HomeMy WebLinkAbout1971-12-29 210 Bozeman, Montana 29 December 1971 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Build ing, 29 December 1971, at 1:15 o'clock p.m. Present were Mayor Langohr, Commissioner Grabow, Comm- issioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, City Manager Fryslie, Ass't. City Manager Keyes, Acting City Attorney O'Connell and the Clerk. Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had: Minutes of the regular metting held 22 December 1971 were approved as corrected. Application for Beer & Liquor Licenses for 1972: The following applications for City Beer and Liquor Licenses, together withthe required fee were presen ted. NAME LIQUOR !lliID!. In con currence with the recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the above applications be approved and the Director of Finance be dir- ected to issue license in accordance therewith and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none. Ordinance No. 911 - Amend Ordinance No. 910, Area of Vacated Aspen Street: Ordinance No. 911 amending Section 1 of Ordinance No. 910 of the Bozeman Municipal Code of the City of Bozeman vacating a portion of Aspen Street was presented, entitled AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 910 OF THE Ci ty OF BOZEMAN VACATING A PORTION OF ASPEN STREET LYING BETWEEN LOTS 25 THROUGH 32 INCLUSIVE, OF BLOCK 109, AND LOTS 1 THROUGH 8 IN- CLUSIVE, OF BLOCK 108, NORTHERN PACIFIC ADDITION TO BOZEMAN, MONTANA. Following a discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the proposed Ordinance No. 911 amending Ordinance No. 910 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commiss- ioner Sedivy, Commissioner Grabow, Commissioner Lehrkind and Mayor Langohr; those voting No, none. Ordinance No. 912 - Amend Traffic Code on D.W. L to conform with State Law: Ordinance No. 912 amending Title 11, Chapter 11.04 Traffic Code of the Bozeman Municipal Code of the City of Bozeman to conform with the State Law was presented, entitled: AN ORDINANCE AMENDING TITLE 11, CHAPTER 11.04 of THE BOZEMAN MUNICIPAL CODE BY REDUCING THE AMOUNT OF ALCOHOL NECESSARY TO PRESUME A PERSON UNDER THE INFLUENCE OF INTOXICATING LIQUOR AND DEFINING THE BASIS FOR DETERMINING THE SAME. It was moved by Commissioner Sedivy, seconded by Commissioner Grabow, that Ordinance No. 912 amending Ordinance No. 837 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer and Mayor Langohr; those voting No, none. Authority to Contract for Landfill Utilization Plan: A letter received from Thomas, Dean & Hoskins, Inc., submitting a proposal for preparation of an operation plan for the Sanitary Landfill for the City of Bozeman, located northeast of the City, containing approximately 200 acres was presented. Thomas, Dean & Hoskins, Inc., will prepare a plan to illustrate the staging of the Landfill operation and will show the location and sequence of each trench to be excavated and the Traffic patterns to provide access in and out of each area of the landfill site. Areas will be designated for special use. The plan will also indicate the use of permanent and portable fencing to control blowing papers and the traffic patterns. The development plan will be designed to divert surface water runoff from the areas of excavation and filling. Cross sections will be prepared to illustrate the depth of trench excavation with relation to the existing ground, the location for stockpiling cover material, and the final grades upon completion of the operation in each area. The final grades I I I I I I proposed will be designed to allow the land to be returned to agricultural uses. A report will accompany the plan. The engineering fee for the above described services shall be $1,975.00 and the plan will be completed within forty-five days after receipt of the topographic maps of the area. Following a thorough discussion, it was moved by Commissioner Grabow. seconded by Commissioner Lehrkind, that the contract for the proposed landfill plan for the Sanitary Landfill be entered into and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy and Mayor Langohr; those voting No. none. Adjournment: There being no further business to come before the Commission at this time, it was moved by Commissioner Grabow, seconded by Commissioner Lehrkind, that th meeting be adjourned and the motion was carried by the following Aye and No vote: those vot ng Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedi No, none.
