HomeMy WebLinkAbout1971-12-15 206 Bozeman, Montana 15 December 1971 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 15 December 1971, at 1:15 o'clock p.m. Present were Mayor Langohr, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, City Manager Fryslie, Ass't. City Manager Keyes, Acting City Attorney O'Connell and the Clerk. Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held 8 December 1971 were approved as read. Grant Deed to Montana Power Company - 0.08 Acre on North Rouse: A Grant Deed conveying to the Montana Power Company a tract of land located in the NW~NE~ Section 6, Township 2 South, Range 6 East, M.P.M., Gallatin County, Montana, and containing 0.08 acres of land along with a check from the Montana Power Company in the amount of $200.00 for the purchase of the land from the City of Bozeman was presented. The deed includes a reversion clause in event present use of the land is discontinued. Following a discussion, it was moved by Commissioner Sedivy, seconded by Commissioner Grabow, that the Grant Deed between the Montana Power Company and the City of Bozeman be entered into and the Mayor and the Clerk be authorized and directed to execute the Grant Deed conveying unto the Power Company a tract of land in the amount of 0.08 acres and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer and Mayor Langohr; those voting No, none. Discussion - Diteman Construction Claims: SIn 1/:503: Attorneys H. A. Bolinger, Jr., representing Wallace Diteman. Inc., and the Security Bank & Trust Company and R. J. Andriolo representing U.S.F.& G. were present for a discussion with the City Comm-- ission concerning its action of 8 December 1971 withholding payment of monies due pending clerifi- cation of legal questions. Following a lengthy discussion, the City Manager was instructed to secure a recommendation concerning this matter from an attorney not associated with the firms Berg, O'Connell, Angel and Andriolo or Bolinger and Welcome for presentation to the Commission at its next regular sche- duled meeting, 22 December 1971. Norm Wallin & Vern Koelzer, regardin~ Sidewalks: Mr. Norm Wallin and Mr. Vern Koelzer appeared before the Commission in regard to placing side- walks in front of their place of business. They advised the Commission, that they felt it was not necessary to place sidewalks on the Southside of Main Street in that area and asked that the State Highway Department abandon their thoughts of putting sidewalks on the South side of the Street. A thorough discussion followed and the City Commission thanked Mr. Wallin and Mr. Koelzer for coming and stated they would take the request under advisement. Petition Concerning University Subdivision - Traffic & Zoning: A petition signed by 104 property owners or interested persons in and around the University Subdivision expressing their concern over the current traffic conditions on East Garfield Street and requesting that the City Commission establish a building permit moratorium until additional acc- esses are provided and also requesting that the City change the zoning in this area from"C"Resid- entia1 to "A" Residential was presented. Mr. John Breeden was also present to express his interest and concern in regard to the traffic conditions in this general area. Following a thorough discussion and upon recommendation of the City Manager, it was moved by Commissioner Grabow, seconded by Commissioner Lehrkind, that this matter be referred to the Planning Board for their recommendation and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy and Mayor Langohr; those voting No, none. Request to Vacate South Rouse Avenue - Garfield To Cleveland: A request from the Mount Blackmore Development Corporation requesting vacation of South Rouse Avenue between East Cleveland And East Garfield Streets along with a recommendation from the City County Planing Board was presented. The Planning Board at their meeting of 8 December recommended that the City Commission not vacate South Rouse Avenue due to the fact that this area is in need of additional North-South arterial. Following a thorough discussion and in concurrence with the recommendatiobs of the City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the request from the Mount Blackmore Development Corporation requesting vacation of South Rouse Avenue be denied and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, I I I I I I Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none. Request to Conduct Christmas March, Young Life - 18 December 1971: A letter received from Young Life requesting permission to conduct a Christian March on 18 Dec- ember 1971, at 7:30 o'clock p.m. to begin at the Bozeman Senior High School and ending at Willson Avenue and Main Street was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the Christian March be granted as requested and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind and Mayor Langohr; those voting No, none. Reports The following reports were presented. Director of Public Service Police Judge The City Manager commented on the reports and recommended approval thereof. It was moved by Commissioner Sedivy, seconded by Commissioner Grabow, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer and Mayor Langohr; those voting No, none. Commission Resolution No. 1500 - Covenants & Terms of Bonds - SID No. 502: Commission Resolution No. 1500 authorizing the issuance and terms of Bonds of Special Improve- ment District No. 502 was presented, entitled Commission Resolution No. 1500 RESOLUTION CONFIRMING SALE OF $450,000 SPECIAL IMPROVEMENT DISTRICT NO. 502 BONDS, AND PRESCRIBING '!HEIR FORMS AND TERMS AND COVENANTS OF THE CITY FOR THE SECURITY OF TIlE HOLDERS THEREOF. It was moved by Commissioner Grabow, seconded by Commissioner Lehrkind, that the Resolution be passed and adopted and the motion was carried by the following Aye and No vote; Those voting Aye being Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, and Mayor Langohr; those voting No, none. Adjournment: There being no further business to come before the Commission at this time, it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Grabow, Commissioner No, none.
