HomeMy WebLinkAbout1971-12-08 202 Bozeman, Montana 8 December 1971 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 8 December 1971, at 1:15 o'clock p.m. Present were Mayor Langohr, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, City Manager Fryslie, Ass't. City Manager Keyes, Acting City Attorney O'Connell and the Clerk. Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held 1 December 1971 were approved as read: Authorization to Purchase 30 5/8" X 3/4" Water Meters - $1,100.00: The Water department has need for 30 5/8" X 3/4" water meters at an approximate cost of $1,100.00 and the City Manager requested authority to purchase the meters. It was moved by Commissioner Sedivy, seconded by Commissioner Grabow, that the City Manager be given authority to purchase the water meters at an approximate cost of $1,100.00 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer and Mayor Langohr; those voting No, none. Authorization to Purchase 250 lengths of Sewer Rod - $750.00: The City has need for 250 lengths of Sewer rod in the approximate amount of $750.00 and the City Manager requested authority to purchase the Sewer Rods. It was moved by Commissioner Grabow, seconded by Commissioner Lehrkind, that the purchase.of the Sewer rods be approved and the motion was carried by the following Aye and N vote: those voting Aye being Commissioner Grabow, Commissioner " Lehrkind, Commissioner Vollmer, Commissioner Sedivy and Mayor Langohr; those voting No, none. Resolution No. 1499 - Intent to Annex 241,2653 Acres - No. East Annexation Hearing 5 January 1972.: Commission Resolution No. 1499 declaring the City Commissions intention to annex an area in the amount of 241,2653 acres to the present City Limits along North Rouse Avenue and Bridger Road, entitled: Commission Resolution No. 1499 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE TO THE BEST INTEREST OF THE CITY OF BOZEMAN AND THE INHABITANTS THEREOF AND OF THE INHABITANTS OF A TRACT OF LAND CONTIGUOUS TO lHE SAID CITY OF BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS TRACT WIlHIN mE CORPORATE LIMITS THEREOF. AS PREPARED by the City Attorney was presented. The City Manager recommended that the Commission adopt the Resolution and it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the resolution be passed and adopted and that 5 January 1972 be the date set for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none. AgreemenL - MSU to Place Mobile Laboratory at Waste Water Treatment Plant: A proposed agreement for the purpsoe of placing a mobile laboratory at the Waste Water Treatment Plant to connect to existing and/or constructed facilities to operate the laboratory as a classroom and research facility between the City of Bozeman and the Montana State University was presented. An annual fee of Fifty dollars ($50.00) will be paid to the City of Bozeman beginning 1 July 1972. Following a discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the Agreement be approved and the Mayor and Clerk of the Commission be authorized and directed to sign the Agreement for the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind and Mayor Langohr; those voting No, none. Street Network and Critical Points for Traffic Study: The City Manager announced that a meeting had been held with representatives of the planning and survey division of the Montana Highway Department concerning a traffic study of primary and sec- ondary highways and arterial streets in the City of Bozeman. A map delineating the streets was I presented and the following priorities discussed. 1. Improvement of the West College Street - U.S. 191 Intersection. 2. Installation of Traffic Lights on Main Street at Third and Fifth Avenues. 3. The one-way couplet on Babcock Street and Mendenhall Street from Eleventh Avenue to Rouse or Wallace Avenue. I I 4. An additional right-of-way on Main Street at the Seventh and Eighth Avenue to Rouse or Wallace Avenue. I I I NOTICE 24 64 299 319 605 465 913 1010 A thorough discussion followed and it was moved by Commissioner Grabow, seconded by Commissioner Lehrkind, that the network of streel and the above priorities be approved and submitted to the High- way Department for a recommended Traffic study and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy and Mayor Langohr; those voting No, none. Plans & Specifications for Approval - SID No. 505, South 20th Avenue Watermains: Open Construction Bids 5 January 1972, Sale of Bonds 12 January 1972: Plans and Specifications covering the proposed improvements in Special Improvement District No. 505 for the construction of Watermains on South 20th Avenue, as prepared by Thomas, Dean & Hoskins, consulting engineers was placed before the Commission. In concurrence with the consulting engineers, theCity Manager recommended that the plans and specifications as presented be approved and that a call for construction bids and a sale of the District Bonds in the maximum amount of $30,000.00 be authorized. