HomeMy WebLinkAbout1972-01-05 I I I Bozeman, Montana 5 January 1972 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building,S January 1972, at 1:15 o'clock p.m. Present were Mayor Grabow. Commissioner Sedivy, Comm- issioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, City Manager Fryslie, Ass't. City ~anager Keyes, Acting City Attorney O'Connell and the Clerk. Commission Lehrkind opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held 29 December 1971 were approved as read. Minutes of the special meeting held 3 January 1972 were approved as read. Open Construction Bids SID No. 505, Construction of Water Mains on South 20th Ave.: This was the time and place set for opening bids for the construction of Watermains on South 20th Avenue, SID No. 50S. Affidavit of publication of Notice to Bidders was presented. It was moved by Commissioner Sedivy, Seconded by Commissioner Vollmer, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vollmer, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting no, none. The following Bids were then opened and read: Matzeck Construction, Ennis Schedule No.1 - $29,l70.00 Schedule No.2 - 7,350.00 Total Base Bid $36,520.00 C. W. Schmidt, Inc., Missoula Schedule No. 1 - 32,374.10 Schedule No.2 - 6,076.00 Total Base Bid $38,450.l0 Tynes Construction., Great Falls Schedule No. 1 - $29,065.00 Schedule No. 2 - 6,860.00 Total Base Bid $35,925.00 The Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the bids be referred to the engineers representing consultant Thomas, Dean, and Hoskins, Inc., and the City Engineer for final tabulation, consideration and recommendation 12 January 1972 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, CommissionerVandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Hearing, Resolution No. l499, Intent to Annex 241,2653, n.e. of Bozeman: During the regular session of the City Commission held on 8 December 1971, the Commission re- gularly passed and adopted Commission Resolution No. l499 declaring its intention to extend the boundaries of the City of Bozeman so as to include 241,2653 acres along North Rouse Avenue and Bridger ro ad . This being the date set for public hearing as set forth in said Commission Resolution No. 1499, affidavit of publication of Notice and the Clerks mailing certificate stating that all property owners had been notified was presented. The City Manager presented protests filed with the Clerk of the City Commission and signed by property owners amounting to 66.67%. A number of property owners were also present to discuss the annexation, answer questions and affirm their written protests to the annexation. Following a discussion, the Commission concurred in the recommendation of the City Manager and it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that on the basis of the protests being sufficient and under the provision of Section ll-507, R.C.M., 1947, no further proceedings shall be had under Commission Resolution No. 1499 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none. Proclamation U. S. Department of Justice - "Alien Address Report Month;" In accordance with the United States Department of Justice, Immigration and Naturalization Service, Mayor Grabow proclaimed the month of January as "Alien Address Report Month" and requested that all citizens, employees and officers of the City of Bozeman assist and encourage every alien within the City of Bozeman to report his address at the nearest Post Office or Immigration and Naturalization Service Office during the month of January 1972. It was moved by Commissioner Vande- venter, seconded by Commissioner Vollmer, that the Commission concur in the proclamation and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Comm- issioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind and Mayor Grabow; those voting No, none. 213 214 Reports: The following reports were presented: Police Judge (Dec. & Annual:) Fluoridation Building Inspector The City Manager commented on the reports and recommended approval thereof. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commiss~' ioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer and Mayor Grabow; those voting No, none. Claims for December: Claims l226l through l2413 inclusive and 1541 through 1665 inclusive were presented as follows: The City Manager checked the claims and found them to be true and lawful claims against the City of Bozeman and recommended they be approved and the Director of Finance be directed to issue warrents in payment. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer and Mayor Grabow; those voting No, none. Keyes, Acting City Manager $20,000.00: The official bond in the amount of $20,000.00 as required by Ordinance No. 524, written by Hartford Accident and Indemnity Company bonding Robert F. Keyes Acting City Manager during the absence of City Manager Fryslie and approved as to form by the Acting City Attorney was presented together with Mr. Keyes oath of office. It was moved by Commissioner Lehrkind, seconded by Comm- issioner Vandeventer, that the bond be approved as recommended by the Acting City Attorney and filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer, Commissioner Sedivy and Mayor Grabow; those voting No, none.
