Resolution 4749, CO4 with Saunders Line for Conduit Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: David Fine, Economic Development Specialist Chris Naumann, Executive Director, Downtown Bozeman Partnership SUBJECT: Resolution 4749, Approving Change Order No. 4 for the 2016 Downtown & Midtown Conduit Project MEETING DATE: November 21, 2016 AGENDA ITEM TYPE: Consent RECOMMENDATION: Approve Resolution 4749, a change order for the 2016 Downtown & Midtown Conduit Project. BACKGROUND: Attached is a copy of change order number 4 for the above referenced project. This change order includes the addition of multiple ducts of conduit that can serve the Downtown and Midtown business districts and continue the expansion the City’s conduit system. A description of the work and a spreadsheet of the quantities are included with the change order documents. Overall this change will increase the contract price by $45,152.49 and will add 8 days to the contract time. The final recommended change in cost and time for these items is reasonable and commensurate with the work involved. The change orders for this project, including this one, reflect an expanded scope of work rather than cost overruns on this initial scope of work. We also are purchasing surplus material for future use in expansion of the conduit system. UNRESOLVED ISSUES: None ALTERNATIVES: As suggested by the City Commission. FISCAL EFFECTS: Overall this change order increases the contract amount by $45,152.49 from $968,545.97 to $1,013,698.46 and will be paid for with approved funding for conduit expansion in the Downtown Urban Renewal District and Midtown Urban Renewal District FY 2017 Budgets. GENERAL INFORMATION This document was developed to provide a uniform format for handling contract changes that affect Contract Price or Contract Times. Changes that have been initiated by a Work Change Directive must be incorporated into a subsequent Change Order if they affect Price or Times. Changes that affect Contract Price or Contract Times should be promptly covered by a Change Order. The practice of accumulating Change Orders to reduce the administrative burden may lead to unnecessary disputes. If Milestones have been listed in the Agreement, any effect of a Change Order thereon should be addressed. For supplemental instructions and minor changes not involving a change in the Contract Price or Contract Times, a Field Order should be used. B. COMPLETING THE CHANGE ORDER FORM Engineer normally initiates the form, including a description of the changes involved and attachments based upon documents and proposals submitted by Contractor, or requests from Owner, or both. Once Engineer has completed and signed the form, all copies should be sent to Owner or Contractor for approval, depending on whether the Change Order is a true order to the Contractor or the formalization of a negotiated agreement for a previously performed change. After approval by one contracting party, all copies should be sent to the other party for approval. Engineer should make distribution of executed copies after approval by both parties. If a change only applies to price or to times, cross out the part of the tabulation that does not apply. 83 Page 1 of 1 CONTRACTOR UNIT PRICING DOWNTOWN/ MIDTOWN CONDUIT ROUTES CHANGE ORDER NO. 4 SAUNDERS LINE CONSTRUCTION, INC.
