HomeMy WebLinkAbout1971-09-29 176 Bozeman, Montana 29 September 1971 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 29 September 1971, at 1:15 o'clock p.m. Present were Mayor Langohr, Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy, City Manager Fryslie, Ass't. City Manager Keyes, Acting City Attorney O'Connell and the Clerk. Commissioner Vollmer, opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held 22 September 1971 were approved as read. Authorize Absence of Commissioner Lehrkind: In concurrence with the recommendation of the City Manager, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the absence of Commissioner Lehrkind be authorized in compliance with Section 11-3245, R.C.M., 1947. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Grab9w; those voting No, none. Open Bids, 8,000 G.V.W. Truck for Water Department: This was the time and place set for opening bids for one 1972 Model Four Wheel Drive, 8,00~f G.V.W. Truck for the Water Department. The affidavit of publication of the "Call for Bids" was pre- sented. It was moved by Commissioner Sedivy, seconded by Commissioner Grabow, that the bids be opened and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner Vollmer and Mayor Langohr; those voting No, none. The following bids were then opened and read: Kamp Implement Company Belgrade $3,949.00 Owenhouse Hardware Company Bozeman 3,885.00 Rolfe & Wood Bozeman 3,999.99 Upon recommendation of the City Manager, it was moved by Commissioner Grabow, seconded by Comm- issioner Vollmer, that the bids be referred to the City Engineer and the Water Superintendent for checking and recommendation to be made to the Commission at their next meeting on Wednesday, 6 Oct- ober 1971. The motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Grabow, Commissioner Vollmer, Commissioner Sedivy and Mayor Langohr; those voting No, none. Open Bids - 1/4 Ton 4 X 4 Truck for Street Department: This was the time and place set for opening bids for one 1972 one-quarter ton 4 X 4 truck for the Street Department. Affidavit of publication of the "Call for Bids" was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none.' Hearing & Final Adoption, Res. No. l488, Assess Weed Abatement 1971t: This was the time and place for the public hearing on levying assessment for the extermination and removal of noxious weeds for the year 1971 in the amount of $1,079.75. Affidavit of publication of Notice was presented. No one was present to protest and no written protests having been filed, Resolution No. 1488 provisionally passed and adopted at the regular session held September 22, 1971 was presented for final passage. In concurrence with the recommendation of theCity Manager, it was moved by Commissioner Grabow, seconded by Commissioner Vollmer, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those votingAye being Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy and Mayor Langohr; those voting No, none. Reques t for SID to Cons truc t \Ja ter Main on South 20th Avenue: A letter received from Eugene Graff for the creation of a Special Improvement District for the installation of water lines on 20th Street South of Babcock Street, was presented. Following a discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the City Eng.- ineer and the City Attorney be instructed to prepare a resolution initiating a Special Improvement District for the installation of the water lines and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none. I I I I I I Resolution No. 1492 - Intent to Vacate a Portion of Alley, Block E, Tracy Addition: Commission Resolution No. 1492 set forth as follows: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO VACATE THAT PORTION OF THE ALLEY OF BLOCK E OF TRACY'S ADDITION TO BOZEMAN, MONTANA, LYING BE'lWEEN AND ABUTTING ON LOTS THREE (3) TO NINE (9) INCLUSIVE AND LOTS FORTY (40) AND FORTY-SIX (46) inclusive. prepared by the City Attorney as directed by the Commission to vacata a portion of Alley, Block E., Tracy Addition was presented. Following a brief discussion, it was moved by Commissioner Sedivy, seconded by Comm~sioner Grabow, that Commission Res olution No. 1492 be passed and adopted and 27 October be set as the date for public hearing, it was then moved by Commissioner Sedivy, seconded by Commissioner Grabow, that the motion be amended to adopt the resolution to include a clause that the land would revert back to the City of Bozeman if none of the additions are begun within one year. On the motion to amend those voting Aye being Commissioner Sedivy, and Commissioner Vollmer, Commissioner Grabow abstained; those voting Aye on the Amended Motion were Commissioner Sedivy and Commissioner Vollmer; Commissioner Grabow abstained. Proclamation, "Fire Prevention Week" 3-9 October 1971 - Breakfast 4 October: Mayor Don M. Langohr, announced his proclamation designating the week of 3-9 October 1971 as "Fire Prevention Week.