The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 3 November197l, at l:ls o'clock p.m. Present were Mayor Langohr, Commissioner Grab~w,
Commissioner Lerhkind, Commissioner Vollmer, Commissioner Sedivy, City Manager Fryslie, Ass't.
City Manager Keyes, City Attorney Berg and the Clerk.
Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held 27 October 1971 were approved as read.
Consideration of Construction Bids: SID No. 502 - Watermains:
The City Engineeer and the engineers representing consultant Thomas, Dean and Hoskins, Inc.,
having completed their study of the bids submitted for the construction of trunkline system water-
mains for the westerly portion of Bozeman SID No. 502 WSF-MT-OS-00-Q017 and having prepared a final
tabulation of the bids recommended that C. W. Scmidt Corporation, Missoula, be awarded the contract
on the basis of their low bid in the amount of $535,908.64. The City Manager in concurrence with
the recommendation of the consulting engineers, recommended that the Commission approve the above
bid contingent upon sale of the bonds to be held 17 November 1971, and HOO approval of the low bid.
It was moved by Commissioner Sedivy, seconded by Commissioner Grabow, that the contingent award of
the contract as recommended for construction of trunkline systems watermains for the westerly portion
of Bozeman, SID No. 502 be awarded to C. W. Schmidt, Inc., Missoula, on the basis of their low bid
submitted 27 October 1971 and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner Vollmer, Commissioner Lehrkind and
Mayor Langohr; those voting No, none.
Resolution No. l495, Intent to Vacate a Portion of Aspen Street:
Commission Resolution No. 1495:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO VACATE A
PORTION OF ASPEN STREET LYING BE'IWEEN LOTS 2S THROUGH 32 INCLUS-
IVE, OF BLOCK 109, AND LOTS 1 THROUGH 8 INCLUSIVE OF BLOCK l08,
NORTHERN PACIFIC ADDITION TO BOZEMAN, MONTANA.

prepared by the City Attorney as directed by the Commission to vacate a portion of Aspen Street lying I
between lots 25 through 32 inclusive, of Block 109, and lots 1 through 8 inclusive, of Block 108,
Northern Pacific Addition was presented.
It was moved by Commissioner Grabow, seconded by Commissioner Lehrkind, that Commission Resolu-
tion No. 1494 be passed and adopted and 1 December be set as the date for the public hearing and
the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow,
Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy and Mayor Langohr; those voting
No, none.
Authority to At~end Police Chief Meeti~ - Chief Johnson, l7-19 November, Glendive:
The Montana Association of Chief's of Police have scheduled a meeting to be held in Glendive,
17-19 November and the Chief of Police requested authority to attend the meeting. It was moved by
Commissioner Lehrkind, seconded by Commissioner Vollmer, that the Chief of Police be authorized to
attend the meeting, and , it being in the public interest the expenses be paid from the general fund
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those
voting No, none.
g,eport - Building Inspector:
The City Manager commented on the report of the Building Inspector and recommended the approval
thereof. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the report be
approved and ordered filed and the motion was carried by the following Aye and No vote: Those voting
Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind,
and Mayor Langohr; those voting No, none.

It was moved by Commissioner Sedivy, seconded by Commissioner Grabow, thata special meeting of
the City Commission be called for Friday, 5 November 1971 at 8:00 o'clock A.M., for the purpose of
canvassing the election returns. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind, Commissioner
Vollmer, Commissioner Langohr; those voting No, none.
Resignation o~ City. Attorney Berg, .,:Jr., - Elected to Constitutional Convention:
City Attorney Ben E. Berg, Jr., having been elected as a delegate to the Constitutional Conven-

tion stated he felt that he could not serve both the City as City Attorney and as a Constitutional
Convention delegate and thus tendered his resignation as City Attorney of the City of Bozeman.
The City Manager stated it was with mixed emotions that he accept the resignation of Ben E.
Berg, Jr., as City Attorney, a position he has held since 1962, and offered his sincere congrat-
ulations and best wishes as a Constitutional Convention delegate.
The City Manager announced his appointment of Michael J. O'Connell as Acting City Attorney
for the City of Bozeman.
It was moved by Commissioner Grabow, seconded by Commissioner Lehrkind, that they extend best
wishes to City Attorney Berg and concur in the City Managers appointment of Michael J. O"Connell
as Acting City Attorney. The motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Grabow, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Vollmer
and Mayor Langohr; those voting No, none.
Vaca tion fC?~gity Manager Harold A. Fryslie , 15-20 November 1971:
The City Manager requested that he be granted vacation leave of absence from 15-20 November
1971 inclusive, and that the Ass't City Manager be designated to perform the duties of the City
Manager during this time. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy,
that the request be granted and Ass't. City Manager Keyes be designated as Acting City Manager
during this period and the motion was carried by the following Aye and No vote: Those voting
Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind,
and Mayor Langohr; those voting No, none.
Claims:

The City Manager checked the claims and found them to be true and lawful claims against the
City of Bozeman and recommended they be approved and the Director of Finance be directed to issue
warrants in payment. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer,
that the claims be approved and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Cmmmissioner
Grabow and Mayor Langohr; those voting No, none.
Adjournment:
There being no further business to come before the Commission at this time, it was moved
by Commissioner Vollmer, seconded by Commissioner Sedivy, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those v ti
