Present were Mayor Langohr, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, City Manager Fryslie, Ass't. City Keyes, City Attorney Berg and the Clerk. Commission Sedivy opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held 29 September 1971 were approved as corrected. Absence of Commissioner Grabow Authorized: In concurrence with the recommendation of the City Manager, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the absence of Commissioner Grabow be authorized in compliance with Section 11-3245, R.C.M., 1947. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow, Commissioner Lehr- kind and Mayor Langohr; those voting No, none. Request - J.B. Phillips to Locate Trailer to Dispense Mexican Food: Mr. J. B. Phillips appeared before the City Commission to Appeal the denial by the City Manager of his application for a business license to operate his mexican food establishment from a trailer at 903 West College Street in Bozeman and request that the City Commission authorize and direct the license to be issued. Discussion revealed that Mr. Phillips had twice applied for such a license most recently on 29 September 1971 and in each case the license had been denied by the City Manager by reason of provisions in the zoning code prohibiting conducting a business from a trailer within the City of Bozeman, except in authorized zones and areas. Also off-street parking requirements cannot be met by Mr. Phillips on the property at 903 West College Street. The City Manager also expressed the opinion that the trailer owned by Mr. Phillips would not comply with the uniform building code as adopted and in effect within the City of Bozeman. Mr. Phillips contended he was being singled out and discriminated against in the matter. Following considerable discussion, it was moved by Commissioner Sedivy, seconded by Commissioner Vollmer, that action on this matter be delayed for a period of one week to give the City Commission an opportunity to examine the proposed site and review the appropriate codes. The motion was carried by the following voting Aye, Commissioner Sedivy, Commissioner Vollmer and Commissioner Lehrkind, Commissioner Langohr voted No, with the City Manager expressing opposition to the delay. Consideration of Bi~s 8,000 lb. G.V.W. Truck: The Commission was referred to the opening of bids for the 1972 Model Four Wheel Drive, 8,000 lb. G.V.W. Truck for the Water Department. The bids having been studied in detail by the City Engineer and the Water Superintendent, it was found that the bid of OWenhouse Hardware Company, Bozeman, on the basis of their bid in the amount of $3,885.00 plus $115.00 additional for the auto- matic transmission it being the lowest bid and equaling or exceeding the specifications as con- tained in the "Call for Bids." The City Manager concurred with the recommendation of the City Engineer and Water Superintendent recommending that the purchase be awarded to Owenhouse Hardware Company on the basis of their bid in the total amount of $4,000.00, it being the lowest bid and conforming with the specifications as contained in the "Call for Bids." It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the purchase of the trucK be awarded to Owenhouse Hardware Company and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohrj those voting No, none. Consideration of Bids 1/4 Ton 4 X 4 Truck - Street Department: After tabulating and checking the bids for the one-quarter ton 4 X 4 Truck for use by the Street department that were opened at the previous meeting, the City Manager concurring with the City Engineer and the Street superintendent, recommended that the purchase be awarded to Kamp Implement Company, Belgrade, in the amount of $3,749.00, it being the lowest bid received and eq- ualing or exceeding the specifications as contained in the "Call for Bids." In concurrence with the recommendation of the City Manager, it was moved by Commissioner Vollmer, seconded by Commiss- ioner Sedivy, that the award be made to Kamp Implement Company, Belgrade, in the amount of $3,749.00 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind and Mayor Langohr; those voting No, none. 179 180 Confirmation of Police Oficer Mickey Ray Lessley: The Chief of Police reported that Police Officer Mickey Ray Lessley had satisfactorily com- pleted the required six month probationary period and recom~ended that Officer Lessley be con- firmed as a regular officer of the Bozeman Police Department effective 1 October 1971. The City Manager announced that he concurred in the recommendation of the Chief of Police subject to the approval of the Commission. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind that the confirmation of Police Officer Mickey Ray Lessley be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Grabow and Mayor Langohr; those voting No, none. Promotion of Police Officer Douglas Taylor to Sergeant: A letter received from the Chief of Police with the recommendation, that Officer Douglas C. Taylor be promoted to the rank of Sergeant effective 1 October 1971 was presented. The City Manager concurred in the recommendation of the Chief of Police and recommended that the City Commission concur in his promotion of Police Officer Douglas C. Taylor to Police Sergeant. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the Commission approve the promotion of Douglas C. Taylor to Sergeant effective 1 October 1971 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow, Commissioner Vollmer and Mayor Langohr; those voting No, none. Appointment of Director of Finance - William J. Verwolf: Mr. Eryslie announced his appointment of William J. Verwo1f, a native of Manhattan, to the position of Director of Finance effective 4 October 1971, to fill the vacancy created by Jim W. Smith who has recently accepted a position with the State Bank Examiners. It was moved by Commiss- ioner Sedivy, seconded by Commissioner Lehrkind, that the Commission concur in the appointment of William J. Verwolf as Director of Finance to become effective 4 October 1971 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Grabow and Mayor Langohr; those voting No, none. Agreeme~t - HB436-?54 Project 212 (12) - Gravel Purchase: The Agreement HB-42-436-254, Project No. 212 (12) between the Montana State Highway Commission and the City of Bozeman for the purchase of 3,000 tons of 1 1/2" gravel at $1.50 per ton, 4,000 tons 1/2" gravel at $1.50 per ton, and 2,000 tons 3/4" gravel at $1.50 per ton from Pioneer Ready Mix in the approximate amount of $3,556.96 to be used for maintenance of the streets of Bozeman was pre- sented. