The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 27 October 1971, at 1:15 o'clock p.m. Present were Mayor Langohr, Commissioner Grabow,
Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, City Manager Fryslie, Ass't. City
Manager Keyes, City Attorney Berg and the Clerk.
Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held 20 Oc tober 1971 were approved as read. I ;
Open Construction Bids: SID No. 502, Water Mains:
This was the time and place set for opening bids for the construction of Trunkline system water-
mains for the westerly portion of Bozeman SID No. 502. Affidavit of publication of "Notice to Bidders~
was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the bids
be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind and Mayor Langohr;
those voting No, none.
The following bids were then opened and read:
Cop Construction Company, Billings ---------$706,334.00
Felton Construction Company, Missoula ------- 548,947.20
Long Construction Company, Billings --------- 633,693.30
Lowe Construction Company, Billings --------- 599,731.80
C. W. Scmid Corporation --------------------- 535,908.64
The Commission concurred with the recommendation of the City Manager, and it was moved by Comm-
issioner Sedivy, seconded by Commissioner Grabow, that the bids be referred to the engineers repre-
senting consultant Thomas, Dean & Hoskins, Inc., and the City Engineer for final tabulation and
recommendation contingent upon the successful sale of the bonds held 17 November 1971 and the motion
was carried by the following Aye and No vote; those voting Aye being Commissioner Sedivy, Commissioner
Grabow, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy and Mayor Langohr; those
voting No, none.
fl.earing, Resoluti<m No. lL~92. Intent to vacate portion Alley, Block E, Tracy Addn. -Ordinance 909 Vacating:
This was the time and place set for public hearing of Commission Resolution No. 1492 on vacating I
a portion of the alley of Block E of Tracy's Addition to Bozeman, Montana. Affidavit of publication
of notice and the Clerk's certificate stating that all property owners had been notified as required
by law was presented. There being no one present to protest and no protests having been filed, it
was moved by Commissioner Grabow, seconded by Commissioner Lehrkind, that Ordinance No. 909, entitled
ORDINANCE NO. 909
AN ORDINANCE OF THE CITY OF BOZEMAN VACATING THAT PORTION
OF THE ALLEY OF BLOCK E OF TRACY's ADDITION TO nOZEMAN,
MONTANA, LYING BE'lWEEN AND ABUTTING ON LOTS TIIREE (3) to
NINE (9) INCLUSIVE AND LOTS FORTY (40) AND FORTY-SIX (46)
INCLUSIVE.
As prepared by the City Attorney vacating aportion of the Alley, Block E, Tracy's Addition be
passed and adopted. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy and Mayor
Langohr; those voting No, none.

This was the time and place set for hearing on levying assessment for the Collection and disposal
of garbage for the year 1971 in the amount of $125,350.67. Affidavit of publication of Notice was
presented. Mr. Jack Lovelace, a property owner, was present to protest and discuss the garbage assess-
ment. No written protests having been filed, it was moved by Commissioner Lehrkind, seconded by
Commissioner Vollmer, that the resolution be finally passed and adopted and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer,
Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none. I

An application for a one-half year off premise beer license along with the appropriate fee from
Phillip Clark Frey of the St. George and the Dragon located at 104 West Main Street was presented.
The City Manager stated he knew of no reason to deny this application and recommended approval thereof.
It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the application be approved
and the Director of Finance be instructed to issue the license and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commiss-
ioner Grabow, Commissioner Lehrkind and Mayor Langohr; those voting No, none.

Release of Bid Security of Three Top Bidders:
Following tabulation of the bids for the construction of Special Improvement District No. 502
and in concurrence with the recommendation of the consulting engineer, it was moved by Commissioner
Grabow, seconded by Commissioner Lehrkind, that the bid security of the three top bidders be released
and the bid security of the two low bidders be held. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer,
Commissioner Sedivy and Mayor Langohr; those voting No, none.
Reports:
The City Manager commented on the report of the Water Collector and recommended approval there-
of. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the report be
approved and ordered filed and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and
Mayor Langohr; those voting No, none.

There being no further business to come before the Commission at this time, it was moved by
Commissioner Vollmer, seconded by Commissioner Sedivy, that the meeting tJe djourned and the motion
