Please vote to reclaim the Tap Room’s application for public comment.
I strongly oppose the approval of The Tap Room's application to modify it’s conditional
use permit to allow for serving hard alcohol.
The kids and teachers at Hawthorne Elementery in Bozeman have already had to
motify behavior to avoid young children's exposure to drunk behavior during
school hours. The original approval of this buisiness was a deliberate violation of
state law which says " 16-3-306. Proximity to churches and schools restricted. a retail
license may not be issued pursuant to this code to any business or enterprise whose premises are
within 600 feet of and on the same street as a building used exclusively as a church, synagogue,
or other place of worship or as a school other than a commercially operated or postsecondary
school. This distance must be measured in a straight line from the center of the nearest entrance
of the place of worship or school to the nearest entrance of the licensee's premises. This section
is a limitation upon the licensing deparments authority."
Any person having some basic sense of distance could stand at either the buisiness
or School entrance and see they are closer than 600 feet (200 yards). Are the city
officials really so out of touch that they did not care that this tap room would be
directly across from a school. Now the city is considering the approval of hard
alchohol as well. The city has gone to far in its zealous push to allow easy
establishment of buisiness in bozeman with this tap room location. Please stop this
insanity before it goes any further and vote to reclaim the Tap Room’s application for
public comment and ultimately deny the approval of hard alchohol sales and cosumption directly
across from Hawthorne Elementery school.
