The Con~ission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 1 March 1972, at 1:15 o'clock p.m. Present were Mayor Grabow, Commissioner Sedivy, Comm-
issioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Acting City Manager Keyes, Acting
City Attorney O'Connell and the Clerk.
Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had:

An application received from Ruth E. Clark, ll03 Cherry Drive, requesting a kennel license in
accordance with Ordinance No. 857, Section 5.l6.040 of the Bozeman Muncipal Code, together with the
required fee was presented. Following a discussion, the Commission concurred with the recommendat-
ion of the Acting City Manager and it was moved by Commiss;oner Vollmer, seconded by Commissioner
Sedivy, that the request of Mrs. Ruth E. Clark of 1103 Cherry Drive be tabled for a period of one
week due to the fact that a new ordinance is being prepared which will more clearly spell out the
guide lines for issuing a kennel license. The motion was carried~ the following Aye and No vote,
those voting Aye being Cormniss ioner Vollmer, Commissioner Sed ivy, Commissioner Lehrkind, Comm-
issioner Vandeventer and Mayor Grabow; those voting No, none.
Uti,lity Tie-On Agreem~nt - Covered Hagon Mobile Honle Court, Jr. Tschache:
An Agreement to extend the Water and Sewer facilities of the City of Bozeman outside of the
City Limits of the City of Bozeman to service the Covered Wagon Park Subdivision prepared pursuant
to Section ll-100l, R.C.M., 1947, was presented.
The Acting City Manager commented that all provisions which had been stated by the City Comm-
ission at their meeting of l2 May 1971 had been included in the Agreement and Mr. Tschache further
agreed to pave North Seventeenth Avenue from Durston Road north with a one and one-half inch hot
mix overlay.
Following a discussion, it was moved by Comnlissioner Sedivy, seconded by Commissioner Lehrkind,
that they approve the Agreement as presented and the Mayor and Clerk be authorized and directed to
sign the Agreement for the City. The motion was carried by the following Aye and No vote: those I
voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner
Vollmer and Mayor Grabow; those voting No, none

In compliance with Chapter l4 of the Bozeman Municipal Code, the Sign Bond of Epcon Company,
Billings, Montana, was presented. The Acting City Manager stated the Building Inspector had re-
commended approval of the above mentioned bond and the Acting City Attorney had approved the bond
as to form. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the
aforementioned bond be approved and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commiss-
i.oner Sedivy and Mayor Grabow; those voting No, none.

The Chief of police reported that police Officers Stephen b. Elliott and David A. Krogstad
had satisfactorily completed the required six month probationary period and recommended that police
Officer Elliott be confirmed as a regular officer of the Police Department effective 1 March 1972,
and that Police Officer Krogstad be confirmed as a regular officer of the Police Department effect-
ive 6 March 1972. The Acting City Manager announced that he concurred in the recommendation of the
Chief of police. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that
the confirmation of police Office Elliott and Police Officer Krogstad be approved and that they be
congratulated on completing the six month probationary period and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer,
Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. I

A request from Carl Tange to annex a tract of land of approximately thirty acres lying north-
erly and westerly of the present City Limits and known as the Tange Addition and to become a portion
of the City of Bozeman was presented.
Mr. Carl Tange and Mr. Don Nell were present to discuss the proposed annexation and to present
certain conditions for the Tange Addition to be accepted into the Bozeman City Limits as follows:
1) Tange will deed Oak Street to the City as drawn on attached map entitled
Tange Addition.
2) Tange will deed Lot 7 and Lot 8 to the City as drawn for an alternate
Oak Street onto Seventh Avenue with following Provisions.

(a) The City must determine the routing for Oak Street within
two years so we can do planning on property.
(b) If Oak Street is to go straight thru to Seventh, Lot 7
must be deeded back to Tange within the above stated two
year period.
(c) If Lot 8 is not required for exchange purposes with Humble
to put Oak Street straight thru or for Oak Street Alter-
nate, it must be deeded back to Tange within the above
stated two year period.
3) Tange will deed park area to City per the plan of three plus acres. Tange
will also agree to purchase park land at $200. per acre if the City so
desires. If road easements are required thru the park area for develop-
ment of the Tange Addition, this must be granted by the City at no cost
to Tange.
4) Tange will not pay any costs for Oak Street planning and construction
bordering the Tange Addition.

A letter received from the City-County Planning Board whereby they recommended approval of the
plat with the following stipulations was also read.
l) That Oak Street be located to the south of the property along the property
line and abut the Humble Oil property with an alternative access to the
west and north of the Humble Oil property as an alternate route for local
traffic on Oak Street in the near future.
2) That the portion of Oak Street adjacent to Humble Oil property to the \-lest
and to the north be deeded to the City instead of dedicated for right-of-way.
3) That the City request cash-in-lieu of park dedicati.on.
4) That block and lot numbers be used for the entire area.
Following a thorough disctlssion, it was moved by Commissioner Vandeventer, seconded by Comm--
issioner Vollmer, that the Tange request for annexation be tabled for a period of one week in view
of obtaining further information and contacting Humble Oil Company. The motion was carried by the
following Aye and No vote: those voting Aye being Commiss ioner Vandeventer, Commiss ioner Vollmer,
Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none.

The Acting City manger commented on the above reports and recommended approval thereof. It
was moved by Commiss ioner Vollmer, seconded by Commissioner Sedivy, that the reports be approved
and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer
and Mayor Grabow; those voting No, none.
Letter to Rosary H'gh School:
It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that a letter be
addressed to Rosary HLgh School congratulating them on their outstanding performance and their first
place finish in the District 6-B Tournament held in Helena, 2l~-26 February 1972. The motion was
carried by the following Aye and No vote: those voting ^ye being Commissioner Lehrkind, Commiss:Loner
Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none.

There being no further business to come before the Commission at this time, it was moved by
Commissioner Vandeventer, seconded by Commissioner Vollmer, that the tneeting be adjourned and the
motion was carri.ed by the following Aye and No vote: those voting A~e be:ng Commissioner Vande-
venter, Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Hayor Grabow; those
voting No, none.
