HomeMy WebLinkAbout1971-12-22 208 Bozeman, Montana 22 December 1971 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 22 December 1971, at 1:15 o'clock p.m. Present were Mayor Langohr, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, City Manager Fryslie, Ass't. City Manager keyes, Acting City Attorney O'Connell and the Clerk. Commissioner Grabow opened the meeting with a prayer and the following proceedings were had: Minutes of the Regular meeting held 15 December 1971 were approved as corrected. Pay Estimate No.1, SID 503, Wallace Diteman, Inc.,: Pay Estimate No. 1 for Watermain Improvements in Special Improvement District No. 503 along with the claim for payment of $16,741.00 to Wallace Diteman, Inc., as provided in contract documents of Special Improvement District No. 503 was again presented. A letter received from Richard J. Andriolo representing U.S.F. & G. stating that the interest of U.S.F. & G. and Security Bank and Trust Company are not in conflict and in order to facilitate payment of the amounts expended for labor and material, U.S.F. & G. Company does hereby authorize the City of Bozeman to pay to the Sec- urity Bank & Trust Company the amount which Security Bank & Trust Company can verify by paid receipts or other acceptable means that it has paid for labor and material in connection with said SID No. 503 was presented along with a letter from Attorneys Holter and Heath who are not associated with the firms Berg, O'Connell, Angel and Andriolo or Bolinger and Welcome stating that after reviewing the legal proceedings of SID No. 503 together with pertinent correspondence and other allied material it was their opinion that until the issues raised in cause 19843 have been resolved, the City of Bozeman may legally pay only that portion of claim of Wallace Diteman, Inc.,dated 19 November 1971, representing monies paid by the Security Bank and Trust Company for Labor and material used in con- struction of SID No. 503. They further recommended that Thomas, Dean & Hoskins, Inc., engineers for Special Improvement District No. 503 verify to the City of Bozeman the labor and material bills paid by the Security Bank & Trust Company. Jim Cummings in behalf of consulting engineers Thomas, Dean & Hoskins certified that the cost exceeded the estimate and recommended payment of Pay Estimate No.1, dated 29 November 1971 to the Security Bank & Trust Company in the amount of $16,741.00. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the Pay Estimate be approved and a cl~im in the amount of $16,741.00 be made to the Security Bank & Trust Company and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind and Mayor Langohr; those voting No, none. Alarm System - South Side Water Reservoir: The City has need for an Alarm System for the Bozeman Creek Reservoir and the City Manager requested authority to purchase an Alarm System from Sparling Company in the amount of $3.353.00 for the Bozeman Creek Reservoir to be placed at the Police Station. The installation of this equipment would eliminate overtime now being paid the employees for checking equipment on weekends and holidays. The Alarm System would also give twenty-four hour surveillance of chlorination equipment. Following a discussion, it was moved by Commissioner Sedivy, seconded by Commissioner Grabow, that the City Manager be granted authorization to purchase the Alarm System from Sparling Company with shipment to be made within sixty days. The motion was carried by the following Aye and No vote: Those voting Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, and Mayor Langohr; those voting No., none. Request for Circus License - M.S.U. 11-13 August 1972: A letter received from Bud Purdy Fieldhouse Manager requesting permission to obtain the proper license to hold Ringling Bros,. Barnum & Bailey Circus on 11, 12, and 13 August 1972 for six per- formances was presented. He also requested the Commission to protect Montana State University thirty days prior and fourteen days after the date of the circus from issuing any license for a circus or carnival to any other organization. It was moved by Commissioner Grabow, seconded by Commissioner Lehrkind, that the request to obtain the proper license be approved, but that no official action be taken on the request that other licenses not be issued for thirty days prior or fourteen days sub- sequent to 11 August 1972 but that the request be thoroughly considered if any further applications are received and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, and Mayor Langohr; those voting No, none. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded by Comm- issioner vollmer, that the above applications be approved and the Director of Finance be directed to issue license in accordance therewith and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none. I Reports: The following reports were presented. Cemetery Cashier Water Collector Director of Finance The City Manager commented on the reports and recommended approval thereof. It was I moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Vollmer, Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind and Mayor Langohr; those voting No, none. Plans and Specifications SID No. 504, Paving Tamarack & Aspin Street Between 5th & 7th, $62;000.00: Plans and Specifications covering the proposed improvement in Special Improvement District No. 504 paving West Aspen Street to West Tamarack Street from North Fifth Avenue to North Seventh Avenue prepared by Thomas, Dean and Hoskins; Inc., consulting engineers were placed before the Commission. In concurrence with the consulting engineers, the City Manager recommended that the plans and spec- ifications as presented be approved and that a call for construction bids and a sale of the District Bonds in the maximum amount of $62,000.00 be authorized. It was moved by Commissioner Sedivy, se- conded by Commissioner Grabow, that the plans and specifications be approved and the Clerk of the Commission be directed to publish a "Call for Bids" for the construction of the improvements with an opening date of 19 January 1971 and to advertise for bids for the sale of the bonds of District No. 504 in the approximate amount of $62,000.00 to be received 26 January 1971 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, and Mayor L8ngohr; those voting No, none. Police False Arrest Insurance: It was moved by Commissioner Grabow, seconded by Commissioner Lehrkind, that the Commission accept the Police False Arrest Policy insuring twenty-three police officers & the City Attorney at $40.00 per officer or a total premium of $960.00 and the motion was carried by the following Aye and No vote; Those voting Aye being Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer; Commissioner Sedivy and Mayor Langohr; Those voting No, none. .Ad journmen t: It was moved by Commissioner Grabow, seconded business to come before the Commission they wish everyone a Merry Chr The motion was carried by the following Aye and No vote: those votin Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy and no further e adjourned. abow, g No, none. ission 209
