HomeMy WebLinkAbout1972-01-26 I I I 221 Bozeman, Montana 26 January 1972 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 26 January 1972, at 1:l5 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Acting City Manager Keyes, Acting City Attorney O'Connell and the Clerk. Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held 19 January 1972 were approved as read. Bond Sale SID No. 504 - $62,000.00 Construction of Pavement H. Aspen St. & Tamarack St. between N. 5th & 7th: This was the time and place set for the sale of bonds of Special Improvement District No. 504 Affidavit of publication of Notice of Sale of the bonds was presented. The Mayor and the Acting City Manager outlined the proceedure for conducting this bond sale and stated that the amount of bonds to be sold for Special Improvement District No. 504 would be in accordance with the advertisement as follows: Advertised Amount Amount to Be Sold SID No. 504 $62,000.00 $62,000.00 Mayor Grabow announced the City was ready to conduct the bidding on the Bonds of Special Im- provement District No. 504 in the amount of $62,000.00. The following bidders qualified by deposit- ing with the Clerk of the Commission the necessary bid security. Bidder Representing Mrs. Jean Roby First National Bank Mr. Phil Sandquist Security Bank & Trust Company Mr. Hal Bolinger Self Mr. Ed. Hines D. A. Davidson & Company, Gt. Falk Dr. C. C. Morledge, M.D., Self. Billings, The lowest effective interest rate accruing to the City of Bozeman were as follows: Bidder Interest Rate Dr. C. C. Morledge, M.D. 7.0% Mr. Hal Bolinger 5.7 First National Bank 5.6 Security Bank & Trust Co., 5.5 Following the recommendation of the Director of Finance, concurred in by the Acting City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the bid of Security Bank & Trust Company, Bozeman, being the lowest and best bid submitted, the sale of the bonds be awarded to Secur~ty Bank & Trust Company and the bid security of the unsuccessful bidders be returned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow, those voting No, none. Consideration of Construction Bid - Special Improvement District No. 504, Construction of Paving W. ASPEN & \.J. Tamarack Street between NO._2th &7thi\venue: The engineers representing consulting Thomas, Dean & Hoskins, Inc., and the City Engineer having completed their study of the bids submitted for the construction of the paving on West Aspen and West Tamarack Streets between North Fifth and North Seventh Avenue, Special Improvement District No. 504, and having prepared a final tabulation of the bids reported that the only bid received for the project if accepted would exceed the advertised total cost of $62,000.00 by $4,920.78. It was further reported that a cashiers check in the amount of $4,920.78 had been received from Albertson's Inc., to provide the extra money needed to allow completion of the paving project. The engineers representing consultants, Thomas, Dean & Hoskins, Inc., and the City Engineer recommended that the bid be awarded to Long Construction Company, Billings on this basis. The Acting City Manager concurred in the recommendation of the engineers and it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that Long Construction Company be awarded the contract for the construction of Special Improvement District No. 504 on the basis of their bid of $57,l97.25 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Valley View Country Club Request for Hard Surface - Kagy Blvd from Sourdough to South Third Ave.: A petition signed by l38 interested persons or property owners regarding hard surfacing of Kagy Blvd. from Sourdough Road to South Third Avenue was presented. The petitioners stated the surfacing should be sponsored by the City and County and felt that such costs could be supported by the Montana State Gasoline Tax refunds. Following a discussion, it was moved by Commissioner Vollmer, 222 seconded by Commissioner Sedivy, that the Commission acknowledge receipt of the petitions and assure them that it will be given every consideration. They also suggested that the interested persons meet with the County Commission. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Consideration of Request for Building Permit Moratorium & Zoning Change - University Subdivision: In accordance with action taken last week whereby the City Commission tabled action upon the above mentioned petition signed by l04 persons residing within the general area of the University Subdivision for a period of one week the request was again presented. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the above items be removed from the table and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Acting City Attorney O'Connell had been asked to check on the legal ratifications of the building permit moratorium. Acting City Attorney O'Connell stated that after investigating this matter he feels that there should be a clear cut immediate hazard before the Commission would be justified in declaring a moritorium. The Mayor stated that he and the other Commissioners had personally visited the area last Thursday and made an on the ground inspection. The Commission realizes there is a problem because of the limited access to this area, but they do not feel that the solution proposed by the petition was the most desirable course of action. The Acting City Manager again stated that in concurrence with the City-County Planning Board's recommendation on this matter, he would not recommend that the City Commission create the moratorium or make the zoning changes requested by the petition. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that they deny the request for the Building permit and Zoning change and instructed the City staff to give this their immediate attention in order that at least a part of the traffic problem and Garfield Street may be remedied by September 1972. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Reports: The following reports were presented: Director of Finance Water Collector Cemetery The Acting City Manager commented on the reports and recommended approval thereof. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the reports be approved and ordered filed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Authority to Purchase \-later Meters - Approximate cost $1,200.00: The City has need for an additional supply of water meters and the Acting City Manager requested authority to purchase a supply of water meters at an approximate cost of $l,200.00. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the purchase of water meters be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Ad ;ournment: There being no further business to come before the Commission at this time, it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Comm- issioner Lehrkind, Commissioner Vandeventer, Commtssioner Vollmer and Mayor Grabow; those voting No, none.
