HomeMy WebLinkAbout1972-02-16 228 Bozeman, Montana 16 February 1972 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, l6 February 1972, at l:lS o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Acting City Manager Keyes, Acting City Attorney O'Connell and the Clerk. Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held 9 February 1972 were approved as read. ~~'es~."~-92~1l Buddy Poppies 6 May 1972 - V.F.H. Auxili~2 A letter received from the Veterans of Foreign Wars Auxiliary designating 9 May 1972 as "Poppy Day" and requesting permission to sell "Buddy Poppies" was presented. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that per~mission to conduct the fund drive on 9 May 1972 be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Proclamation; National Beauty Salon Week, Ilf-20 February 1972: Mayor William Grabow announced his proclamation of 14-20 February as "National Beauty Salon Week" in the City of Bozeman and called it to the attention of all citizens as a week in which to give special consideration to the cosmetologists of our community, acknowledging their high sense of public responsibility and their dedication to providing the best possible beauty care for all women in accordance with the request of the Bozeman Beauticians Association. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the proclamation be endorsed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. I Robert Taylor - Regarding Permit to Hove House on \.Jest Lamme: Robert Taylor appeared before the Commission in regard to the denial of a permit to move a house from West Villard Street to 609 North Montana Avenue. Mr. Barrick was called upon to advise the Commission that the reason for this denial was based upon the courts decision not to permit the Building Inspector the authority to accept the ungraded and uninspected lumber for graded and inspected lumber. The Acting City Attorney was asked for his interpretation of the courts findings. He stated that if the inspection of the ungraded lumber consists of something more than a visual inspection by the City Building Inspector and said Building Inspector makes an effort by means other than vis- ual observation to determine that the lumber in the house or building is at least the equivalent to that required by the Uniform Building Code in quality, strength, effectiveness, fire resistance, durability and safety, then such Building Inspector may accept such lumber as being a suitable al- ternate for the lumber required by the Uniform Building Code. He further stated that the Building Inspector be required to make a more stringent and demanding inspection, for example. a hammer test, a drill test, or a core test to determine if the building is structurally sound and would give the Building Inspector a principle to follow. Following a thorough discussion, the Commission concurred with the recommendation of the Acting City Attorney, also concurred in by the Acting City Manager and it was moved by Commissioner Lehr- kind, seconded by Commissioner Vandeventer, that the Commission allow this type of request to be granted pending an inspection of more than a visual inspection by the Building Inspector, the extent of such inspection to be determined by the Building Inspector. The motion was carried by the follow ing Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Comm- issioner Vollmer, Commissioner Sedivy ~ those voting No, none. Mayor Grabow abstained. Continuation Bond - Wilson & Company: In compliance with Chapter 16 of the Bozeman Municipal Code, the plumbing and heating bond of Wilson & Company was presented. The Acting City Manager stated the Building Inspector had recommended approval of the above mentioned bond and the Acting City Attorney had approved the bond as to form. It was moved by Commissioner Vandeventer, seconded by Commissioner Sedivy, that the continuation of the aforementioned bond be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vollmer and Mayor Grabow; those voting No, none. I I I I I Request for Annexation - Boyd Boylan: A letter received from Boyd Boylan requesting that his property consisting of twenty acres located on the corner of 1lth avenue and Kagy Boulevard directly west of the proposed site for the new MSU stadium, be annexed to the City of Bozeman and that he be granted permission to hook on to the City Sewer System was presented. Following a discussion, it was moved by Commissioner Sedivy, seconded by Commissioner Lehr- kind, that the request be turned over to the plannng board for study and their recommendation. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sed- ivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Contract Documents SID No. 504: The contract documents for the construction of a portion of West Aspen and West Tamarack Street between North Fifth and North Seventh Avenue, SID No. 504 as awarded to Long Construction Company, Billings, on the basis of their bid in the amount of $57,l95.25 was presented. The Acting City Manager recommended that the contract be approved. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the Contract documents be approved and that the Mayor and Clerk of the Commission be authorized and directed to sign the contracts for the City of Bozeman and that Long Construction Company be authorized to proceed with the construction and that the pledge for bid security be returned to Long Construction Company, Billings, Montana, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Contract Documents - Railings at Waste Water Treatment Plant: The contract documents for the fabrication and installation of Railings at the New Waste Water Treatment Plant as awarded to Service Electric Co., Bozeman, on the basis of their bid in the amount of $6,925.00 was presented. The Acting City Manager recommended that the contract be approved. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the contract documents be approved and the Mayor and the Clerk of the Commission be authorized and directed to sign the contracts for the City of Bozeman and that the pledge for bid security be returned to Service Electric and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. Reports: The following reports were presented: Cashier Police Court The Acting City Manager commented on the reports and recommended approval thereof. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the reports be approved and ordered filed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy", Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Adjournmen t: There being no further business to come before the Commission at this time, it was moved by Commissioner Sedivy, seconded by COmmissioner Lehrkind, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Comm- issioner Lehrkind, Commissioner Vandeventer, Commissioner Vollm~ and Mayor Grabow; those voting No, none.
