The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, l5 March 1972, at 1:15 o'clock p.m. Present were Hayor Grabow, Commissioner Sedivy, Comm-
issioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Acting City Manager Keyes, Acting
City Attorney Andriolo and the Clerk.
Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held 8 March 1972 were approved as read.

This was the time and place set for opening bids on a new 20,000 pound G.V.W. Dump Truck for
use by the Street Department. The affidavit of publication of the "Call for Bids" was presented. It
was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the bids be opened and read
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those
voting No, none.
The following bids were then opened and read:

Upon recommendation of the Acting City Manager, it was moved by Commissioner Lehrkind, seconded
by Commissioner Vandeventer, that the bids be referred to the Street Superintenden and the City Engineer
for tabulation and recommendation to be made to the Commission a t their next meeting on Wednesday,
22 March 1972. The motion was carried by the following Aye and No vote: those vo ting Aye being
Commissioner Lehrkind, Commissioner Vandeventer, COnlnlissioner Vollmer, Commissioner Sedivy, and
Mayor Grabow; those voting No, none.
Ordi~nce No ~ - Dog Kennel License:
Following a review of Ordinance No. 915 prepared by the Acting City Attorney, amending Title 5,
Chapter 5.16 of the Bozeman Municipal Code by defining a dog kennel and establishing standards and
proceedures for the issuance of a license to maintain a dog kennel. It was moved by Commissioner
Vandeventer, seconded by Commissioner Vollmer, that the Ordinance be tabled for further study and
until additional information is secured. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy, Comm-
issioner Lehrkind and Mayor Grabow; those voting No, none.

The petition signed by Mr. & Mrs. Kenneth Swenson, 1322 South Willson Avenue and Dr. & Mrs.
Stephen Chapman, l402 South Willson Avenue, requesting that the City of Bozeman vacate the extension
of Grant Avenue sixty feet wide from the east edge of South Willson Avenue extending approximately
one-hundred eighty feet to the railroad right -of-way was again presented along with a letter from
the City-County Planning Board. Mr. Kenneth Swenson was also present in regard to the request.
The City-County Planning Board did not make a recommendation to the City Commission, but felt
that West Grant Avenue should not be closed at this time as it provides an access to an undeveloped
public park and could be utilized for access at the time the park is designed. Following a field
check and an analysis of the petition to vacate that portion of Grant Street lying east of South
WHlson Avenue, the City Engineer recommended that the petition be denied and retained as a future
access to the City Park.
Following a discussion, the Commission concurred ~oJith the recommendation of the City County
Planning Board and the City Engineer also concurred in by the Acting City Manager and it was moved
by Commissioner Vollmer, seconded by Commissioner Sedivy, that the request be denied, but that the
Street Department be instructed to grade this area in order that it may make it smooth so that they
can use it for off-street parking, for putting in a lawn or for whatever they see fit. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commiss-
ioner Sedivy, Commissioner Vandeventer, Commissioner Lehrkind and Mayor Grabow; those voting No, none.

The Annual Meeting of the Montana Recreation & Park Association is scheduled to be held in Helena,
6-8 April 1972, and the City Recreation Director recommended that the Park Recreation Board Chairman,
The Recreation Director and the ParkSuperintendent be authorized to attend. In concurrence with the
recommendation of the Recreation Director, concurred in by the Acting City Manager, it was moved by

Commissioner Sedivy, seconded by Commissioner Lehrkind, that the request to attend the conference
be granted and, it being in the public interest, their expenses be paid from the Park fund and the
motion was carried by the following Aye and No vote: those voting Aye being Commlssioner Sedivy,

The certificate from the City Engineer certifying that the fabrication and installation of
Aluminum Safety Grating on five junction and diversion structures at the Haste tvater Treatment
plant have been completed was presented. The Acting City Manager concurred in the recommendation
of the City Engineer that payment be approved and the Director of Finance be directed to issue a
Harrant in the amount of $3,9/:0.86 to Midwest hTelding & Machine Shop. It ~vas moved by Commissioner
Lehrkind, seconded by Commissioner Vandeventer, that the claim be approved and the projec t be

A request from the Ross Jensen Chapter of theDeMolays and Rainbmv girls to conduct a fund
drive for Muscular Dystrophy on street corners in the downtmvn area and at the shoppinG centers
on Friday, 17 March 1972, was presented. It Has moved by Commissioner VAndeventer, seconded by
Commissioner Lehrkind, that permission to hold the fund drive on Friday, l7 March 1972, be granted
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Vollmer and Mayor Grabow;

Hayar Grabmv announced his proclamation of Tuesday, 11 April 1972, as "From Yellowstone to
TomtrlOrrOvl Day" in the City of Bozeman and encouraged all citizens to observe the day in tribute to
the men and Women Hhose contributions to the survival of wildlife and the beal!ties of nature needs
to be more ~videly known as requested by the Long Distance Division of the Bell System as a tribute
to the National Park Service personnel on its 100th Anniversary was presented. It was moved by
Commissioner Lehrldnd, seconded by Commissioner Vandeventer, that they endorse the Hayors procla-
mation as requested and the motion was carried by the following Aye and No vote: those voting Aye

Mayor Hilliarn E. Grabmv announced he had issued a proclamation designating the week of 19-25
March as Camp Fire Girls 'i-leek recognizing sixty t\\lO years of service to girls aged seven through
High School. The Commission concurred with the Mayor and it Was moved by Commissioner Vandeventer,
seconded by Commissioner Vollmer, that the proclamation proclaiming the Heek of 19-25 March 1972,
as "Camp Fire Girl Heek I be endorsed and the motion was carried by the follo\ving Aye and No vote:

The Acting City Manager commented on the reports and recommended approval thereof. It was
moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the reports be approved and

Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and

The final plat of the Rearrangement of the Elks Club Property was again presented along with
the favorable recommendation of the City-County Planning Board. Following a discussion, the hcting
City Manager recommended, that he be authorized and directed to sign the Rearrangement of the Elks
Club property as the Director of Public Service. It was moved by Commissioner Sedivy, seconded
by Commissioner I_ehrkind, that the plat be approved and the Acting City Manager be authorized and
directed to sign the Plat as Director of Public Service and the motion was carried by the folloHing

A short discussion was held on the "AA" Basketball Tournament hosted in Bozeman lO-l3 March
and the adverse publicity raised by certain fans from other cities concerning the apparant lack
of both facilities and interest in the Basketball Tournament. The Chief of Police stated that the
tournament this year was the finest and best coordinated tournament that we have had in Bozeman.
Traffic and crowd control were handled effectively and Bozeman and the Montana State University
were commended generally on their manner of hosting the tournament. It was moved by Commissioner
Sedivy, seconded hy Commissioner Lehrkind, that the Acting City Manager be instructed to address
a letter to the Montana High School Association with copies to the Bozeman Chamber of Commerce and
the Field House, Montana State University, advising them of the City of Bozeman's continued interest
in holding future Basketball Tournaments in Bozeman. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner
Vandeventer, Commissioner Vollmer, and Mayor Grabow; those voting No, none.
