The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 9 February 1972, at l:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Comm-
issioner Vandeventer, Commissioner Vollmer, Acting City Manager Keyes, Acting City Attorney O'Connell and
the Clerk.
Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held 2 February 1972, were approved as read.
Authorize Absence of Commissioner Lehrkind:
In accordance with the re commendation of the Acting City Manager, it was moved by Commissioner
Vandeventer, seconded by Commissioner Vollmer, that the absence of Commissioner Lehrkind be authorized
in compliance with Section ll-3245, R.C.M., 1947. The motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and
Mayor Grabow; those voting No, none.
2P_~~, Bids on Railings at Ne\.J \\Taste Water Treatment Plant:
This was the time and p_lace set for opening bids for the fabrication and installation of Railings
at the New Waste Water Treatment Plant. The affidavit of publication of the "Call for Bid" was presented.
It was moved by Commissioner Sedivy, seconded by Commissioner Vandeventer, that the bids be opened and
read and the motion was carried . . . . .
The following bids were then opened and read:

Upon recommendation of the Acting City Manager, it was moved by Commissioner Vandeventer, seconded
by Commissioner Vollmer, that the bids be referred to the City Engineer for checking and recommendation
to be made to the Commission. The motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those
voting No, none.
Discussion on Request to Connect to Sanitary Se~er on South 19th Ave., Ralph Aaker property:
The request from Donald F. Nell of United Agencies on behalf of his client Ralph K. Aaker for the
extension of a sewer line from its present location on South Nineteenth Avenue to cover a tract of land
being the E~ of the SE~ of Section l4, T2S, R5E, MPM, being eighty acres Bore or less and fronting on
19th Avenue adjacent to the City of Bozeman was again presented for discussion.
Mr. Nell was also present to discuss the request for the extension of a sewer line and answer any
questions in regard to the request.
Following a thorough discussion, it was moved by Commissioner Sedivy, seconded by Commissioner
Vandeventer, that the request be tabled for another week to furth study the problem and in order to gain
more information. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Sedivy, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none.

It: was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the City Commission and
the Acting City Manager be authorized to attend the meeting of the Montana League of Cities Board of Dir-
ectors to be held in Helena, 15 February 1972, and the expenses be paid from the General fund and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Comm-
issioner Sedivy, Commissioner Vandeventer and Mayor Grabow; those voting No, none.
Utility Tie-On Agreement: Midland Terminal Inc.,:
A Utility Tie-On Agreement providing for Midland Terminal Inc., who signed a waiver of protest to
annexation to connect at their own expense the property located north of the City of Bozeman with the
existing sewer lines of the City of Bozeman or their extensions pursuant to the provisions and authority
given by Section ll-lOOl, R.C.M., 1947, and as amended by the 1971 legislative assembly was presented.
Following a discussion, the Commission concurred with the recommendation of the Acting City Manager
and it was moved by Commissioner Sedivy, seconded by Commissioner Vandeventer, that the Utility Tie-On
Agreement having been executed by the property owner be approved with a rider attached as follows:
(1) Upon completion of construction they would deed the complete sewage system
outside of their property to the City.
(2) That the City reserve the right to limit the quantity and type of sewage that
would be introduced into the mains.

The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Sedivy, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none
License Bond of Parco Neon:
In compliance with Chapter 14 of the Bozeman Municipal Code, the sign bond of Parco Neon Company,
Livingston, was presented. The City Manager stated the Building Inspector had recommended approval
of the bond and the Acting City Attorney had approved the bond as to form. It was moved by Commissioner
Vandeventer, seconded by Commissioner Vollmer, that the bond be approved and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Conmissioner Vollmer,
Commissioner Sedivy and Mayor Grabow; those voting No, none.

The acting City Manager commented on the report of the Police Chief and recommended approval
thereof. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the report of
the Police Chief be approved and ordered filed. The motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Vandeventer
and Mayor Grabow; those voting No, none.

The Acting City Manager commented on the claims and found them to be true and lawful claims
against the City and recommended they be approved and the Director of Finance be directed to issue
warrants in payment. It was moved by Commissioner Sedivy, seconded by Commissioner Vandeventer,
that the claims be approved and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner Vollmer, And Mayor
Grabow; those voting No, none.
Consideration of Bids on Railing at New Waste Hater Treatment Plant:
The City Engineer having checked the bids on the fabrication and installation of Railings at
the New Waste Water Treatment Plant, recommended that the bid of Service Electric, Bozeman, in the
amount of $6,925.00 be accepted. The Acting City Manager concurred with the recommendation of the
engineers, recommending that the contract be awarded to Service Electric of Bozeman on the basis
of their bid in the amount of $6,925.00, it being the lowest bid and equaling the specifications
as contained in the"Call for Bids."rn concurrence with the recommendation of the City Engineer, and
the Acting City Manager, it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer,
that the above hid be accepted and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor
Grabow; those voting No, none.

Commissioner Vollmer, seconded by Commissioner Sedivy, that the meeting be adjourned and the motion
