MINUTES OF THE MEETING OF THE CITY COMMISSION
The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 13 October 1971, at 1:15 o'clock p.m. Present were Mayor Langohr, Commissioner Lehrkind,
Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy, City Manager Fryslie, Ass't City
Manager Keyes, City Attorney Berg and the Clerk.
Mayor Langohr opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held 6 October 1971 were approved as read.
Application for Business License - J.B. Phillips:
Mr. Phillips application for a business license to operate his Mexican food establishments from
a trailer at 903 West College Street in Bozeman was again presented following an examination of the
proposed site and review of the appropriate codes.
The City Manager again recommended that the application of the business license be denied by
reason of provisions in the zoning code prohibiting conducting a business from a trailer within
the City of Bozeman, except in authorized zones and areas and also that off-street parking
requirements cannot be met by Mr. Phillips. It was moved by Commissioner Grabow, seconded by
Commissioner Lehrkind, that the Commission concur with the recommendation of the City Manager and
move that the business license of Mr. Phillips be denied and the motion was carried by the following
Aye and No votes; those voting Aye being Commission Grabow, Commissioner Lehrkind, Commissioner
Sedivy and Mayor Langohr; those voting No, none; Commissioner Vollmer abstained.
Request for expanded Curb Opening - Spain, 2202 Highland Court:
A request from Mr. Louis Spain, 2202 Highland Court for zoning code variance from twenty feet to
twenty-three feet three inches at a new residence at 2202 Highland Court was presented. Following a
discussion, it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that they concur
with the recommendation of the City Manager and approve a twenty-three foot three inch curb cut
variance for a double garage at the new residence located at 2202 Highland Court and the motion was
carried by the following Aye and No vote; those voting Aye being Commissioner lehrkind, Commissioner
Vollmer, Commissioner Grabow, Commissioner Sedivy and Mayor Langohr; those voting No, none.
Deeds for Portion of Koch Street - 15th to 19th Streets:
The Warranty Deeds drawn by the City Attorney for street right-of-way on a portion of Koch
Street from Fifteenth to Nineteenth Avenue owned by James F. & Josephine Placek, Sara P.
Richards and School District No. 7 were presented. Following a discussion, it was moved by Commissioner
Vollmer, seconded by Commissioner Sedivy, that the Warranty Deeds be approved as recommended by
the City Manager and that the property conveyed to the city by those deeds be accepted for street
purposes and the motion was carried by the following Aye and No vote; those voting Aye being
Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind and Mayor
Langohr; those voting No, none.
Plans & Specifications - Cemetery Shop Bldg. "Call for Bids" open 10 November 1971:
Plans and specifications for the construction of the new Cemetery Shop Building as prepared
by Thomas, Dean & Hoskins, Inc., consulting engineers were placed before the Commission. The
City Manager recommended that the plans and specifications as presented be approved and that a
"Call for Bids" for the construction of the new Cemetery Shop Building be authorized with an opening
date of 10 November 1971. It was moved by Commissioner Sedivy, seconded by Commissioner Grabow,
that the plans and specifications be approved and the Clerk of the Commission be directed to publish
a "Call for Bids" for the construction of the building with an opening date of 10 November 1971
and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner
Sedivy, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer and Mayor Langohr; those
voting No, none.
Proclamation Nntional Business Womens Heek - 17-23 October 1971:
Mayor Langohr Announced his proclamation of 17-23 October 1971 as "National Business Womens
Week" in Bozeman. It was moved by Commissioner Grabow, seconded by Commissioner Lehrkind, that the
City Commission go on record as supporting the Mayor's proclamation presented by Mrs. Ione Moore,
President of the Bozeman Business & Professional Club. The motion was carried by the following Aye
and No vote; those voting Aye being Commissioner Grabow, Commissioner Lehrkind, Commissioner Lehrkind,
Commissioner Vollmer and Mayor Langohr; those voting No, none.
Kennel License Application - A.W. Clark - 1103 Cherry Drive:
An application received from Mr. A.W. Clark, 1103 Cherry Drive, requesting a kennel license
in accordance with Ordinance No. 857, Section 5.16.040 of the Bozeman Municipal Code, together

