ordinance was then signed by the Mayor and filed and recorded by the Clerk, and designated
as Ordinance No. 918; and the Clerk was directed to cause the number and title thereof to be pub-
lished in the official newspaper at least once within ten days from this date, in accordance with
Section ll-3254, R.C.M., 1947.
Adjournment:
There being no further business to come before the Commission at this time, it was moved by
Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the meeting be adjourned and the
motin was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind,
Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting
No, none.