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the Agreement HB 42-436-254, Project 212(12) be approved as presented and the Mayor and the Clerk of the Commission be authorized to sign the Agreement for the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commiss- ioner Grabow and Mayor Langohr; those voting No, none. Authority to Conduct Candy Sale - Camp Fire Girls, 5-l4 November 1971: A letter received from Mrs. Ivan Smith, Secretary-Kegistrar of the Bozeman Council Camp Fire Girls requesting permission to conduct a candy sale 5i4 November was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that permission to hold the candy sale be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind and Mayor Langohr; those voting No, none. ~uthority to Conduct Fund Drive - MSU Bands, 9 October 1971: A letter received from Dr. Carl Lobltz, Director of Montana State University Bands to conduct a two hour fund raising drive on Saturday, 9 October 1971 in Downtown Bozeman by Montana State University band members was presented. It was moved by Commissioner Lehrkind, seconded by Commiss- ioner Vollmer, that permission to conduct the fund drive be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none. U.N.I.C.E.F. Drive - Friday, 29 October 1971. A letter received from Mrs. Carolyn Rogers reqyesting authority to conduct a U.N.I.C.E.F. drive to be held on Friday, 29 October 1971, between the hours of 4:00 to 7:00 o'clock p.m. was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Vollmer, that permission to conduct the fund drive as requested be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none. I I I I I I Au~hority to Call for Bids - SID 502, 27 October 1971 - Construction Bids: Advertise Bond Sale, 3 Novemher 1971: Plans and Specifications covering the proposed improvement in Special Improvement District No. 502 for the construction of a trunkline system of watermains for the westerly portion of Bozeman as prepared by Thomas, Dean, and Hoskins, Inc., consulting engineers were placed before the Comm- ission. In concurrence with the consulting engineers, the City Manager recommended that the plans and specifications as presented be approved and that a call for construction bids and a sale of the district bonds in the maximum amount of $450,000.00 be authorized. It was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that the plans and specifications be approved and the Clerk of the Commission be directed to publish a "Call for Bids" for the construction of the im- provements for the district with an opening date of 27 October 1971 and to advertise for bids for the sale of the bonds of SID 502 in the approximate amount of $450,000 to be received 3 November and the motion was carried by"tbe following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Grabow and Mayor Langohr; those voting No, none. Reports: The following reports were presented: Police Judge Building Inspector The City Manager commented on the reports and recommended the approval thereof. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Vollmer, Commissioner -Sedivy, Commissioner Grabow, Commissioner Lehrkind and Mayor Langohr; those voting No, none. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner SediVY, Commissioner Grabow and Mayor Langohr; those voting No, none. Arterial Streets & Traffic Control: A letter received from Chief of Police Robert K. Johnson with a list of recommendations in regard to creating some new arterial streets in Bozeman was presented. The City Manager did not request immediate action on the recommendation. The recommendations developed following some study of traffic conditions in Bozeman designated the following as arterial streets.: On the south side of Bozeman, College Street from Willson to Eighth should be made a through street. Parking is already restricted on the southside of the street so it will not be necessary to restrict any more parking. Story Street from Church through to Tracy Avenue should be made a through street. Re- stricted parking is also in force on the south side of Story. Black and Story already has stop signs erected so it will only be necessary to place them on Black Avenue, Dell Place and Bogarts Place. On the north side of Main Street, North Grand Avenue should be made a through street from Main to Tamarack and Tamarack from Grand to Rouse. It will be necessary to restrict parking on the east side of Grand Avenue. The east side is the most desirable, because of the location of the North Grand Ball Park and the Church and parking lot between Lamme and Beall. A four way stop to be placed at Grand and Mendenhall and continue the fourway stop at Peach and Grand. That West Mendenhall from Seventh through Eleventh be made a through street. This parti- cular portion of Mendenhall has a long history of serious automobile accidents. Steps should be taken to pave Mendenhall from Tenth to Eleventh. Beall Street from North Fifteenth through to North Twentieth should be made a through street. This would relieve 182 traffic on North Twentieth where the new Gibsons store is located. Following a thorough discussion of the recommended arterial streets, it was moved by Commissioner Sedivy, seconded by Commissioner Lehrkind, that arterial streets be designated including College Street between Willson and Eighth Avenue. Story Street between South Church and South Tracy Avenue. Willson Avenue from Mendenhall North. Beall Street from 15th Street west to the City Limits. Mendenhall Streets from Seventh Avenue to 11th Avenue, and that I the parking on the arterial streets will not be prohibited at tHB time and will remain as it is. Stop signs will be located at Streets intersecting the newly designated arterials, including a fourway stop at the intersection of Willson and Mendenhall. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Lehrkind, Commissioner Grabow, Commissioner Vollmer and Mayor Langohr; those voting No, none.