with the required fee was presented. The City Manager and the Chief of Police stated they were
not aware of any reason to deny the kennel license and it was moved by Commissioner Lehrkind,
seconded by Commissioner Vollmer that the above application be approved and the Director of Finance
be instructed and directed to issue a license in accordance therewith. The motion was carried by
the following Aye and No vote; those voting Aye being Commissioner Lehrkind, Commissioner Vollmer,
Commissioner Grabow, Commissioner Sedivy and Mayor Langohr; those voting No, none.
Resolution No. 11.82 - Assessing SID tl99, Pavi~n North Seventeenth, Beall to Durston: I
Commission Resolution No. 1482 leving final assessment for the paving construction on North
Seventeenth from Beall to Durston, SID No. 499 in the total amount of $65,310.55 was presented,

Resolution No. 1489 - Assess Walks & Curbs - $18,565.29:
Resolution No. 1489 assessing cost of repair, replacement or constrcution of sidewalks
and curbs for the year 1971 in the amount of $18,565.29 was presented, entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL
ASSESSMENT OF TAXES UPON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN,
STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND INSTALLING AND/OR REPAIRING
MISCELLANEOUS SIDEWALKS AND CURBS DURING THE YEAR 1971.
It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy that the resolution

Authority to purchase salt spreader - approximately $1,300.00:
The street Department has a need for a Salt Spreader at an estimated cost of $1,300.00
and the City Manager requested authority to purchase the Salt Spreader. It was moved by Commissioner
Sedivy, seconded by Commissioner Grabow, that the City Manager be granted authority to purchase the
Salt Spreader and the motion was carried by the following Aye and No vote; those being Aye were
Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer; those voting
No, none.

The City Manager commented on the reports and recommended the approval thereof. It was moved
by Commissioner Grabow, seconded by Commissioner Lehrkind that the reports be approved and ordered
filed and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner
Grabow, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy; those voting No being none.
HB 436 Fund Agreement - Road Oil:
The Construction Agreement HB 436 for the State Highway Project No. 212(13) for the construction
of streets of Bozeman and including the purchase of material, equipment rental and labor by the
Highway Maintenance forces under area No. 2220, Project No. 4643 and Account No. 3200 in the
approximate amount of $2,320.19 was presented.
It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer that the contract
documents be approved as presented and that the Mayor and Clerk of the Commission be authorized
to sign the agreements for the City of Bozeman and the motion was carried by the following Aye and
No vote; those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Grabow,
Commissioner Sedivy and Mayor Langohr; those voting No, none.
Authorize William J. Verwolf to Execute Checks for the City of Bozeman:
It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy that William J. Verwolf
be authorized to sign City of Bozeman checks as Director of Finance of the City of Bozeman as
recommended by the City Manager and the motion was carried by the following Aye and No vote; those
voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Lehrkind, Commissioner
Grabow and Mayor Langohr; those voting No, none.
Request to Hold Light Bulb Sale - October 20, 1971 Lions Club:
A request from the Bozeman Lions Club for permission to hold their annual Light Bulb Sale on
the 20th of October 1971 was presented. It was moved by Commissioner Sedivy, seconded by Commissioner
Grabow that permission to hold their annual Light Bulb Sale be granted and the motion was carried by
the following Aye and No vote; those voting Aye being Commissioner Sedivy, Commissioner Grabow,
Commissioner Lehrkind, Commissioner Vollmer and Mayor Langohr; those voting No, none.
Ad jourment:
There being no further business to come before the Commission at this time, it was moved by
Commissioner Sedivy, seconded by Commissioner Grabow that the meeting be adjourned and the motion