~ The Fire Chief reported a breakfas~ to which the public is invited, will be served at the Bozeman Fire Hall on Monday, 4 October 1971, from 6:30 o'clock a.m. to kick off the annual Fire Prevention Week activities and that the City Fire Department has scheduled a full program for the entire week. It was moved by Commissioner Grabow, seconded by Commissioner Vollmer, that the Mayor's proclamation and the program of the Fire Department be concurred in and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Comm- issioner Vollmer, Commissioner Sedivy and Mayor Langohr: those voting No, none. Approve & Accept Deeds & Easements SIn No. 502 - Right-of-way: Holy Rosary High. School Albert & Ramona Michel G. Moss & D. A1berda Joseph & Mary Strozzi The Utility and Right-of-Way Easements Louise Nickey James & Josephine Placek Sara P. Richards School District No. 7 and Deeds from each of the above property owners for the installation, operating, using, repairing, replacing, maintaining and removing a utility line and appurtenances thereto upon and across their property lying within the City of Bozeman, County of Gallatin, State of Montana, was presented. The City Manager recommended that the City enter into the Agreement approved as to form by the City Attorney and it was moved by Commissioner Vollmer, sec- onded by Commissioner Sedivy, that the Easement Agreements be Bntered into by the City and the Mayor and the Clerk be authorized and directed to sign for the City and that the claim for $50.00 attached to the following easements as payment thereor be approved and ordered paid. Conti rma tion, Police Officer Ronald S. Morton: A letter received from Chief of Police Robert Johnson, concurred in by the City Manager, in- forming the Commission that Officer Ronald S. Morton had satisfactorily completed the required six- month probationary period and recommending that Officer Ronald S. Morton be confirmed as a regular officer of the Bozeman Police Department effective 24 September 1971 was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Grabow, that the confirmation of officer Ronald Sidney Morton be approved and that he be congratulated on completing his probationary period and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner Vollmer and Mayor Langohr; those voting No, none. Authority to Conduct MSU Homecoming Parade, 16 October 1971: A letter from C.C. Dye, Assistant Director of Public Service, Montana State University, requesting permission to stage their annual Homecoming Parade on Saturday, 16 October 1971 at 10:00 o'clock A.M. was presented. The parade will begin at Buttreys Shopping Center Parking Lot on to West Main Street and proceed down Main Street to Rouse Avenue. Following a discussion, it was moved by Commissioner Sedivy, seconded by COmmissioner Grabow, that permission to stage the parade be granted with the recommendation that the parade proceed down Main Street to Church Avenue to allow an easier return to the MSU Campus. The motion was carried by the following Aye and No vote: those voting Aye 177 178 being Commissioner Sedivy, Commissioner Grabow, Commissioner Vollmer and Mayor Langohr; those voting No, none. Promotion of Firefighter Henry Wruck to Captain - 1 October 1971: Subsequent to a letter received from Fire Chief Jack Huber recommending the appointment of Firefighter Henry Wruck to Captain and the City Manager having concurred in his recommendations, appointed Firefighter Henry Wruck to Captain effective 1 October 1971. It was moved by Commiss- ioner Vollmer, seconded by Commissioner Sedivy, that the Commission concur in the appointment of Firefighter Henry Wruck to Captain effective 1 October as announced by the City Manager and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none. Reports: The following reports were presented: Librarian Water Collectors Report The City Manager commented on the reports and recommended the approval thereof. It was moved by Commissioner Grabow, seconded by Commissioner Vollmer, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy and Mayor Langohr; those voting No, none.
