The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 1 December 1971, at 1:15 o'clock p.m. Present were Mayor Langohr, Commissioner Grabow,
Commissioner Lehrkind, Commissioner Sedivy, City Manager Fryslie, Ass't. City Manager Keyes, Acting
City Attorney O'Connell and the Clerk.
Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held 24 November 1971 were approved as corrected.
Hearing, Resolution No. 1495, Intent to Vacate a Portion of Aspen Street: Ordinance No. 910 Vacating:
This was the time and place set for public hearing of Commission Resolution No. 1495 on vacating
a portion of Aspen Street lying between Lots 25 through 32 inclusive, of Block 109, and Lots 1 through
8 inclusive, of Bloc 108, Northern Pacific Addition to Bozeman, Montana. Mr. Frank Lessley, 716 Nor:th
Church Avenue was present to ask questions in regard to the vacation of the street. There being no
protests having been filed, it was moved by Commissioner Grabow, seconded by Commissioner Lehrkind,
that Ordinance No. 910 entitled:
ORDINANCE NO. 910
AN ORDINANCE OF THE CITY OF BOZEMAN VACATING A PORTION OF ASPEN
STREET LYING BE'lWEEN LOTS 25 11lROUGH 32 INCLUSIVE, OF BLOCK 109,
AND LOTS 1 11l0URGH 8 INCLUSIVE, OF BLOCK 108, NOR11lERN PACIFIC
ADDITION TO BOZEMAN, MONTANA.
as prepared by the Acting City Attorney vacating a portion of the streets be passed and adopted. The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Comm-
issioner Lehrkind, Commissioner Sedivy and Mayor Langohr; those voting No, none.
Authorize Absence of Commissioner Vollmer:
In concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy,
seconded by Commissioner Grabow, that the absence of Commissioner Vollmer be authorized in compliane
with Section 11-3245, R.C.M., 1947. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind and Mayor Langohr;
those voting No, none.
Horizon Club (Senior High School) Fund Drive 1-14 December 1971:
A letter received from Gloria Jans, President of the Horizon Club (High School Campfire) re-
questing permission to hold a fund drive from 1 to 14 December was presented. It was moved by Comm-
issioner Grabow, seconded by Commissioner Lehrkind, that the request be granted and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner
Lehrkind, Commissioner Sedivy and Mayor Langohr; those voting No, none.
Bond & Oath of Office - Mayor Elect Edmund P. Sedivy:
The official bond and oath of Office, in the amount of $5,000.00 as required by Ordinance No.
524, Chapter 2.08.020 of the Bozeman Municipal Code for Mayor Elect Edmund P. Sedivy of the City of
Bozeman was presented. The bond covers a renewal periodof four years, beginning 1 January 1972
and ending 31 December 1975. It was moved by Commissioner Grabow, seconded by Commissioner Lehrkind,
that the bond be approved as recommended by the Acting City Attorney and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrkind,
and Mayor Langohr; those voting No, none. (Edmund P. Sedivy excused)
License Bond - Jack Francis, Electrician:
In compliance with Chapter 15 of the Bozeman Municipal Code, the Electricians License Bond of
Jack Francis was presented. The City Manager stated the Building Inspector had recommended the
approval of the above mentioned bond and the Acting City Attorney had approved the bond as to form.
It was moved by Commissioner Sedivy, seconded by Commissioner Grabow, that the bond be approved
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Sedivy, Commissioner Grabow, Commissioner Lehrkind and Mayor Langohr: those voting No, none