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the plans and specifications be approved and the Clerk of the Commission be authorized and directed to publish a "Call for Bids" for the construction of the improvements for Special Improvement District No. 505 with an opening date of 5 January 1972, and to advertise for bids for the sale of the bonds in the approximate amount of #30,000.00 to be received 12 January 1972 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none. Leave of Absence - City Manager Fryslie, 6 January 1972 to 19 May 1972: To attend U.S. Army Command & General Staff College: The City Manager announced that he had been given the opportunity to attend the U. S. Army Command & General Staff College at Fort Levensworth, Kansas, from 6 January 1972 to 19 May 1972 and requested that he be granted a leave of absence without pay during that time and that Ass't. City Manager Keyes be appointed as Acting City Manager during this time. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that City Manager Fryslie as requested be granted a Leave of Absence without pay for the purpose stated abmeand that Ass't City Manager Keyes be appointed as Acting City Manager during this time and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Gra- bow, Commissioner Lehrkind and Mayor Langohr; those voting No, none. Commission Resolution No. 1498 - Certificate of Delinquent Taxes: Commission Resolution No. 1498, certifying delinquent taxes in the amount of $36,968.82 to the Gallatin County Treasurer was presented, entitled: COMMISSION RESOLUTION NO. 1498 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DECLARING CERTAIN SPECIAL ASSESSMENTS AND INSTALLMENTS OF SPECIAL ASSESS- MENTS, DUE AND PAYABLE NOVEMBER 30, 1971, AND UNPAID AS OF THAT DATE, AND CERTAIN OTHER SPECIAL ASSESSMENTS AND INSTALLMENTS OF SPECIAL ASSESSMENTS, DUE AND PAYBLE NOVEMBER 30, 1971, AND UNPAID, DELINQUENT, AS PROVIDED BY CHAPTER 2.32 6F THE BOZEMAN MUNICIPAL CODE AND SECTION 11-2233, POLITICAL CODE, R.C.M., 1947. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrklnd, Commissioner Vollmer, Commissioner Sedivy and Mayor Langohr; those voting No, none. Reports: The following reports werepresented: Building Inspector Director of Finance Librarian Fire Chief Fluoridation Police Chief The City Manager commented on the above reports and recommended approval thereof. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none. Diteman Construction Claim: The City Manager presented pay estimate No. 1 for Watermain Improvements in Special Improvement District No. 503 with City of Bozeman claim attached, each dated 29 November 1971, the claim being for payment of $16,741.00 to Wallace Diteman, Inc., as provided in contract documents of Special Improvement District No. 503. The City Manager also advised the Commission that he had received an assignment of monies due under this contract on 3 November 1971 whereby Wallace Diteman, Inc., assigned all monies and payments over to the Security Bank & Trust Company of Bozeman. Also filed with the City Manager is correspondence dated 12 November 1971 and 8 December 1971 from R. J. And- riola acting s Attorney for U.S.F.&G., the Bonding Company for this contract instructing the City ;II of Bozeman that no payments shall be made under this contract except with the expressed wtitten approval of the Bonding Company. Also corr~pondence from Page Welcome, Attorney, dated 2 December 1971 demanding that the City of Bozeman immediately pay all amounts due under this contract to the Security Bank & Trust Company. Following a discussion of correspondence from the City Manager to all parties concerned and other circumstances surrounding this contract and upon advise of the City Attorney concurred in by the City Manager, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the claim presented not be approved for payment at this time pending clarification of the legal questions the 1ega1ll The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissio:ner Sedivy, Commissioner Grabow, Commissioner tehrkind and Mayor Langohr; those voting No, none.
