HomeMy WebLinkAbout1971-11-24 I I I Bozeman, Montana 2f+ November 1971 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 24 November 1971, at 1:15 o'clock p.m. Present were Mayor Langohr, Commissioner Grabow, Commissioner Lehrkind. Commissioner Vollmer, Commissioner Sedivy, City Manager Fryslie, Ass't City Manager Keyes, Acting City Attorney O'Connell and the Clerk. Commissioner Grabow opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held 17 November 1971 were approved as read. Req:-Iest for Culvert, Alley at Be:111 Street - 10th to 11th Avenue: The request from Dr. Tom Fellows for a culvert to be placed in an irrigation canal which runs parallel and adjacent to Beall Street was again presented to the Commission following a week of study and an on the ground inspection. Following a discussion, it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that they concur in the recommendation of theCity Manager, that the City of Bozeman offer to provide the equipment and labor for the installation of a culvert if the property owners involved provide the material. The motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none. Resolution No. 1L.97, Set Date, Maturity Date & Amount of Bonds - SID No. 502: Commission Resolution No. l497 authorizing the issuance of bonds of Special Improvement District No. 502 was presented as follows: COMMISSION RESOLUTION NO. 1497 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN FIXING THE DATE. MATURITY DATE. AND THE PRINCIPAL AMOUNT OF BONDS TO BE ISSUED IN SPECIAL IMPROVEMENT DISTRICT NO. 502. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the resolution be passed and adopted and the motion was carried by the following Aye and no vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Con~issioner Grabow, Commissioner Lehrkind and Mayor Langohr; those voting No, none. Bond & Oath of O~fice Approval, Milt Vandeventer - 3 January 1972 to 31 December 1975: The official bond and Oath of Office in the amount of $5,000.00 as required by Ordinance No. 524, Chapter 2.08.020 of the Bozeman Municipal Code for Milton Vandeventer newly elected Commissioner of the City of Bozeman was presented. The bond covers a period of four years, beginning 1 January 1972 and ending 31 December 1975. It was moved by Commissioner Sedivy, seconded by Commissioner Grabow, that the bond be approved as recommended by the City Attorney and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer and Mayor Langohr; those voting No, none. Re9.-':lest for Fede~al Grant Payment, $88,921.56 - Waste Water Treatment Plant: The Applicant's payment request WPC No. Mont-125, Form CG-22 (Applicants Payment Request), copy of final payment estimate for Detweiler Bros., Inc.. & Felton Construction Company, Form CG-23 (Labor Standards Certificate from above Contractors), Force Account Weekly Payrolls (Labor & Equipment) & Summary Sheet, Copies of City of Bozeman Claims eligible purchases & Summary Sheet prepared for the Federal Water Pollution Control Administration seeking the Fourth and Semi-Final payment for the Construction of the Waste Water Treatment plant and the Sewer Project in the amount of $88,921.56 was presented. Following a thorough discussion, it was moved by Commissioner Grabow, seconde~ by Commissioner Lehrkind, that the form CG-22 and Form CG-23 for the WPC Mont-l25 Fourth and Semi- Final construction grants be approved and forwarded to the Federal Water Pollution Control Adminis- tration for consideration of the payment request in the amount of $88.921.56 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy and Mayor Langohr; those voting No, none. ~",-sollltion Seeking Federal Funds - Downtown Redevelopment COl11tT1i ttee: A letter received from John Reichel, Chairman of Downtown Redevelopment Committee regarding an investigation of Federal Funds available for improving and maintaining downtown City Areas along with a resolution passed by the Downtown Redevelopment Committee was presented. Following a thorough discussion, it was moved by Commissioner Lehrkind, seconded by Commissioner :199 200 Vollmer, that the Commission acknowledge the request and instruct the City Manager to explore the availability of Federal Funds on a planning basis, also ascertain what will have to be done as a City Government and that a resume be prepared for each of the plans as to how they will affect the City. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none.' Re.Ror ~~: The following reports were presented: Cashier Director of Public Service Water Cemetery The City Manager commented on the reports and recommended approval thereof. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the report be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind and Mayor Langohr; those voting No, none. 1l2.!:~E...]rice - Discussion regard .ng Traffic: John Price appeared before the Commission to discuss the traffic condition in and around the City of Bozeman, questioning the reason for a twenty-five mile per hour speed zone on West College Street between Eleventh and Nineteenth Avenue. The Commission informed Mr. Price, that they have taken every measure to conform with City and State regulations in regard to speed zones and pedes- trian traffic and would continue to do so. The area in question is one of considerable pedestrian I use. Contract Documents, STD No. 502, HSF-MT-08-00-0017 for Execution: C.W. Schmid..,L$5351.903?..64: The Contract Documents for the construction of Trunk1ine System Watermains for the westerly portion of Bozeman SID No. 502, WSF-MT-08-00-00l7 is awarded to C. W. Schmid, Inc., Missoula, Mon- tana, on 17 November 1971, in the amount of $535,908.64 was presented. The City Manager recommended that the documents me approved as to form by the Acting City Attorney be approved. It was moved by Commissioner Sedivy, seconded by Commissioner Grabow, that the Contract Documents be approved and the Mayor and the Clerk of the Commission be authorized and directed to sign the contracts for the City of Bozeman and that C. W. Schmid, Inc., be authorized to proceed with the construction and that the pledge for bid security be returned to C. W.
